DECLARATION
of 22 September 2022
establishing protection zones for natural medicinal sources of mineral water at the spa site of Janské Lazne and defining specific protective measures
According to § 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Points and on the amendment of certain related laws (Spa Act), for the implementation of § 21 (1) and (3), § 22 (5) and § 23 (3) of the Act:
Establishment of protection zones
(1) For the protection of natural medicinal sources of mineral water situated on the territory of the municipality of Janské Lazne, Trutnov district, Králové Hradec region, protection zones I and II shall be established. Within the Level II protection zone, subzones II A and II B are defined according to the degree of protection.
(2) The first stage protection zone is graphically marked in a copy of the cadastral map in the scale 1: 1 000, which is listed in Annex 1 to this decree, and in the basic maps of the Czech Republic in the scale 1: 10 000 and 1: 50 000, which are listed in Annexes 2 and 3 to this decree. The first tier protection zone is situated on the parcels of the cadastral territory of Janské Lázny listed in Annex 4 to this Decree.
(3) The Level II protection zone and its sub-zones II A and II B are established for the protection of the infiltration territory. They are graphically marked in the basic maps of the Czech Republic on the scale 1: 10 000 and 1: 50 000, which are listed in Annexes 2 and 3 to this decree.
(4) Sub-zone II A of the Second Grade Protection Zone is located on the cadastral territory of Janské Lazne, Montenegro in the Giant Mountains and Marshov I. Sub-zone II B of the protection zone II is located on the cadastral territory of Janské Lázně, Bolkov, Maršov I, Maršov II, Maršov III, Great Úpa I, Montenegro in Giant Mountains and Montenegro Mine.
Definition of specific safeguard measures
(1) Level I protection zone shall be prohibited:
(a) to take groundwater except for natural medical resources;
(b) to carry out mining, mining and shredding activities, with the exception of those necessary for the operation of a natural medical spa or for the use, exploration or treatment of the reception of natural medical resources;
(c) carry out interventions in a rock environment deeper than 6 m, not falling under mining or mining activities, except for activities necessary for the operation of natural medical baths or for the use, exploration or treatment of natural medical resources;
(d) the discharge of waste water or defective substances (1) liable to endanger the quality of surface or groundwater, into surface or groundwater waters or into a watercourse flowing through the protective belt;
(e) to build or operate objects for agricultural production, industrial production objects or other objects in which defective substances are handled;
(f) to be handled with particularly dangerous or defective substances;
(g) to establish or operate petrol stations or oil boilers;
(h) to build or operate permanent storage areas for petroleum products, fertilisers or chemical products;
(i) apply plant protection products which could have a negative effect on the quality of groundwater or resources;
(j) not to use non-inert sprinkler materials for the treatment of communications;
k) implement heat pump wells;
(l) to establish parking or weaning areas without impermeable surface treatment or with no draining of surface water through oil separators into sewerage or permanent watercourses;
(m) use pressure injection procedures within land or construction works at a distance of less than 100 m from sources; or
n) build highways, first class roads or long-distance pipelines.
(2) It is prohibited in sub-zone II A of the protection zone II.
(a) carry out mining, mining or shredding activities, except those necessary for the operation of natural medical baths or for the use, exploration or treatment of the reception of natural medical resources and wells of more than 30 m in order to obtain a source of drinking water for individual supplies in areas where it is not possible to use other ways of supplying drinking water;
(b) carry out interventions in a rock environment deeper than 6 m, not falling under mining or mining activity, except for activities necessary for the operation of natural medical baths or for the use, exploration or treatment of the reception of natural medical resources and wells up to 30 m in depth to obtain a source of drinking water for individual supplies;
(c) to take groundwater at temperatures above 15 ° C, except for the use of natural medical resources;
(d) to build or operate objects for agricultural production, industrial production or other objects in which it is handled with defective substances liable to endanger the quality of surface or groundwater;
(e) to export, or, where appropriate, to store, the content of immediate pits, urine pits or manure of livestock to land situated in that territory;
(f) to be handled with particularly dangerous or defective substances;
(g) discharge waste water or defective substances into groundwater;
(h) to establish parking areas or weaning areas without impermeable treatment or drainage of surface water through oil separators into sewerage or permanent watercourses;
(i) use fertilisers with a rapid release of nitrogen or phosphorus or pesticides to control plant or animal pests or to protect plants;
(j) not to use non-inert sprinkler materials for the treatment of communications;
(k) to build or operate waste landfills or to store waste;
l) implement wells for heat pumps,
(m) reduce the size of permanently wooded areas; or
n) build highways, first class roads and long-distance pipelines.
(3) It shall be prohibited to:
(a) carry out work for the drainage or treatment of watercourses likely to jeopardise the natural groundwater regime, with the exception of routine water flow management or land under water flow management;
(b) carry out melioration work;
(c) set up camps, campsites or other temporary accommodation facilities without ensuring the disposal of waste water into an immediate pit or public sewerage;
(d) to carry out wood extraction on forest land other than by individual or group selection of trees, under-grown or, where appropriate, in bulk in a way where the width of the bare mower does not exceed the average height of the harvested crop;
(e) to operate in the forests of a special destination in such a way that the natural groundwater regime could be adversely affected;
(f) reduce the size of permanently wooded areas; or
(g) to apply plant protection products which could have a negative effect on the quality of groundwater or natural medical resources, with the exception of localised application in order to preserve the protected subjects of the Giant National Park.
Repeal
The Decree of the Eastern Czech Regional National Committee on the protection of the natural medical resources of the spa site of national and international importance of Janská Lazne of 2 May 1988 is hereby repealed.
Efficacy
This Decree shall take effect on 1 January 2023.
