DECLARATION
of 19 December 2006
on a national transport information system
The Ministry of Transport provides pursuant to § 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended by Act No. 411 / 2005 Coll., for the implementation of § 124 (3) of this Act:
Information affecting road safety and continuity
Information that affects the safety and continuity of road traffic
(a) the immediate density and speed of the traffic current in the localised section of the infrastructure;
(b) traffic accidents where they create an obstacle to traffic or where the investigation or removal of the consequences of an accident prevents continuous traffic on the road;
(c) the fire of vehicles and their costs on or in the immediate vicinity of infrastructure bodies;
(d) fire of objects in the vicinity of the infrastructure, if they may jeopardise the operation of the infrastructure;
(e) road closures and stops (1);
(f) the specific use of the road (2), where there is a restriction on traffic on the road, or where an increased number of pedestrians are present in or in the immediate vicinity of the road,
(g) obstacle to traffic on the road (3);
(h) road repair and maintenance (4);
(i) the state of idleness and roadworthiness defects (5);
(j) infrastructure sections not maintained during the winter period (6);
(k) the meteorological situation and weather conditions affecting the traffic of the infrastructure, the mobility of the infrastructure, the safe movement of vehicles on the road or the limitation of visibility (7);
(l) network accidents (8) in the infrastructure body or in the immediate vicinity of the infrastructure;
(m) failures of road components and accessories 9),
(n) waiting periods due to administrative or other measures;
(o) mandated by the current infrastructure traffic limitation for certain types of vehicles,
(p) restrictions on parking, for example due to block cleaning;
(q) occupancy of detention lots;
(r) danger due to other emergency situations.
Method of collecting information having an impact on road safety and traffic continuity
(1) The police of the Czech Republic, the municipal police, road administrations, infrastructure managers and the Fire Department of the Czech Republic (hereinafter referred to as "information providers") shall collect the information referred to in paragraphs 2 to 6, which falls within their competence or scope of activity, on the basis of the identification or reporting of their employees, as well as through transport equipment, operational information and information systems in transport, if they own or operate them. The information providers may also collect other information referred to in Article 1 which does not fall within their competence or the subject matter of the activity they learn about or receive.
(2) The police of the Czech Republic collect information from the whole territory of the Czech Republic according to § 1 (a) to (c), (g), (l) to (o) and (r) through their information system.
(3) The municipal police shall collect from the territory of the municipalities or municipalities for whose territory they exercise their jurisdiction the information referred to in Article 1 (a) to (c), (g), (l), (m), (o) and (r), through a universal system built within the national transport information system.
(4) Road administrations collect from the infrastructure in which they exercise their jurisdiction the information referred to in Article 1 (e), (f), (j) and (p), through the Central Road Register (10).
(5) Infrastructure managers managing motorways, express roads or I, II and III-class roads and local road managers collect the information referred to in Article 1 (a), (h), (i), (k), (m) and (q) by means of an information system for the management and maintenance of the national road transport information system they manage.
(6) The Fire Department of the Czech Republic collects information pursuant to § 1 (b) to (d), (l) and (r) from the territory of the regions through the information systems of the Regional Operational and Information Centres (11).
Means of transmission of information having an impact on road safety and continuity
(1) Information providers shall transmit the information collected pursuant to Article 2 (1) to the national transport information system in electronic form through the data network.
(2) The information providers use, as a priority, the event or phenomenon of the topographical map of the state map (12) in the geodetic reference system WGS 8413 for the digital geographic location of the site.
(3) The information transmitted contains:
(a) the date and time of creation and, where appropriate, the reporting of the observed event or phenomenon;
(b) the date and time of termination or expected termination of the monitored event or phenomenon or, where applicable, the period of validity of the information;
(c) the type, subtype and extent by code list defined and used in the national transport information system in accordance with international standards for transport and travel information according to ČSN EN ISO 14819-214),
(d) geographical location of the site of the event or phenomenon in digital form using state map works;
(e) the road direction affected by the road communication;
(f) a description of the measures taken and, where appropriate, a description of the current situation on the spot caused by the event or phenomenon under surveillance;
(g) the date and time of receipt of the information and an indication of the provider of the information or, where appropriate, of his staff member who has supplied the information.
(4) Where the information provider is unable to collect and transmit all the data referred to in paragraph 3 or to transmit it in the format referred to in paragraph 3 (c) within the scope of its competence or scope of activity, it shall transmit the information as incomplete to the extent of the information available to it.
Disclosure of information affecting road safety and continuity
(1) The information transmitted to the national transport information system as incomplete in accordance with Article 3 (4) shall be verified in the system for publication by adding missing data in accordance with Article 3 (3).
(2) The Ministry of Transport, or the person authorised by it, shall publish the information referred to in Article 1 in a manner that allows remote access, including publication on the Public Administration Portal, and also through a reference data interface for information systems of information providers and public authorities.
Efficacy
This Decree shall take effect on 1 March 2007.
