GOVERNMENT REGULATION
of 30 November 2011
amending Government Decree No. 455 / 2009 Coll., establishing, for the purposes of the Criminal Code, which plants or fungi are considered as containing a narcotic or psychotropic substance and which quantities are greater than small within the meaning of the Criminal Code
The Government orders pursuant to § 289 (3) of Act No. 40 / 2009 Coll., Criminal Code:
Government Regulation No. 455 / 2009 Coll., establishing, for the purposes of the Criminal Code, which plants or fungi are considered as containing a narcotic or psychotropic substance and which quantities are greater than small within the meaning of the Criminal Code are amended as follows:
1. In Annex No 1, Part A, point 1, the words "of the total weight of the plant 'are replaced by the words" in the flowering or fertile peak of the hemp plant (excluding grains) including leaves'.
2. In Annex No 1, Part A, points 2 to 4 are deleted.
Point 5 is renumbered point 2.
Efficacy
This Regulation shall enter into force on the day of its publication.
