DECLARATION
of 24 January 2025
on telemedicine health services
The Ministry of Health provides pursuant to Section 120 of Act No. 372 / 2011 Coll., on health services and the conditions for their provision (Health Services Act), as amended by Act No. 240 / 2024 Coll., for the implementation of Section 11c (3) of the Health Services Act:
Preliminary provisions
This decree provides
(a) technical requirements for the quality and safety of communication and encryption of the communication channel;
(b) means of demonstrating the identity of the communicating parties;
(c) the method of expressing and recording the patient's consent or disapproval to record the communication log between the provider and the patient.
Technical requirements for communication quality and safety
The quality and safety requirements of communication in the provision of telemedicine health services are provided by the provider by technical solutions which are mandatory for providers through e-health standards under the Act on the Electricationof Healthcare (1).
Encryption of the communication channel
(1) Encryption means ensuring the illegibility of the communication channel without using additional technical means.
(2) Telemedicine health services provided by telephone are provided using the encryption of the communication channel in a manner ensured by the operator-rem2) of the communication network used.
(3) Telemedicine health services provided with audio, audio or visual transmission other than those referred to in paragraph 2 shall be provided using electronic communications services providing the encryption of a communication channel that is active throughout the period of provision of health services.
(4) Remote monitoring of patients by a medical device ("telemonitoring") is carried out using the encryption of the communication channel between the medical device and the provider. More detailed conditions for the encryption of the communication channel in the use of telemonitoring are laid down in the standard of electronic healthcare issued under the Act on the Electronication1).
(5) In the case of the provision of telemedicine health services by means other than those referred to in paragraphs 2 to 4, those other devices shall comply with the encryption condition referred to in paragraph 1 and comply with the rules on personal data protection and with the requirements on cyber security under the Cybersecurity Act (3).
How to demonstrate the identity of the communicating parties
(1) The patient demonstrates his identity
(a) in a pre-arranged manner; or
(b) using electronic identification in accordance with the Electronic Identification Act (4).
(2) A healthcare professional demonstrates his identity
(a) in a pre-arranged manner; or
(b) through the provider's information system, which has allocated access data to its information system under the Health Electronation5 Act.
(3) The pre-arranged method shall be recorded in the medical file.
Method of expressing and recording the patient's consent or disapproval to record the communication log between the provider and the patient
Prior to commencing the provision of the telemedicine health service, the provider shall verify whether the patient agrees to record communication between the provider and the patient. A statement of consent or disapproval to record a communication record may express the patient's explicit or otherwise undoubtful intention. This speech shall be recorded in the medical file.
Efficacy
This Decree shall take effect on the day following that of its publication.
