GOVERNMENT REGULATION
of 19 February 2014
amending Government Regulation No 75 / 2007 Coll., on the conditions for granting payments for natural handicaps in mountain areas, areas with other handicaps and Natura 2000 areas on agricultural land, as amended, and certain related government regulations
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll.:
Amendment of the Government Regulation on the conditions for granting payments for natural handicaps in mountain areas, areas with other handicaps and Natura 2000 areas on agricultural land
Government Decree No. 75 / 2007 Coll., on the conditions for granting payments for natural handicaps in mountain areas, areas with other handicaps and Natura 2000 areas on agricultural land, as amended by Government Decree No. 113 / 2008 Coll., Government Decree No. 83 / 2009 Coll., Government Decree No. 480 / 2009 Coll., Government Decree No. 111 / 2010 Coll., Government Decree No. 369 / 2010 Coll., Government Decree No. 372 / 2010 Coll., Government Decree No. 283 / 2011 Coll., Government Decree No. 448 / 2012 Coll., Government Decree No. 400 / 2013 Coll., is amended as follows:
1. At the end of footnote 2, the following sentence is added:
the following point is inserted:
2. In Article 6, the following paragraphs 7 and 8 are added:
"(7) Applications submitted in 2014 shall not be subject to paragraph 1 (b) unless payment has been made to the applicant on the basis of applications submitted by the end of 2013
(a) in a less favourable area under this Regulation or under a government regulation on the conditions for the implementation of assistance to less favourable areas and areas with environmental restrictions (9); or
(b) in Natura 2000 under Article 3 of this Regulation or under the Government Regulation on conditions for the implementation of aid to less favourable areas and areas with environmental restrictions 10),
or a decision has been taken to repay the payment as a result of a breach of paragraph 1 (b).
(8) The application referred to in paragraph 1 may not be lodged with the Fund for a period beginning in 2015. "
3. in Article 12 (5) (a), including footnote 23:
"(a) restitution or property settlement with churches and religious societies 23),

Amendment of the Government Regulation on the conditions for the implementation of agri-environmental measures
In Article 5 (5) of Government Decree No 79 / 2007 Coll., on the conditions for the implementation of agri-environmental measures, as amended by Government Decree No. 114 / 2008 Coll., Government Decree No. 45 / 2009 Coll., Government Decree No. 78 / 2010 Coll., Government Decree No. 282 / 2011 Coll. and Government Decree No. 298 / 2013 Coll., paragraph (a) including footnote 12 is worded as follows:
"(a) restitution or property settlement with churches and religious societies 12),
12) Act No. 229 / 1991 Coll., on the treatment of property relations with land and other agricultural property, as amended. Act No. 428 / 2012 Coll., on property settlement with churches and religious societies and on the amendment of certain laws (Act on property settlement with churches and religious societies), as amended by the Constitutional Court found in No. 177 / 2013 Coll. '
Amendment of the Government Regulation on the conditions for granting subsidies for afforestation of agricultural land
In Article 8 (3) of Decree No 239 / 2007 Coll., on the conditions for granting aid for afforestation of agricultural land, point (a), including footnote 18, reads as follows:
"(a) restitution or property settlement with churches and religious societies 18),

Government Decree No. 147 / 2008 Coll., laying down the conditions for the grant of subsidies for the conservation of the economic population of forest land under the Natura 2000 measure in forests, as amended by Government Decree No. 51 / 2009 Coll., Government Decree No. 83 / 2009 Coll., Government Decree No. 480 / 2009 Coll., Government Decree No. 369 / 2010 Coll., Government Decree No. 106 / 2012 Coll., Government Decree No. 448 / 2012 Coll., Government Decree No. 76 / 2013 Coll., and Government Decree No. 400 / 2013 Coll., is amended as follows:

Government Decree No. 53 / 2009 Coll., establishing the conditions for granting subsidies for forestry environmental measures, as amended by Government Decree No. 83 / 2009 Coll., Government Decree No. 480 / 2009 Coll., Government Decree No. 369 / 2010 Coll., Government Decree No. 108 / 2012 Coll., Government Decree No. 448 / 2012 Coll., Government Decree No. 75 / 2013 Coll. and Government Decree No. 400 / 2013 Coll., are amended as follows:
1. in Article 7 (2) (a), including footnote 12:

Amendment of the Government Regulation on certain conditions for granting national additional payments to direct aid
Government Decree No. 112 / 2008 Coll., laying down certain conditions for granting national additional payments to direct aid, as amended by Government Decree No. 480 / 2009 Coll., Government Decree No. 86 / 2010 Coll., Government Decree No. 87 / 2011 Coll., Government Decree No. 107 / 2012 Coll., Government Decree No. 332 / 2012 Coll. and Government Decree No. 298 / 2013 Coll., are amended as follows:
1. In Paragraph 2 (2), "1 November 'is replaced by" 15 May'.
2. in Articles 7 (1) and (2), 8 (1) and (2) and 12 (3) and (4), "1 to 31 December" shall be replaced by "1 to 31 July";
3. in Articles 7 (2) and 8 (2), "28 February following" shall be replaced by "30 September relevant."
4. In Paragraph 11, the words "30 April following 'are replaced by the words" 30 November relevant'.
EFFECTIVE
This Regulation shall take effect on 1 March 2014.
