on the planning of thematic tasks
The Office for inventions and discoveries pursuant to Article 155 (1) (d) of Act No. 84 / 1972 Coll., on discoveries, inventions, improvements and designs (hereinafter referred to as "the Act '), in agreement with the participating central authorities and with the Central Council of Trade Unions, provides:
Organisation of thematic tasks planning
(1) Thematic tasks plans are a tool for securing selected tasks of scientific and technological development and production.
(2) The Office for inventions and discoveries (hereinafter "the Office"), in cooperation with the Central Authorities of the Federal and Republic administrations, with other Central Authorities and with the Central Board of Trade Unions, is methodically managing and controlling the planning of thematic tasks.
(3) The Office, in cooperation with the Central Authorities of the Federation and Republics, with other central authorities and the competent authorities of the Revolutionary Trade Union Movement, and in cooperation with the Socialist Youth Union, the Czechoslovak Scientific and Technical Society, the Association of Cooperative Farmers and other social organisations, is drawing up and announcing thematic tasks to address socially important technological and economic problems from national economic plans.
The Central Government of the Federation and Republics and other central authorities shall, in their responsibility, draw up and declare, in cooperation with the competent authorities of the Revolutionary Trade Union Movement or the Union of Cooperative Farmers, in the framework of the thematic tasks. The Socialist Youth Union, the Czechoslovak Scientific and Technical Society and other social organisations are involved in the compilation and announcement of ministerial plans for thematic tasks.
Socialists' organisations (hereinafter referred to as "organisations') are required, in cooperation with the competent authorities of the Revolutionary Trade Union Movement and other social organisations, to effectively guide citizens' creative activities by regularly compiling and announcing sectoral and corporate plans for thematic tasks. The sectoral plan for thematic tasks shall be drawn up and announced by production units or other medium-sized management articles. The business plan of the thematic tasks is compiled and announced by national enterprises, group companies, institutes, cooperative organisations, etc. Organisations are required, in cooperation with the authorities of the Revolutionary Trade Union Movement, the Socialist Youth Union, the Czechoslovak Scientific and Technical Society, or the Association of Cooperative Farmers and other social organisations, to create political, organisational, cadre, economic and material- technical conditions for the widest possible range of workers to participate in the solution, development, testing and implementation of evaluated solutions; To this end, they acquire members of the Brigades of Socialist Work and Youth Collections for this activity, and organise resolution and implementation teams, in particular complex rationalisation brigades.
The thematic tasks plan shall include in particular:
(a) problems selected from the tasks set out in the national economic plans and from the comprehensive socialist rationalisation plans;
(b) other important tasks such as safety and hygiene of work, protection and environment, tasks arising from other urgent needs, etc.
When drawing up and announcing thematic tasks plans, institutions and organisations shall:
(a) ensure that the tasks included in the plan are of relevance to the degree of notice and that there is no dual declaration of the same task within the scope of the field or a declaration of a task the solution of which is available by other means within the requested period;
(b) familiarise their subordinate organisations with the declared tasks, organise exchange of thematic tasks plans among them and cooperate in popularising and addressing the declared tasks;
(c) check how subordinate organisations perform their tasks in this field of activity.
(1) The organisation shall submit proposals for thematic tasks for inclusion in the sectoral plan and the sectoral programme of thematic tasks or thematic tasks announced by the Office directly to the superior body. That authority shall assess and supplement the proposals submitted by itself; the proposals for the ministerial plan of thematic tasks and the thematic plan announced by the Office shall be submitted to the superior body.
(2) The central authorities of the Federation and the Republics shall submit to the Office proposals for thematic tasks which they propose to include in the thematic work plan announced by the Office.
(3) The organisations and authorities referred to in paragraphs 1 and 2 shall draw up and submit proposals for thematic tasks on the schedule annexed to this Decree.
Announcement of the thematic tasks plan
(1) Thematic tasks plans are normally announced at the end of the calendar year for the following year. During each year, the thematic tasks plans may be supplemented and announced by further thematic tasks, if an urgent need for solutions proves necessary.
(2) Thematic tasks may be announced for a period of more than or less than one year depending on their nature and importance.
The authorities and organisations announcing the thematic tasks plan are required to publish and popularize it in such a way as to make it known to the public, in particular to the circle of supposed solvers.
The amount of special remuneration for solving the thematic task shall be set at a fixed amount in such a way as to reflect the complexity of the problem and the expected social benefits of the use of the solution.
(1) When launching the thematic tasks plan, the authorities and organisations are required to define and publish the competitive conditions for submission, discussion, evaluation and remuneration of solutions.
(2) The conditions of competition referred to in paragraph 1 shall include in particular:
(a) a description of the existing situation and shortcomings of known solutions;
(b) a precise definition of the problem to be addressed, specifying in detail the technical and economic requirements to be met by the expected solution;
(c) information on the state of the art, indicating the documentation materials; the authorities and organisations announcing the thematic task shall enable interested parties to become familiar with such materials;
(d) the deadline for submitting draft solutions; the period shall be determined taking into account the difficulty of the problem and the time-limits for subsequent tasks of the economic plans and may be extended where justified;
(e) special remuneration for solving the thematic task;
(f) an indication of who and until when the candidates for the solution may apply for technical advice or advice;
(g) the address to which the solution is to be sent;
h) an indication of who is unable to participate in the solution of a thematic task.
Anyone can participate in the solution to the announced thematic task, except those persons who have approved the publication of the thematic task. Furthermore, persons who have been entrusted with the functions of chairman or member of the evaluation committee or conduct a benefit survey or come into contact with proposals for solutions shall be excluded from participation in the thematic task; However, if they have decided to draw up and submit a proposal for a solution and to draw attention to that fact before they have been aware of the content of other solutions applied for, they may, while being relieved of their duties, participate in such a solution.
(1) The thematic task may be withdrawn only for serious reasons, in the same way as it was declared or in another equally effective way, not later than one month before the deadline for submitting proposals for the resolution of the task. In the event of the removal of a thematic task, the announcing authority or organisation shall provide adequate compensation to the respondents who have fulfilled its conditions in whole or in part before the removal of the thematic task. This right shall be brought to the attention of the investigator by the announcing authorities or organisations when recalling the thematic task.
(2) The designating authority or organisation may extend the deadline for submitting proposals for a thematic task without changing the terms and conditions if the task has not been resolved within the specified time limit and is of particular importance to the national economy. The deadline may be extended within two months after the deadline for submission of draft solutions. This fact shall be notified by the announcing authority or organisation to all applicants and published in the same way as the publication of a thematic task or other equally effective way.
Evaluation of thematic tasks
(1) The proposals submitted for the solution to the thematic task are evaluated by the announcing authority or organisation. To this end, it shall establish in advance, as an expert advisory body, an evaluation committee in which the organisation which will use the solution must be represented. Members of these commissions are also representatives of the Revolutionary Trade Union Movement or the Association of Cooperative Farmers, the Czechoslovak Scientific and Technical Society and representatives of the Socialist Youth Association at ZENIT.
(2) The Commission may request opinions from experts who are not members of the Commission.
(3) Proposals shall be evaluated no later than two months after the deadline set for submission of draft solutions. The deadline for the evaluation of draft solutions may exceptionally be reasonably extended where justified. All solvers shall be informed of the extension of this period and the justification.
(4) If the solver has solved the thematic task under all the conditions of the competition and the solution has been assessed best in terms of meeting these conditions, the announcing authority or organisation shall be obliged to pay the special remuneration to him in full. If all the conditions meet more solutions from different solvers and one of them cannot be assessed as best, a special reward shall be distributed equally among solvers. If the solver has solved the thematic task only in part, but the solution has been judged best, the reward is reduced proportionally. A partial solution is considered to meet only some requirements, but is capable of being used in an organisation and its use in an organisation will bring social benefits. If individual partial solutions form a combination of solutions, complete or partial, the remuneration shall be distributed among the solvers in the proportion in which they have contributed to solving the task.
(5) The special remuneration shall be payable within two months of the date of evaluation.
(6) The notifying authority or organisation shall inform without delay the outcome of the evaluation of all solvers and shall make the result publicly available in an appropriate manner. The evaluation of the proposals received to address the task of the issuing authority or organisation shall be final.
(1) After the evaluation, all proposals for solutions to thematic tasks shall be discussed as applications for improvement proposals with the right of priority when this solution took place; the design of the solution by which the thematic task has been solved is not hindered by the positive decision that the solver has not exceeded the task, resulting, in particular, from his description of the work, from the work order or from the conditions and indicators set out in the assignment. The special reward for solving the thematic task does not reduce the reward for using such an improvement proposal.
(2) If it is assumed that the solution is an invention at the same time, the announcing authority or organisation shall recommend the solver to apply for the invention and the organisation shall provide assistance to the author within the scope of the provisions of Section 49 of the Act. The special reward for solving the thematic task does not shorten the reward for using such a invention.
(1) The evaluation proposals for solutions are required by the institutions and organisations, in accordance with the responsibility assumed in the publication of thematic tasks, to make use of and inform the solvers thereof without delay. At the same time as the decision of the Head of the issuing authority or organisation, the authorities and organisations shall establish a specific programme for their speedy implementation with a timetable and an indication of the personal responsibility for carrying out the tasks, including material and financial security. If these solutions are not used within two months of the deadline for their speedy implementation, the authorities and organisations shall, in cooperation with the competent authorities of the Revolutionary Trade Union Movement, the Socialist Youth Union, the Czechoslovak Scientific and Technical Society, or the Association of Cooperative Farmers and other social organisations involved in the establishment and publication of a thematic task plan, examine the reasons for preventing the use of the solution and implement effective measures to remedy the situation.
(2) Where the use of a solution requires development or testing or exceptional means which cannot be provided during the current planning period, the institution or organisation shall include the use of the solution in the relevant part of the implementation economic plan for the immediate period.
(3) The organisation shall notify its superior authority without delay if it has made use of a solution to a sectoral or sectoral thematic task; for thematic tasks declared by the Office, the organisation shall also be required to notify the Office.
Transitional and final provisions
Proposals for solutions to thematic tasks that have been announced before the entry into force of this decree shall be treated in accordance with Decree No. 102 / 1972 Coll.
The Order of the Office for Inventions and Discoveries No. 102 / 1972 Coll., on the planning of thematic tasks is hereby repealed.
This Decree shall take effect on 1 July 1986.
