of 15 June 2020
on the content and extent of the information which the small-scale aid provider is required to record in the central register of small-scale aid and on the procedure for recording it
The Ministry of Agriculture and the Office for the Protection of Competition provides pursuant to Article 9 of Act No. 215 / 2004 Coll., on the modification of certain relations in the field of public aid and on the amendment of the Act on Support for Research and Development, as amended by Act No. 109 / 2009 Coll., Act No. 236 / 2012 Coll., Act No. 104 / 2017 Coll. and Act No. 183 / 2017 Coll.:
§ 1
Subject matter
This decree provides
(a) the content and scope of the data which the small-scale aid provider is obliged to record in the central register of small-scale aid (hereinafter the "central register") pursuant to the directly applicable European Union1 Regulation; and
(b) the procedure for recording small-scale support data in the central register.
§ 2
Definition of terms
For the purposes of this decree:
(a) the relevant period for the previous 3 years;
(b) the conversion rate for the European Central Bank at the date of granting of small-scale support;
(c) by identifying the beneficiary, the data identifying the natural or legal person as the beneficiary of small-scale aid;
1. natural persons shall have at least the name and surname, date of birth or identification number and address of the place of residence or place of business;
2. legal persons shall have at least the trade name, identification number and address of the registered office.
§ 3
Content and extent of data to be recorded in the central register
(1) The small-scale aid provider records the following information in the central register:
(a) identification of the beneficiary of small scale aid;
(b) the amount of aid granted to the beneficiary of small-scale aid, rounded to two decimal places in mathematics, determined in CZK and converted at a conversion rate of EUR or EUR,
(c) identification of the area of small-scale aid granted under the directly applicable European Union Regulation (1);
(d) the date on which the aid was granted on a small scale;
(e) identification of the legal act granting small scale aid to the beneficiary determining the date on which the aid was granted;
(f) identification of the small-scale aid provider;
(g) the form of small-scale aid granted under the directly applicable European Union Regulation (1);
(h) the purpose of the small-scale aid granted;
(i) the type of small-scale aid measure under the directly applicable European Union Regulation (1); and
(j) the sector concerned on the basis of the statistical classification of economic activities in the European Union.
(2) If the beneficiary of small-scale aid is a financial intermediary, the small-scale aid provider in the area outside agricultural primary production, primary production of fishery and aquaculture products or services of general economic interest shall also record the financial intermediary's designation and the date of receipt of the quarterly report in accordance with the directly applicable European Union2.
§ 4
Procedure for recording data in the central register
(1) The data provided for in Section 3 shall be recorded in the central register in a manner which allows remote access by means of an electronic form.
(2) Information on the beneficiary of small-scale aid, the amount of small-scale aid within the relevant period and the identification details of the small-scale aid provider in question is entered in the central register of the provider authorised to access the central register.
§ 5
Repeal
Decree No. 465 / 2009 Coll., on the data recorded in the central register of small-scale aid, is repealed.
§ 6
Efficacy
This Decree shall take effect on 1 July 2020, with the exception of the provisions of Article 3 (j), which shall take effect on 1 September 2020.
