DECLARATION
of 13 August 2025
amending Decree No. 16 / 2016 Coll., on the Conditions for Connection to the Electricity System, as amended
Pursuant to Section 98a (2) (g) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 382 / 2021 Coll., Act No. 469 / 2023 Coll., Act No. 87 / 2025 Coll. and Act No. 223 / 2025 Coll.:
Decree No. 16 / 2016 Coll., on the Conditions of Connection to the Electricity System, as amended by Decree No. 487 / 2021 Coll. and Decree No. 248 / 2024 Coll., is amended as follows:
1. In the introductory sentence of the Decree, the words "to implement § 23 paragraph 1 (a), § 24 paragraph 10 (a), § 25 paragraph 10 (a) and § 28 paragraph 1 (a) of the Energy Act 'are replaced by the words" Act No. 382 / 2021 Coll., Act No. 469 / 2023 Coll., Act No. 87 / 2025 Coll. and Act No. 223 / 2025 Coll.'.
2. in Article 1 (a), the words "electricity storage facilities" shall be inserted after the words "production facilities," and the words "customer demand points" shall be replaced by the words "demand facilities."
3. In Section 1 (b), the words "and with the required power consumption or power output 'are deleted.
4. In Article 2 (b), at the end of the introductory part of the provisions, the words "the value of the electrical power agreed at the point of connection to the transmission system or distribution system in MW 'and points 1 to 3 are deleted.
5. In Article 2 (c), the words "electricity storage facilities," shall be inserted after the words "production plant,"
6. in Article 2 (e), the word "physical" shall be replaced by the words "natural person, natural person undertaking," the words "or the connection of a micro-device to a distribution system" shall be replaced by "connected to a transmission or distribution system," the words "type of production" shall be replaced by "type" and the words "power plant" shall be inserted after the words "power plant";
7. In Article 2, at the end of point (f), the dot is replaced by a comma and the following point (g) is added:
"(g) installed power of the electricity storage facility
1. the sum of the rated output power of the power electronics through which the electricity storage facility is connected to the transmission or distribution system; or
2. the sum of the nominal output of all generators which are part of a power storage facility where the power storage facility is not connected to the transmission or distribution system via power electronics. ';
8. in Article 3 (2) (a), the word "manufacturing" shall be replaced by "equipment."
9. in Articles 3 (2) (b), 4 (1) (d), 4 (1) (f), 8 (6) (c), 12 (2) and 12 (7), the words "or electricity storage facilities" shall be inserted after the words "production plants."
10. in Paragraph 3 (2) (c), "12" is replaced by "5."
11. in Paragraph 3 (2) (f), the word "microbreds" is replaced by the word "procedure."
12. in Paragraph 3 (2), the comma at the end of point (g) shall be replaced by a dot and point (h) shall be deleted;
13. in Article 3 (3):
"(3) The reserve power at the connection point of the installation directly connected to the electrical system or at the connection point of the installation through which another installation is connected may be agreed in the connection contract at the most as a total of the rated power, the sum of the rated power of the power electronics through which the equipment is connected at the connection point and a factor of 1,2 times the sum of the rated power of the generators at the connection point not connected via the power electronics. ';
14. in Article 4 (1) (a), the words "microbreds connected to the distribution system" shall be replaced by "procedure."
15. in Article 4 (1) (c), "9" is replaced by "3."
16. in Article 4 (1) (d), the words "or electricity storage facilities" shall be inserted after the words "production plants."
17. in Paragraph 4 (1), the comma at the end of point (f) shall be replaced by a dot and point (g) shall be deleted;
18. in Paragraph 4 (2):
"(2) In the case of a power storage facility or plant with an installed power of more than 0,5 MW, the application for connection shall also include a timetable for the preparation of the construction of the power storage facility or plant containing the estimated dates.
(a) issuing a binding opinion on the impact of the implementation of the project on the environment, where required by law;
(b) the decision to authorise the project;
(c) start of construction of a power storage plant or plant;
(d) the construction of a plant or plant for the storage of electricity. ';
19. in Paragraph 4 (3), "Annexes 1 to 6" is replaced by "Annex 1";
20. In Article 4, the following paragraph 4 is added:
"(4) The application shall be submitted in paper or electronic form. ';

The production or storage facility may be connected at the customer's sampling point or via another already connected production or storage facility. The connection of the power storage facility or plant at the sampling point is requested and the connection contract is concluded by the customer. The connection of a power storage facility or plant through another power storage facility or facility shall be treated as the connection of the power storage facility or plant at the sampling point, with the application being submitted and the connection contract being concluded by the electricity storage facility manufacturer or operator whose power storage facility or plant is already directly connected to the transmission or distribution system. ';
22. in Article 6 (4), the words "electricity storage facilities" shall be inserted after the words "production plants."
23. in Article 8 (1) (h), the words "and the installed power of the electricity storage facility" shall be inserted after the words "production plants."
24. in Paragraph 9 (4), "12" is replaced by "5."
25. In Article 11 (1) to (4), the words "and with the provision of the required power or power" shall be deleted.
26. in Paragraph 12 (1), the words "Reimbursement of the share of the costs associated with the connection and the provision of the required power or power" shall be replaced by the words "Flat-rate amount to cover the costs associated with the connection of the installation."
27. in Article 12 (1) and (6), "8" is replaced by "2."
28. In Article 12, paragraph 8 is added:
"(8) If the device is requested to be connected to high voltage voltage voltage and higher, the non-refundable share of the eligible cost is 30% of the value of the share in the eligible costs, but not more than CZK 50 000 000, if the reservation of performance or power at the time of its demise lasted less than 12 months, otherwise 50% of the value of the share in eligible costs, but not more than CZK 50 000 000. 29. In Article 15, at the end of the text of paragraph 1, the words "neither electricity storage facilities' shall be added.

31. In Section 16, the word "microbreds' is deleted.
32. In Article 16 (1), the words "or a power storage facility with an installed power up to 10,8 kW 'shall be inserted after the word" micro-unit', and the sentence "The sum of the installed power of all micro-units and the power storage facility connected at the sampling point by the simplified connection shall not exceed 10,8 kW '.
33. in Article 16 (2) and (4), the words "or a power storage facility with an installed power of up to 10,8 kW" shall be inserted after the words "microdroys."
34. in Articles 16 (2) (c) and 16 (4), "10" is replaced by "4."
35. in Article 16 (2), the comma at the end of point (d) shall be replaced by a dot and point (e) shall be deleted;
36. In Article 16 (3), the words "and installations for the storage of electricity with installed power up to 10,8 kW 'are inserted after the words" micro-units' and the words "or installations for the storage of electricity with installed power up to 10,8 kW 'are inserted.

OBLIGATIONS OF THE REQUEST FOR THE APPROACH TO THE TRANSPORT OR DISTRIBUTION SYSTEM
1. Business company (completed by the applicant - entrepreneur registered in the Commercial Register).
2. Data on registration in the Commercial Register, including the file tag (completed by the applicant - entrepreneur registered in the Commercial Register).
3. Name or surname (completed by the applicant not registered in the Commercial Register).
4. Date of birth (completed by the applicant - natural person).
5. Location broken down: State, county, municipality, street and descriptive number, or registration number (completed by the applicant - legal person or natural person undertaking).
6. Name and surname of the person who is the statutory authority or of all persons who are members of the statutory authority (completed by the applicant - legal person).
7. Address of place of stay broken down: State, county, municipality, street and descriptive number, or registration number (completed by the applicant - natural person not in business).
8. Contact - phone, email.
9. Address for delivery.
10. Information about the data box if it has been set up.
11. Person identification number, if assigned.
12. Tax identification number if assigned.
13. The applicant holds a licence for distribution / production / storage of electricity (yes-no). If yes - the licence number shall be indicated.

2. Location of the establishment - region, municipality, cadastral territory, partition numbers of the land on which the establishment is situated, descriptive number, or registration number, cadastral map with location of the connected installation and proposed connection point.
3. Required date of connection; in the case of short-term connections, the duration of the connection shall be indicated.
4. In the case of a plant or plant for the storage of electricity with an installed output of more than 0,5 MW, the timetable for the preparation of the construction of the plant pursuant to Section 4 (2) of this Decree.
5. Consent of the property owner with the location of the connected device on his property.
6. Basic data for connection to the transmission or distribution system:
6.1. Place of connection,
6.2. Voltage level,
6.3. Required reliability of power output and power provision,
6.4. A single-pole scheme of the connected device to enable the application to be assessed,
6.5. Potential for the transmission or distribution system to be reactivated;
6.6. the possibility of island traffic,
6.7. Overflow control at the transfer point,
6.8. performer and compensation.
7. Data on the collection and supply of electricity to and from the transmission or distribution system:
7.1. the existing reserved power input of the connection point and the transfer point, if agreed;
7.2. New required reserved power input of the connection point and transfer point, if agreed,
7.3. the existing reserved power of the connection point,
7.4. new required reserved power of the connection point,
7.5. the total existing installed power of each connected installation,
7.6. the new total installed power of individual connected devices,
7.7. method of connection of 1phase / 3phase.

3.6. Information on whether a power balance service, non-frequency support service or commercial flexibility will be provided through the electricity storage facility;
3.7. island traffic capability.
4. Distribution system:
4.1. type and installed power of connected products4),
4.2. the type and installed power of the electrical storage device (5),
4.3. Data on equipment having a significant influence on the superior transmission or distribution system,
4.4. The voltage levels to be operated by the connected distribution system,
4.5. management of the connected distribution system (technical dispatching, control and surveillance centre).
Notes:
(1) If more than one production module is indicated in the application, the information shall be provided separately for each production module.
(2) The type shall be indicated according to the threshold in accordance with Article 5 of Commission Regulation (EU) 2016 / 631 of 14 April 2016 establishing a network code for requirements for the connection of production facilities to the electricity system.
(3) If more than one electricity storage facility is indicated in the application, the information for each electricity storage facility shall be provided separately.
4) The sum of the installed power of connected production for each type of production shall be reported separately.
(5) The sum of the installed power of connected electricity storage facilities for each type of electricity storage facility shall be reported separately.

Type of connection A is such a connection where the distribution system operator expands the distribution system to the point of the applicant's facility by the management or, where appropriate, the distribution plant or part of the distribution plant.
The method of connection type A1 shall be such that the distribution system operator expands the distribution system by a line or, where appropriate, a distribution station or part of a distribution station to a location other than that of the applicant's installation and is not a type A2 connection. In this case, the applicant's measure shall be 70% of the share for type A connection.
The type A2 connection is such that the distribution system operator attaches the applicant's equipment to the grid of a distribution system of very high voltage or high voltage. In this case, the applicant's measure shall be 30% of the proportion for type A connection.
Type of connection B is a connection that does not meet the conditions of type A, A1 or A2 connections.
In the case of a degraded reservation of power or power for an applicant's installation already connected to the distribution system, or in the case of an application for an increase of the reserved power or power, the current method of connecting the applicant's equipment, assessed under this Order, shall apply to determine the amount of the applicant's share of the eligible costs even if the extension of the distribution system took place before the expiry of this decree. ';
(39) Annexes 3 to 8 are deleted.
Annexes 9 and 10 to date shall be renumbered Annexes 3 and 4.

OBSERVATIONS OF THE REQUEST FOR THE CLOSING OF THE CONTRACT OF ADJUSTMENT OR AMENDMENT OF THE EXISTING CONVENTION TREATY RELATING TO THE APPROACH TO THE MIQUARITY OR ELECTRICITY TREATMENT ESTABLISHED IN THE DISTRIBUTION SYSTEM REFERRED TO IN ARTICLE 16
1. Identification of the customer (business firm, ID number or surname and date of birth, residence).
2. EAN sampling point.
1. Required date of connection.
2. Microbial data:
2.1. The value of installed power of a micro-unit or a power storage facility with installed power up to 10,8 kW;
2.2. For electricity storage installations, its capacity in MWh.
1. A simple documentation of the actual design of a microtube or a device for storing electricity with installed power up to 10,8 kW:
1.1. Technical Report
1.1.1. Description of the installation - type of micro-unit or installation for storage of electricity with installed power up to 10,8 kW.
1.1.2. For a solar energy production plant, the type, number and unit power of photovoltaic panels in kW.
1.1.3. Type, number and label parameters of the generator (in the case of devices connected via power electronics, the parameters of power electronics shall be indicated), active power, apparent power, power factor, number of phases, manufacturer.
1.1.4. The possibility of island traffic.
1.1.5. Types, parameters and values of the protection settings of the production plant or electricity storage facility.
1.1.6. Involvement in a storage facility if installed.
1.2. Drawing documentation
1.2.1. A single-pole diagram of the wiring of a micro-unit or a device for storing electricity with an installed power of up to 10,8 kW, including the connection to the sampling point with a breakdown point.
1.3. Report on the initial revision of electrical equipment containing requirements according to ČSN including measured values of impedance of the fault loop at the connection point (main home cable or fuse box), if the sum of installed power of microdroys and electrical storage devices with installed power up to 10,8 kW is greater than 800 W. '
(41) Annex No 11 is deleted.
Annex 12 is renumbered Annex 5.
Transitional provision
The request for connection, the request for the conclusion of the connection contract or the request for amendment of the connection contract submitted before the date of entry into force of this decree shall be assessed in accordance with Decree No. 16 / 2016 Coll., as effective before the date of entry into force of this decree, including the determination of the proportion of the costs associated with the connection.
