DECLARATION
of 26 January 2017
to implement the Central Account Accounting Act
The Czech National Bank provides pursuant to § 5 (1), § 7 (4), § 8 (5) and § 19 (2) of Act No. 300 / 2016 Coll., on Central Account Records:
Subject matter
(1) This decree regulates details of particulars, structure, format and method of transmission or delivery
(a) information on the creation, modification or correction of the data transmitted for entry in the central account account records pursuant to Article 5 (1) of the Central Account Records Act ("the Act"); and
(b) notification of the identifiers of the data boxes and their changes.
(2) This decree further regulates the formalities, structure and format of the request for data from central account records.
Data File
(1) For the purposes of this decree, the data set shall mean an electronic data grouping with predefined data structures.
(2) The format and structure of the data file are methodologically described, transmitted and processed as a whole by the information system.
Information on the creation, modification or correction of data in the central account records
(1) The institution shall forward to the Czech National Bank every working day information on the creation, modification or correction of data to the extent provided for in Section 4 of the Act by drawing up the CEU (CNB) 10-99 "Daily overview of changes."
(2) The statement referred to in paragraph 1 shall contain, on a case-by-case basis, all information relating to the creation, modification or repair of accounts held by an institution or to safety deposit boxes leased by a credit institution, including changes in client identification data or the beneficial owner of a client pursuant to § 4 (d) and (e) of the Act, which took place during the preceding day or days, where the statement is also transmitted during the working days.
(3) Where there has been a multiple change in the same figure within one day, all such changes shall be indicated in the statement referred to in paragraph 1.
(4) If there have been multiple changes in one account or in one safety deposit box, each change shall be reported separately, except for changes in client identification data or actual owner of the client that can be reported at the same time.
(5) In the event that there has been no generation, modification or correction of the data relating to the accounts held by the institution or the leased safety deposit boxes during the reporting period, the statement referred to in paragraph 1 shall be transmitted without the completed data.
(6) If the institution finds an error in the statement that was accepted by the Czech National Bank for Processing, it does not correct it but includes the relevant correction as an amendment to the statement drawn up on the date on which the error was detected. The same applies to the institution if the Czech National Bank finds the error and notifies the institution.
Format and manner of transmission of data
(1) The institution shall transmit the report to the Czech National Bank in accordance with Section 4 in electronic form as a data message in the format and structure of the data file.
(2) The data report referred to in paragraph 1 shall be transmitted by means enabling remote access via the web application or user interface of the Czech National Bank collection system.
(3) The data report referred to in paragraph 1 shall be signed by the institution by a recognised electronic signature of the contact person or by sealing the recognised electronic seal of the institution.
(4) The institution will inform the Czech National Bank of the name, address, telephone number and e-mail address of the contact person. The institution shall inform the Czech National Bank of changes to this data without undue delay.
Records of data boxes for communication with central account records
(1) The authorities referred to in Section 7 (3) of the Act will send a notification with a list of identifiers of the data boxes by which they communicate with the central account records to the data box of the Czech National Bank. The data message shall be marked in the field "Case 'by the text" Notification of data boxes for CEO', in the field "Empowerment 'shall contain a reference to Section 7 (3) of the Act and in the field" Hand' shall indicate the text "Central Account Records'.
(2) The notification referred to in paragraph 1 shall be sent in the structure of the CSV format data file available on the Czech National Bank website.
(3) Any changes to the identifiers of the data boxes that occur after the notification referred to in paragraph 1 shall be sent by the authorities referred to in Article 7 (3) of the Act without undue delay in the same way as the notification referred to in paragraph 1, distinguishing between the inclusion of a new data box in the list or the exclusion of an existing data box from the list.
Request for central account records
(1) The request for data shall be made in one account, one safety deposit box or one person.
(2) The request for data shall be submitted to the data box set up by the Czech National Bank for Central Account Records. The identifier of this data box is available on the Czech National Bank website.
(3) The request for data is sent to the Czech National Bank in the XML format data file structure, which is available on the Czech National Bank website.
(4) The data report containing the request for data shall be marked in the field "Case" by the text "Request for data from the CET," in the field "Empowerment," a reference to Section 6 of the Act and in the field "To the hands" shall be entered in the text "Central Account Records." The data report may contain several individual requests for data.
Efficacy
This Decision shall enter into force on 1 June 2017.
