DECLARATION
of 14 September 2023
amending Decree No 328 / 2015 Coll., implementing the Act on Asylum and the Act on the Temporary Protection of Aliens, as amended by Decree No 68 / 2019 Coll.
According to Section 86 (4) of Act No. 325 / 1999 Coll., on Asylum, as amended by Act No. 314 / 2015 Coll.:
Decree No 328 / 2015 Coll., implementing the Act on Asylum and the Law on the Temporary Protection of Foreigners, as amended by Decree No 68 / 2019 Coll., is amended as follows:
1. In Section 2, the following point 3 is inserted after point 2:
"3. Armenia,"
Points 3 to 24 shall become points 4 to 25.
2. In Article 2 (8), the words "except Abkhazia and South Ossetia 'are deleted.
3. Paragraph 2 (14) reads as follows:
"14 North Macedonia,"
4. In Article 2 (16), the words "with the exception of Transnistria 'are deleted.
5. In Article 2, the following point 21 is inserted after point 20:
"21. Great Britain and Northern Ireland,"
Points 21 to 25 shall become points 22 to 26.
6. In Paragraph 2, at the end of point 25, comma is replaced by a dot and point 26 is deleted.
Transitional provision
Applications for international protection submitted before the date of entry into force of this Order shall be assessed in accordance with Decree No 328 / 2015 Coll., as effective from the date of entry into force of this Order. The Ministry of the Interior shall, before taking a decision pursuant to Article 16 (2) of Act No. 325 / 1999 Coll., on asylum, as amended, instruct applicants to grant international protection coming from Armenia, Georgia, Moldova or Great Britain and Northern Ireland on the facts referred to in the first sentence and enable them to demonstrate that in its case the State from which they come cannot be considered as a safe country of origin.
Efficacy
This decree shall take effect on 1 October 2023.
