DECLARATION
of 17 January 2012
amending Decree No. 364 / 2005 Coll., on the management of school and school documentation and school matrices and on the transmission of data from school and school documentation and school matrices (Ordinance on school and school documentation), as amended
The Ministry of Education, Youth and Sports provides pursuant to § 28 (6) of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act), as amended by Act No. 383 / 2005 Coll., Act No. 49 / 2009 Coll. and Act No. 472 / 2011 Coll.:
Decree No. 364 / 2005 Coll., on the keeping of documentation of schools and school establishments and school matrices and on the transmission of data from school documentation and school establishments and from school matrices (Decree on documentation of schools and school establishments), as amended by Decree No. 389 / 2006 Coll., Decree No. 226 / 2007 Coll. and Decree No. 208 / 2009 Coll., are amended as follows:
1. Paragraph 3 (5) reads as follows:
"(5) The data referred to in paragraph 1 shall be transmitted to a database managed by, or established by, the Ministry and authorised by the legal person. To the extent necessary for the performance of their tasks, regional authorities and municipal authorities with extended scope shall also have access to this database, which, in the cases provided for in this Decree, ensures the receipt of the data transmitted to the database. Only authorised staff of the Ministry or authorised staff of the legal entity listed in the first sentence shall have access to the individual data in the database. ';
2. In Article 3a, the words "Organisation established by the Ministry 'are replaced by the words" Ministry or legal entity established by it'.
3. In Annex 2, in Article 1 (7), the words "the organisation set up by the Ministry 'shall be replaced by the words" the Ministry or the legal person set up by it', the words "the invitation 'shall be replaced by the words" the invitation' and the words "the provision 'shall be replaced by the words" provide'.
Efficacy
This Decree shall take effect on 31 January 2012.
