DECLARATION
of 1 September 2003
on measures to prevent and combat diseases and diseases communicable from animals to humans
The Ministry of Agriculture provides, pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., ("the Act ') for the implementation of Sections 6 (9) (d) and (e) and 10 (3) of the Act:
Preliminary provisions
This decree implements the relevant provisions of the European Union( 1) and, following the directly applicable provisions of the European Union( 1a), regulates
(a) general measures to combat and prevent the spread of animal diseases;
(b) the manner and time limits for the notification of diseases;
(c) the procedure, the processing aspects and the content of contingency plans for the occurrence of certain dangerous diseases;
(d) for which diseases animal health programmes are drawn up;
(e) animal health conditions and rules on animal vaccination;
(f) requirements for national reference laboratories;
(g) measures to combat and prevent the spread of certain dangerous diseases;
(h) the aspects under which the recognition of herds, holdings, zones or states is to be carried out as disease-free.
For the purposes of this decree, the term
(a) the animal - any livestock and pet animal of the species which may be directly affected by the relevant disease and any wild vertebrate animal which might be involved in the production or spread of the relevant disease as a carrier or reservoir of its agent;
(b) a primary outbreak of the disease - a holding or other place where the animals are collected and where one or more cases of the disease not related from an epidemiological point of view to an outbreak previously found in the same area or an outbreak which is the first outbreak of that disease in another area have been officially confirmed;
(c) confirmation of the disease - official detection of the presence of the disease, supported by laboratory results, where appropriate, if the epizootic disease is the result of a clinical examination or an epidemiological investigation, and which is the reason for the regulation of protection and control measures;
(d) vector - any animal belonging to vertebrate animals or invertebrates which may mechanically or biologically transmit and spread agents of the relevant disease;
(e) incubation period - the period from the time when the animal came into contact with the agent of the disease to the time when clinical signs of the disease occurred. For certain diseases, the duration of this period is listed in Annex 1 to this Decree,
(f) animals of susceptible species - any domestic or wild animal which may be infected by a disease;
(i) sampling - sampling from animals and their environment or products of animal origin, ensuring a statistically correct representation to be carried out for the purpose of diagnosis of disease, kinship, health monitoring, monitoring of the presence of microbiological agents or certain substances in animal products;
(j) a sample - a sample taken either by the breeder, owner or person responsible for the holding, undertaking or animals, or on their behalf for laboratory examination;
(k) official sample - sample taken by the official veterinarian for laboratory examination,
(l) kitchen waste - any waste of food intended for human consumption from restaurants, food establishments or kitchens, including livestock farmers' homes, and, where appropriate, from the meat processing industry.
GENERAL MEASURES FOR PREVENTION AND DISTINCTION
ENTERTAINMENT PLANS AND HEALTH PROGRAMMES
Contingency plans
(1) The State Veterinary Administration shall, in accordance with Article 48 (1) (c) of the Act, draw up and update, in accordance with the criteria set out in Annex 3 to this Regulation and in accordance with the principles for drawing up contingency plans, national contingency plans for the occurrence of the diseases listed in Annex 1 to this Regulation and, where required, of certain other dangerous diseases. Those plans shall include comprehensive rules to ensure an effective and coordinated procedure for the implementation of emergency veterinary measures to control and prevent the spread of the disease and ensure the availability of everything deemed necessary for the rapid eradication of outbreaks, including buildings, equipment, devices and materials.
(2) The Regional Veterinary Administration shall draw up and update regional contingency plans in accordance with national contingency plans and taking into account local conditions.
(3) The State Veterinary Administration shall submit national contingency plans to the Commission for approval.
(1) The State Veterinary Administration, in accordance with Articles 10 (1) and 48 (1) (c) of the Act, regulates and complements national contingency plans in particular with regard to the development of the disease situation and the development of knowledge and experience relating to the nature and control of the individual diseases.
(2) Regional veterinary administrations shall, in accordance with Articles 10 (1) and 49 (1) (a) of the Act, draw up, modify and supplement regional contingency plans on the basis of national contingency plans, taking into account local conditions.
Animal health programmes
(1) The State Veterinary Administration shall, taking into account the state and development of the disease situation, draw up draft annual or multiannual programmes for the recovery of animals from certain dangerous diseases, in particular from the diseases referred to in the European Union Decision on expenditure in the veterinary field (1b).
(2) Animal health programmes are drawn up as programmes for the eradication, control and monitoring of a disease.
(1) Where a financial contribution from the European Union (hereinafter referred to as the Union) is to be required to finance the animal welfare programme, the State Veterinary Administration shall act in accordance with the Decision of the European Union on expenditure in the veterinary field (1c).
(2) The animal health programme contains the information required by the European Union decision on expenditure in the veterinary field (1c).
REPORTING OF DISEASES AND EVIDENCE OF ANIMALS
Disease reporting
(1) The State Veterinary Administration shall report to the Commission and the other Member States on the occurrence of disease from diseases referred to in European Union rules on disease notification (1d).
(2) The State Veterinary Administration shall report in accordance with paragraph 1:
(a) a primary outbreak of the disease referred to in paragraph 1, detected in the territory of the Czech Republic;
(b) after the last outbreak of that disease has been disposed of, the end of the protection and control measures introduced to control it.
(3) The report referred to in paragraph 2 shall be submitted directly by the State Veterinary Administration to the Commission and to the other Member States within 24 hours of:
(a) the detection of the primary outbreak referred to in paragraph 2 (a);
(b) the end of the safeguard and enforcement measures referred to in paragraph 2 (b).
(4) If there is an outbreak of classical swine fever, it is sufficient to provide the Commission and the other Member States with the information provided for in Article 39.
(5) The report contains the information set out in Annex 2 to this Decree; it is transmitted by telex using the coded form and codes established by the European Union Decision on the method of reporting the disease 1e).
(1) The State Veterinary Administration shall also report directly to the Commission any additional (secondary) outbreak of the disease referred to in Section 7 (1) found in the Czech Republic.
(2) The report referred to in paragraph 1 shall be submitted by the State Veterinary Administration not later than the first working day of each week and shall cover the week ending at midnight on the Sunday preceding the report.
(3) Paragraph 7 (5) shall apply mutatis mutandis to the content and manner of transmission of reports.
The State Veterinary Administration shall report to the International Office of Disease (OIE) the occurrence of diseases in accordance with the decision of that Office on the single list of diseases and on the introduction of a new reporting system1f).
Vaccination of animals
(1) Except where otherwise provided, vaccination of animals against the diseases listed in Annex 6 to this Regulation may only be carried out in the cases and under the conditions laid down in European Union rules and in this Regulation as part of the protection and control measures ordered in the event of the presence of the relevant disease, provided that:
(a) the introduction of vaccination under those measures shall be based in particular on the following criteria:
1. the concentration of animals of the species concerned in the infected area;
2. the type, characteristics and composition of the vaccines used,
3. methods for controlling the distribution, storage and use of vaccines;
4. the species, category and age of animals which may or must be vaccinated,
5. the areas where vaccination may or must be carried out;
6. duration of vaccination,
(b) The Commission has taken a decision to supplement the protection and control measures concerning vaccination of animals.
(2) However, the vaccination referred to in paragraph 1 may not:
(a) vaccinated or re-vaccinated animals of susceptible species on the holdings referred to in Article 13 (1);
(b) a hyperimmune serum is used.
(3) The veterinary authorities lay down detailed conditions in the protection and control measures allowing vaccination of animals
(a) the implementation and course of vaccination;
(b) the procedure where clinical signs of the disease in the vaccinated animal are detected or killed.
(4) Only registered vaccines and other substances authorised for use in the provision of veterinary care are eligible for vaccination.
(1) Where the European Union provisions on measures to prevent and combat diseases so require, the veterinary authorities shall require the protection and control measures to ensure that all vaccinated animals:
(a) have been identified by means of a clear and easily legible indication in the manner laid down by European Union rules on measures to prevent and combat diseases and, where appropriate, in the manner laid down by the State Veterinary Administration;
(b) remain in the vaccination area except for those animals which are sent to slaughterhouses designated by the Regional Veterinary Administration for immediate slaughter. They may be moved only after examination of all animals of susceptible species on the holding by an official veterinarian confirming that none of the animals examined are suspected of being infected.
(2) Where vaccination of animals is completed, the movement of animals of species susceptible to the detected disease from the vaccination zone may be allowed only on the basis of the measures taken by the Commission after the expiry of the period laid down by it.
(3) The State Veterinary Administration shall regularly inform the Commission, through the Standing Committee on the Food Chain and Animal Health (the Standing Committee), of the results of the vaccination carried out.
By way of derogation from Article 10 (1), emergency vaccination may only be decided upon after the Commission has informed the Commission of this measure and unless this affects the essential interests of the Union in the field of animal health. This decision shall take into account, in particular, the degree of concentration of animals in the areas concerned, the need to protect individual herds and holdings and the geographical area where vaccination is carried out. The next emergency vaccination procedure depends on whether the Union institutions agree to continue it or whether they conclude that the measures concerning such vaccination need to be amended, extended or terminated.
PROCEDURE IN CONNECTION AND DISTINCTION
(1) If animals suspected of being infected or suspected of being infected ("suspected animals") on the holding are one of the diseases listed in Annex 1 to this Decree, the Regional Veterinary Administration in accordance with Sections 13 and 49 (1) (d) of the Act
(a) immediately, in the framework of the exercise of national veterinary supervision, the holding shall be subject to targeted surveillance (hereinafter referred to as "surveillance") and investigation of suspected animals in order to confirm or exclude the presence of the relevant disease, including sampling for laboratory examination. To this end, suspected animals may be transported to the laboratory under national veterinary supervision and under appropriate measures to prevent the spread of the disease;
(b) order the breeder in particular to:
1. add up all animals of species susceptible to the disease and record for each category the number of animals already dead, infected and suspected. In addition, they shall order the breeder to update these data in order to take into account animals born or dead during the period of suspicion and to submit them on request to the authorities carrying out national veterinary surveillance in order to be able to check them during each inspection carried out on the holding,
2. all animals of species susceptible to the disease in question which are on the holding have been kept at their housing sites and, where appropriate, at other places allowing their quarantine and ensuring that they are not moved from or to the holding. The Regional Veterinary Administration shall take into account the possible role of vectors as appropriate,
3. have placed appropriate disinfectants in the entrances to, and exits from, buildings, premises and places where animals of susceptible species are housed, as well as when entering and leaving the holding and from the holding.
(2) Any movement of persons, animals of other species, not susceptible to the disease in question, means of transport, animal products, carcases of dead or killed animals and other animal by-products not intended for human consumption 1h), tools, feed, litter, manure, urinals and other objects or materials which may transmit disease agents from or to the holding shall be subject, in accordance with Sections 13 and 49 (1) (d) of the Act, to the approval of the Regional Veterinary Administration, which also lays down conditions to prevent any risk of spread of the disease.
(3) The Regional Veterinary Administration, in accordance with Articles 13 (1) (d) and 49 (1) (d) of the Act, carries out an epidemiological inquiry in which it monitors:
(a) the period during which the disease may have occurred on the holding before it was declared or suspected of occurring;
(b) the possible origin of the disease on the holding and the identification (s) of other holdings where animals of susceptible species are suspected;
(c) movement of persons, animals, means of transport, animal products, animal by-products, tools, feedingstuffs, bedding, manure, urinals and other objects or materials which may transmit the disease agent, from or to the holding;
(d) the possible occurrence and spread of vectors.
(4) Pending the imposition of the safeguard and enforcement measures referred to in paragraph 1 (b) and paragraph 2, the breeder shall, in accordance with Article 12 (1) of the Act, take appropriate measures corresponding to the same purpose.
(1) The safeguard and enforcement measures referred to in Article 13 (1) (b), (2) and (3) may also be adopted in relation to other contact holdings.
(2) The protection and control measures referred to in Article 13 shall continue until they are terminated in view of the exclusion of suspected outbreaks.
(1) Where the presence of one of the diseases listed in Annex 1 to this Regulation has been confirmed on the holding, the Regional Veterinary Administration shall carry out an epidemiological inquiry in accordance with Article 13 (3) and shall, in accordance with Articles 15 and 49 (1) (d) of the Law on protection and control measures referred to in Article 13 (1) (b) and (2), order further protective and control measures, namely:
(a) the immediate killing and, where appropriate, the slaughter of all animals of susceptible species on the holding. The carcases of dead and killed animals shall be disposed of in the rendering plant or burned or buried, preferably on site, in accordance with the directly applicable European Union Regulation laying down health rules for animal by-products (2). Such activities shall be carried out in such a way as to minimise the risk of spreading the disease agent;
(b) disposal or appropriate treatment or treatment of certain objects or materials, such as tools, feed, bedding, manure and urinals, which may transmit the disease agent. This treatment, carried out in accordance with the instructions of the Regional Veterinary Administration, is intended to ensure the destruction of the disease agent or its vector;
(c) after compliance with the protective and protective measures referred to in (a) and (b) cleaning and disinfection, where appropriate, disinsecting and exerting buildings in which animals of susceptible species are housed and their immediate surroundings, as well as means of transport and any equipment likely to be contaminated, in the manner and under the conditions set out in Article 21.
(2) Where the burial of carcases of dead and killed animals and other animal by-products is ordered, they shall be carried out at the burial sites specified in the emergency plans of the county or contingency plans. If it is not possible to use these burial sites, burial is carried out at sufficient depth (Section 40 (4) of the Act) so that these carcases and other animal by-products which may be carriers of the disease cannot be dug up by carnivorous animals and in a suitable place to prevent contamination of the groundwater and any pollution of the environment.
(3) The protection and control measures referred to in paragraph 1 may be extended to contact holdings where there are grounds for suspecting their possible infection.
(4) The national crisis centre and the regional crisis control centres coordinate protective and control measures to combat the disease as quickly as possible, as well as to carry out an epidemiological investigation.
(1) The Regional Veterinary Administration may, in accordance with Articles 15 and 49 (1) (d) of the Act on an infected holding consisting of 2 or more separate production units, waive the requirements laid down in Article 15 (1) (a) in the case of infested production units, provided that the official veterinarian confirms that:
(a) the structure and size of these units and the activities carried out under them guarantee their separation as regards stables and equipment, feed, feeding and personnel; and
(b) their separation makes it impossible to transmit the disease from one unit to another.
(2) Where the Regional Veterinary Administration concludes that the disease may have been introduced
(a) from other holdings to the holding referred to in Article 13, or vice versa, to other holdings as a result of the movement of persons, animals, means of transport or any other means of transport, those other holdings shall be monitored in accordance with Article 13 until the suspicion of the presence of the disease is ruled out;
(b) from other holdings to the holding referred to in Article 14, or vice versa, to other holdings as a result of the movement of persons, animals, means of transport or any other means of transport, those other holdings shall be monitored in accordance with Article 13 until the suspicion of the presence of the disease is ruled out, or until the longest incubation period of the relevant disease has elapsed since the date of its likely introduction into the holding, determined following an epidemiological inquiry.
(3) Where the Regional Veterinary Administration concludes that the conditions allow this, the measures provided for in paragraph 2 may be limited to only part of the holding and to animals present therein, but only if the holding complies with the requirements referred to in paragraph 1 or if the measures may be applied only to animals of species susceptible to the disease in question.
(1) Where the presence of the disease has been confirmed, the Regional Veterinary Administration shall establish a protection zone with a radius of not less than 3 km and a surveillance zone with a radius of not less than 10 km, if necessary an additional restricted zone.
(2) The demarcation of the protection and surveillance zones shall take into account, in particular, epidemiological, geographical, administrative and ecological factors related to the disease concerned, on the one hand, to the disease control organisation and to the authorities which decide on protection and control measures and ensure that they are implemented.
(3) The Regional Veterinary Administration shall, in accordance with Article 49 (1) (d) of the Act, take all necessary measures, including ensuring the deployment of significant signs and warnings, as well as cooperation with the media, in order to ensure appropriate information on protection and surveillance measures within the protection and surveillance zones and the application of such measures.
(4) Where the zone referred to in paragraph 1 affects the territory of a neighbouring State, the Regional Veterinary Administration shall cooperate in defining it with the competent authorities of that State.
(5) The State Veterinary Administration may, in accordance with Article 48 (1) (o) (2) of the Act, request the Commission to reduce or increase the zones referred to in paragraph 1 and to change the duration of the safeguard and control measures. taking into account geographical and ecological factors, meteorological conditions, presence, spread and vector type, the results of the epidemiological investigation and laboratory tests and the effectiveness of the protection and control measures applied.
(1) The Regional Veterinary Administration shall, in accordance with Articles 15 and 49 (1) (d) and (f) of the Act, ensure that the following protection and enforcement measures are applied in the protection zone:
(a) the identification (inventory) of all holdings with animals of susceptible species within the zone;
(b) regular veterinary checks on holdings with animals of susceptible species and clinical examination of such animals, including, where appropriate, sampling and laboratory testing. The number and frequency of checks shall be proportionate to the severity of the disease in those holdings presenting the greatest risk. Checks, tests and results shall be kept on record;
(c) a ban on the movement and transport of animals of susceptible species on public and private roads, with the exception of special purpose communications within the holding. Exceptionally, the Regional Veterinary Administration may authorise the transport of animals by road or rail on condition that such transport takes place without transhipment and without stop;
(d) a prohibition on the movement of animals of susceptible species from the holdings on which they are located, other than their direct transport under the supervision of an official veterinarian for the purposes of immediate slaughter, to slaughterhouses situated in the protection zone or, if there are no such slaughterhouses in the protection zone, to slaughterhouses in the surveillance zone designated by the Regional Veterinary Administration. However, the Regional Veterinary Administration shall authorise such transport only after examination of all animals of susceptible species on the holding by an official veterinarian confirming that none of the animals is suspected of being infected. Where there are slaughterhouses in the territorial district of another county veterinary administration, that county veterinary administration shall be informed in advance of such transport.
(2) The protective and control measures applied in the protection zone must be complied with at least until the longest incubation period of the relevant disease has elapsed after the animals have been removed from the infected holding in accordance with Article 15 (1) (a) and after cleaning and disinfection in accordance with Article 21. Where the disease is transmitted by insects, the Regional Veterinary Administration may, in accordance with Articles 15 and 49 (1) (d) of the Act, provide for a different duration of the protective and control measures applied, and, if necessary, provide for an observation period for housing control susceptible animals as biological indicators of the disease.
(3) The State Veterinary Administration shall inform the Commission and the other Member States through the Standing Committee of the protective and protective measures taken.
(4) After the expiry of the period referred to in paragraph 2, the protection and control measures provided for in the surveillance zone shall apply in the protection zone.
(1) The Regional Veterinary Administration shall, in accordance with Articles 15 and 49 (1) (d) and (f) of the Act, ensure that the following protection and enforcement measures are applied in the surveillance zone:
(a) the identification (inventory) of all holdings with animals of susceptible species within the zone;
(b) the prohibition on the movement of animals of susceptible species on public roads, with the exception of the dispatch of animals on pasture or the movement of animals to stables intended for them. Exceptionally, the Regional Veterinary Administration may authorise the transport of animals by rail or road on condition that such transport takes place without transhipment and without stop;
(c) the transport of animals of susceptible species within the zone is subject to the approval of the Regional Veterinary Administration;
(d) the prohibition on the movement of animals of susceptible species within the zone for at least a period corresponding to the longest incubation period of the relevant disease since the last recorded case of the disease. After that period, the animals may be moved from the surveillance zone and transported by direct transport under the supervision of an official veterinarian for immediate slaughter to a slaughterhouse designated by the Regional Veterinary Administration. However, the Regional Veterinary Administration shall authorise such transport only after examination of all animals of susceptible species on the holding by an official veterinarian confirming that none of the animals is suspected of being infected. Where there are slaughterhouses in the territorial district of another county veterinary administration, that county veterinary administration shall be informed in advance of such transport.
(2) Paragraph 18 (2) shall apply mutatis mutandis for the period of compliance with the protection and control measures applied in the surveillance zone.
(1) Where the prohibition on protective and control measures referred to in Articles 18 (1) (d) and 19 (1) (d) are applied for a period of more than 30 days as a result of the occurrence of new cases of disease and resulting in animal housing difficulties, the Regional Veterinary Administration may, in accordance with Articles 17 (3) and 49 (1) (d) of the Act, authorise the movement of animals from a holding situated in a protection or surveillance zone, provided that the breeder has verified the facts and reasons stated and that:
(a) all animals on the holding have been examined;
(b) the animals to be transported have been clinically tested with negative results;
(c) each animal is registered and marked in accordance with the breeding law, 3)
(d) the holding of destination is either situated within or within the protection zone.
(2) In relation to the transport referred to in paragraph 1, the necessary measures shall be taken to prevent the spread of the disease agent, in particular cleaning and disinfection of the means of transport after the transport has taken place.
(1) The cleaning, disinfection, disinsecting and exerting of the infected holding ordered by the protection and control measures are carried out
(a) in a way which excludes any risk of spreading or surviving the disease agent;
(b) disinfectant, disinfectant and exterminator in concentrations approved by the Regional Veterinary Administration;
(c) in accordance with the instructions of the Regional Veterinary Administration and under the supervision of an official veterinarian.
(2) Following the completion of the cleaning, disinfection, disinfecting and exerting operations, the Regional Veterinary Administration shall verify that all the measures ordered have been properly complied with, including the specific procedures laid down for certain diseases, and that a reasonable period of time has elapsed, as a general rule for at least 21 days, to ensure complete control of the disease prior to the start of new animal husbandry (repopulation) on the holding.
The repopulation on the holding shall be subject to the approval of the Regional Veterinary Administration in accordance with § 15 and § 49 (1) (d) of the Act, which shall issue it if, according to the results of the inspection carried out by the official veterinarian, cleaning and disinfection have been carried out and, where appropriate, disinsecting and exterminating according to § 21.
If the infected or suspected wild animals are present, the Regional Veterinary Administration shall take appropriate measures, appropriate to the nature of the disease, the possibilities for its spread, the method of its control and local conditions. The State Veterinary Administration shall inform the Commission and the other Member States through the Standing Committee of the measures taken in accordance with Article 48 (1) (o) (2) of the Act.
(1) Samples taken for laboratory testing to detect the presence of the disease agent shall be examined in accordance with Section 52 (4) of the Act by the national reference laboratories, competent for each disease, or by reference laboratories, technically and staffing, so that they can detect at any time, in particular when the disease is first present, the type, subtype and variant of the agent concerned, as well as other laboratories referred to in Section 52 (3) of the Act. They shall apply diagnostic methods established in accordance with individual procedures and methods approved by the Union authorities for the diagnosis and control of the relevant disease or otherwise in accordance with European Union rules on disease prevention and control measures.
(2) National Reference Laboratory
(a) be responsible for coordinating the standards and diagnostic methods used in the diagnosis of the diseases concerned and for testing vaccines;
(b) may provide diagnostic reagents to other diagnostic laboratories;
c) checks the quality of diagnostic reagents used in the Czech Republic;
(d) carry out regular comparative tests on the diagnostic methods used;
(e) keep isolates of the viruses of the relevant diseases from cases confirmed in the Czech Republic;
(f) ensure confirmation of positive results obtained in other diagnostic laboratories;
(g) cooperate with the relevant reference laboratories within the Union.
(3) The State Veterinary Administration shall keep and keep up to date the list of national reference laboratories and make it available, including any subsequent amendments, to the other Member States and to the public.
(1) Unless otherwise provided for in the provisions of Part Two on specific control and control measures for certain diseases, Sections 13 to 24 also apply to the control and control of those diseases.
(2) For the control and control of the disease, which is not listed in Annex 1 to this Regulation or in the provisions of Part Two on specific control and control measures for certain diseases, paragraphs 13 to 24 shall apply mutatis mutandis, taking into account the nature and severity of the disease in question, the possibilities for its spread and the manner in which it is spread and the local conditions.
SPECIAL PRECAUTIONS FOR THE PRESENT OF CERTAIN DISEASES
_
The occurrence of swine vesicular disease is confirmed, as opposed to the confirmation of the disease referred to in Article 2 (c),
(a) on a holding where:
1. the swine vesicular disease virus has been isolated either from pigs or from the environment;
2. pigs which are seropositive for swine vesicular disease, provided that such or other pigs on the holding show changes characteristic of the disease; or
3. pigs with clinical signs of swine vesicular disease or are seropositive, provided that there is a direct epidemiological link to a confirmed outbreak;
(b) other herds where seropositive pigs are detected. In this case, further testing shall be carried out by the Regional Veterinary Administration prior to confirmation of the presence of the disease, in particular re-random testing at intervals of at least 28 days from the previous sampling. The protective and enforcement measures provided for in Article 13 shall remain in force until such additional examinations have been completed. If additional tests do not demonstrate the presence of that disease and the pigs tested are still seropositive, the Regional Veterinary Administration shall order that they be killed and destroyed under the supervision of an official veterinarian, or slaughtered in a slaughterhouse for that purpose. These pigs must be kept and slaughtered in slaughterhouses separately from other pigs and their meat must be intended exclusively for the domestic market.
(1) Where the presence of swine vesicular disease has been confirmed, the Regional Veterinary Administration shall, in accordance with Articles 15 and 49 (1) (d) of the Act, ensure that the following protection and control measures are applied in the protection zone:
(a) identification (inventory) of all holdings where animals of species susceptible to the disease are;
(b) regular veterinary checks on holdings of animals of species susceptible to the disease and clinical examination of such animals, including, where appropriate, sampling and laboratory testing of such animals. The number and frequency of checks shall be proportionate to the severity of the disease in those holdings presenting the greatest risk. Checks, tests and results shall be kept on record;
(c) a ban on the movement and transport of pigs on public and private roads, with the exception of special purpose roads within the holding. Exceptionally, the Regional Veterinary Administration may, in accordance with Articles 15 and 49 (1) (d) of the Act, authorise the transport of pigs by road or rail on condition that such transport takes place without transhipment and without stop. However, in accordance with Section 48 (1) (o) (2) of the Act, the State Veterinary Administration may also request an exemption from the Commission for slaughter pigs coming from holdings outside the protection zone which are transported to slaughterhouses situated in that zone.
(d) means of transport and equipment (equipment) used within the protection zone for the transport of pigs, other animals or materials which could be contaminated (feed, litter, manure, urinals, etc.) shall not leave the holding within the protection zone, protection zone or slaughterhouse without being cleaned and disinfected in accordance with the instructions of the Regional Veterinary Administration in accordance with § 15 and § 49 (1) (d) of the Act. In particular, these instructions must ensure that no means of transport used to transport pigs leaves the protection zone without being checked by an official veterinarian;
