of 22 June 2020
amending Government Regulation No. 30 / 2014 Coll., laying down binding rules on the provision of financial contributions to forest management and selected hunting activities, as amended
The Government mandates pursuant to § 46 (9) of Act No. 289 / 1995 Coll., on Forests and on the amendment and amendment of certain laws (Forest Act), as amended by Act No. 501 / 2012 Coll., and pursuant to § 62 (2) of Act No. 449 / 2001 Coll., on hunting, as amended by Act No. 501 / 2012 Coll. and Act No. 357 / 2014 Coll.:
Government Regulation No. 30 / 2014 Coll., on the establishment of binding rules on the provision of financial contributions to forest management and selected hunting activities, as amended by Government Regulation No. 308 / 2014 Coll., Government Regulation No. 51 / 2015 Coll., Government Regulation No. 209 / 2016 Coll. and Government Regulation No. 245 / 2018 Coll., is amended as follows:
1. in Article 2 (1) (a), the words "military forests" shall be replaced by the words "forests on land which are objects of importance for State defence (31) (hereinafter referred to as" military forests ")."
2. In Paragraph 2 (1), at the end of the text in point (b), the words "or where the application for a financial contribution pursuant to Part Three of this Regulation is made and the subject of the financial contribution has been met on land in national parks' shall be added.
3. in Article 2 (1), the following point (d) is inserted after point (c):
"(d) the Ministry of Agriculture, where the application for a financial contribution pursuant to Part Three of this Regulation is made and the subject of the financial contribution has been met on land intended for State defence,";
Point (d) shall be renumbered as point (e).
4. In Paragraph 2 (1), the words "and the subject of the financial contribution was met on other parcels' shall be added at the end of the text in point (e).
5. In Article 2 (7) and (8), the text "IV 'is deleted.
6. In Article 2 (7), the words "the applicant 'are inserted after the words" the Office of Notification' and the words "30 June 'are replaced by the words" the end of the calendar year for which the declaration is submitted'.
7. In Article 2, at the end of paragraph 8, the sentence "The information contained in the declaration shall also be provided by the applicant to the competent regional authority electronically published by the Ministry of Agriculture on its website. '
8. In Paragraph 2 (9), the words "the Ministry of Agriculture 'shall be inserted after the words" the environment'.
9. In Article 2, paragraphs 10 and 11 are added:
"(10) A financial contribution shall not be granted unless the conditions laid down in this Regulation are met.
(11) A financial contribution shall not be granted where the subject of the financial contribution has been financed or approved for financing from other public sources. ';
10. in Article 3 (2) and Article 35 (2), the words "if not State owned" shall be replaced by the words "if the applicant is not a state enterprise."
11. In Articles 3 (4), 4 (3), 12 (3), 35 (4) and 35 (4) and 35 (4), the words "after the subject matter of the financial contribution has been fulfilled but no later than 30 June for the period of validity of the declaration" shall be replaced by the words "immediately following the month in which the subject of the financial contribution was met."
12. in Article 3 (5), "Annex No 2" is replaced by "Annexes No 2 to 4";
13. In Article 3, paragraph 8, including footnotes 3 to 6, is deleted.
Paragraphs 9 and 10 shall be renumbered paragraphs 8 and 9.
14. footnote 7 reads:
"(7) Decision No C (2019) 8643 of 27 November 2019 on aid scheme SA.54137 (2019 / N). '.
15. in Paragraph 4 (1):
"(1) A financial contribution for the renewal, securing and rearing of forest areas up to 40 years of age may be granted to the forest owner or person referred to in Article 2 (5). This financial contribution shall be granted, if not for forests in the territory of national parks and their protection zones. ';
footnote 8 is deleted, including the footnote reference.
16. in Article 4 (2) at the end of point (f) and in Article 35b (3) (c), the word "or" shall be deleted.
17. in Article 4, at the end of paragraph 2, the dot is replaced by a comma and the following points (h) and (i) are added:
"(h) the establishment of new fences; or
(i) follow-up care for planting forest crops. ';
18. in Paragraph 4 (4), "Annex 3" is replaced by "Annexes 2 and 3";
19. in Article 4 (5) and 12 (5), the second sentence shall be deleted;
20. Paragraph 4 (7) is deleted.
21. in § 5 (2) (b) and in § 13 (2) (b), the words "the parameters of the natural rejuvenation of individuals are respected" shall be replaced by the words "the parameters of the seeds have been reached."
22. In footnote 12, "5 'is replaced by" 6'.
23. in Article 6 (2), the following point (b) is inserted after point (a):
"(b) the seed parameters laid down by other legislation9 have been achieved,"
Points (b) and (c) shall be renumbered (c) and (d).
24. In footnote 13, the sentence "Annex 4 to Decree No. 83 / 1996 Coll., on the processing of regional forest development plans and on the definition of economic files. 'is replaced by the sentence" Annex 2 to Decree No. 298 / 2018 Coll., on the processing of regional forest development plans and on the definition of economic files.';
25. in Article 9 (2) (b):
"(b) in the case of forest replanting, planting has been carried out in 2018 or earlier."
26. In Article 11 (3), the words "in the forests outside the forest threat zones of Imim A and B38 'shall be inserted after the words" in the forest threat zones of Imim A and B38' and the words "In the forest threat zones of Imim A and B38 'shall be added at the end of the paragraph, the contribution shall be granted no more than twice over the period of validity of the forest economic plan or forest economic curriculum. Once during the period of validity of the forestry plan or the forest economic curriculum, a financial contribution may be granted in the areas of threat to the forest areas of imizum A and B38, provided that the breakdown of the forest area by dividing lines between 3 and 4 metres wide and ranging from 20 to 30 metres has been ensured during the training.';
Footnote 38 reads:
"38) Decree No. 78 / 1996 Coll., on the establishment of forest threat zones under the influence of imis."
27. After Paragraph 11, the following Sections 11a and 11b are inserted:
Establishment of new fences
(1) The application for a financial contribution shall be accompanied, on request of the provider or the competent regional authority, by a forest map with a graphical outline of the fenced area covered by the application and by other fences within the growing group, highlighting those financed or approved for funding from other public sources.
(2) A financial contribution may be granted if:
(a) the quality of the work carried out and its compliance with forest management legislation is confirmed by the forest farm;
(b) the minimum height of the fence is 160 cm,
(c) in the context of forest renewal, forest crops with at least 30% surface representation of melliorative and strengthening trees have been protected; and
(d) in the case of forest replanting protection, the fence shall be established no later than the first calendar year immediately following the calendar year in which the planting was carried out.
(3) The fulfilment of the subject-matter of the financial contribution means the achievement of the recovery parameters in accordance with Article 5 (2) (b) and (c), Article 6 (2) (b) and (d) or Article 7 (2) (c) after the establishment of the fence.
Follow-up of forest planting
(1) The application for a financial contribution is accompanied by a forest map with a graphical drawing of the planting of forest land at the request of the provider or the competent regional authority.
(2) A financial contribution may be granted if:
(a) in the relevant calendar year, the legal period for forest cultivation has not been exceeded;
(b) the protection of planting, to the extent necessary, has been ensured, in the course of the relevant calendar year, at least against roar and, in the case of non-fenced plantings, against the stock of animals;
(c) the quality of the work carried out and its compliance with the forest management legislation is confirmed by the forestry industry; and
(d) planting has been carried out in 2019 or subsequent years.
(3) The completion of the subject-matter of the financial contribution shall mean the completion of the protection of forest planting in the relevant calendar year.
(4) The financial contribution shall be granted each year from the year of planting of the forest crop until the time of securing the forest crop, but for a maximum period of 5 years.
(5) In the case of mixed forest planting, the application shall show a reduced area of each tree. ';
28. Paragraph 12 (7) is deleted.
29. Footnote 18 reads:
"18) Annex No 2 to Decree No 298 / 2018 Coll. '.
30. in Articles 14 (1), 15 (1) and 16 (1), the words "or the competent regional authority" shall be deleted;
31. in Article 14 (2), the following point (b) is inserted after point (a):
"(b) the seed parameters laid down by other legislation9 have been achieved,"
Points (b) to (d) shall be renumbered (c) to (e).
32. In Part Two, Title IV, including the title, is deleted.
33.In Paragraph 34 (8), "V" is replaced by "IV."
34. In Part Two of Title VII, the word "Forests' is deleted.
35. in Article 35 (1), the word "forests" shall be deleted;
36. In Article 35, at the end of paragraph 5, the sentence "The information contained in the application shall also be provided by the applicant to the competent regional authority electronically published by the Ministry of Agriculture on its website."
37. in Article 35b (1) and (2):
"(1) A financial contribution for forest protection may be granted to the forest owner or person referred to in Article 2 (5) if:
(a) military forests;
(b) forests in the territory of national parks in the zone of concentrated nature care or in the zone of cultural landscape and forests in the territory of the protection zones of national parks; or
(c) other forests, unless the applicant is a state enterprise.
(2) Only the financial contribution referred to in paragraph 3 (c) shall be granted in the forests referred to in paragraph 1 (b). "
footnote 32 is deleted.
38. in Article 35b (3) (d), the word "dry" shall be inserted after the word "damaged."
39. in Paragraph 35b, at the end of paragraph 3, the dot is replaced by a comma and the following points (e) and (f) are added:
"(e) the timely and effective rendering of excavated coniferous wood by spraying the surface of the field with wood by a preparation against fibula-eaters with mixed dye and its subsequent covering of non-woven fabrics; or
(f) timely and effective rendering of extracted coniferous wood by treatment with etandinitrile. '
40. in Article 35b (4), the words "the Ministry of Defence, the Ministry of the Environment or" shall be inserted after the words "the Office";
41. in Article 35b (5), the words "Annex No 12" shall be replaced by the words "Annexes No 2 to 4," the third sentence shall be deleted, including footnote 33, and the words "plants and" shall be replaced by "plants or."
42. in Article 35b (6), the text of point (a) shall be replaced by "a" and point (b) shall be deleted;
Point (c) shall be renumbered (b).
43.Paragraph 35b (8) reads as follows:
"(8) The rates of the financial contribution for forest protection are set out in Part V of Annex 1 to this Regulation. In the case of a combination of several ways of rendering the same coniferous wood, the rate which is more favourable to the applicant shall be used. ';
44. In Article 36 (2), the words ", the Ministry of the Environment or the Ministry of Agriculture referred to in Article 2 (1) 'shall be inserted after the words" the applicant shall deliver' and the words "the competent regional authority, the Ministry of the Environment or the Ministry of Agriculture referred to in Article 2 (1) 'shall be inserted.
45. in Article 36 at the end of paragraph 3 and in Article 42 at the end of paragraph 1, the sentence "The information contained in the application shall also be provided by the applicant to the competent regional authority electronically published by the Ministry of Agriculture on its website."
46. In the first sentence of Article 36 (5), the words "and 41d 'shall be inserted after the words" (b)'.
47. In Paragraph 36 (5), the sentence "The amount of the financial contribution referred to in § 41d shall be set at 50% of the direct costs actually incurred, but may not exceed CZK 40,000."
48. In Paragraph 36 (5), the last sentence is replaced by the sentence "The applicant who pays value added tax and claims to deduct value added tax on the amount of the financial contribution received shall indicate the amount of the costs, excluding value added tax, for which he claims to deduct. ';
49. in Article 37 (2) (a) and Article 41c (2) (a), the words "tenant or smuggler" shall be inserted after the word "owner."
50. In Paragraph 37 (3) (a), the words "the distance between each animal field is not less than 6 m in any place."
51. in Paragraph 37 (3) (f), the words "pressure sliding wall and" shall be deleted;
52. in Article 37 (3) (i), the words "the Regional Office" shall be replaced by the words "the competent Regional Office, the Ministry of the Environment or the Ministry of Agriculture referred to in Article 2 (1)."
53.In Article 38 (1) (a) and Article 38 (3) (a), the words "natural occurrence" are replaced by the words "appropriate to their natural environment."
54. in Paragraph 38 (1) (b), the words "its natural occurrence" are replaced by the words "corresponding to its natural environment."
55. In Paragraph 38 (3) (g), the words ", the Ministry of the Environment or the Ministry of Agriculture pursuant to Paragraph 2 (1)" shall be inserted after the words "the Office."
56. Paragraph 39 (3) reads:
"(3) A financial contribution may be granted to professional game farming with rare species or subspecies if the applicant manages the hunting plan for the current year (27). ';
57. After Paragraph 39, the following Section 40 is inserted:
Financial contribution for the use of predators in plant protection
(1) The financial contribution shall be:
(a) the acquisition, installation, manufacture and installation of nesting substrates or of shelters for predators; or
(b) the acquisition and distribution or the production and distribution of hunting habitats for predators on agricultural land.
(2) Applications for a financial contribution shall be accompanied by:
(a) a statement by the user of the chase that the owner, tenant or smuggler of the hunting ground concerned has been given prior consent to the installation of nesting ground or of the shelters for predators or to the location of hunting posts for predators on its hunting grounds, together with an indication of the parcel number of the plot and the name of the cadastral area in which the land is situated;
(b) a project for the protection of specific areas of predators, including the encapsulating of nests, boxes or hunting habitats for predators in a map of 1: 25 000 or 1: 10 000 with a clear indication of nests, boxes or hunting habitats for predators in recent years, where a financial contribution has been granted and newly installed for which a financial contribution is requested; and
(c) a record of the installation of nests or shelters for predators or the deployment of hunting posts for predators.
(3) A financial contribution may be granted if the frequency
(a) nests or boxes for predators do not exceed 1 head per 100 ha of chase; or
(b) hunting habitats for predators shall not exceed 5 head per hectare of agricultural land in the chase and shall be spread on the farm. ";
58. in Paragraph 41 (2) (a) and (b), the word "caught" shall be deleted;
(59) In Paragraph 41 (3) (a), the words "from game caught" shall be deleted.
60. in Article 41a (3), the word "appropriations" is replaced by the word "contributions."
61. in Article 41b (2), the words "3 marketing years immediately preceding" shall be replaced by the words "5 marketing years immediately preceding," the words "out of 3 previous marketing years" shall be replaced by the words "5 previous marketing years" and the words "3 previous marketing years" shall be replaced by the words "5 previous marketing years."
62. In Section 41b, at the end of the text of paragraph 3, the words "if the order of their laboratory examination indicates the name and registration number of the hunt and seal marking 'are added.
63.In Paragraph 41c (1) (b):
"(b) planting of fruit-bearing crops outside the land intended for the performance of forest functions; the following point is added:
64. The following Section 41d is inserted after § 41c, which includes the title:
Financial contribution to refrigeration equipment for game caught
(1) The financial contribution shall cover the purchase and commissioning of refrigerating equipment for the preservation of game caught in a visa.
(2) Applications for a financial contribution shall be accompanied by:
(a) an affidavit of the applicant for de minimis aid;
(b) copies of the accounting or tax documents relating to the purchase and commissioning of refrigeration equipment; and
(c) photodocumentation of refrigeration equipment or buildings containing refrigeration equipment, showing them on three sides and photodocumentation of the cooling device manufacturer's label.
(3) A financial contribution shall be granted once every 5 years for one hunt.
(4) The financial contribution is granted under the de minimis aid scheme. "
65. In Articles 43 (3) and 44 (3), the words ", the Ministry of the Environment or the Ministry of Agriculture pursuant to Article 2 (1)" shall be inserted after the words "the Office."

Explanatory notes:
1) Only suitable timber listed in Annex 2 to Decree No 298 / 2018 Coll., on the processing of regional forest development plans and on the definition of economic files shall be supported.
2) Only birch is supported from suitable basic trees for preparation, the birch is supported, the birch is promoted, the oilseed, the bird crane, the sticky alder and the grey alder, only in the case of sieve and the provision of forest vegetation.
3) Greasy spruce is only supported at the 5-forest-growing-level sites and at higher forest-growing levels (this does not apply to sets of forest-type 0G, 0Y, 2G, 3G, 3R, 4G and 4R).
(4) The financial contribution for the rearing of forest areas, with the aim of ensuring the breakdown of forest areas, shall be granted only in the zones of threat to forest areas of Imimis A and B.
