of 20 September 2022
on the control of the operated air conditioning system and combined air conditioning and ventilation system
The Ministry of Industry and Trade provides pursuant to § 14 (4) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 165 / 2012 Coll., Act No. 318 / 2012 Coll., Act No. 310 / 2013 Coll. and Act No. 103 / 2015 Coll., ("the Act ') for implementation of § 6a (6) of the Act:
§ 1
Subject matter
This decree implements the relevant European UnionRegulation (1) and provides for
(a) the method of determining the nominal performance of the air-conditioning system operated or the combined air-conditioning and ventilation system;
(b) the scope, frequency and manner of control of the air conditioning system operated or the combined air conditioning and ventilation system;
(c) the content and model of the report on the control of the air-conditioning system operated or the combined air-conditioning and ventilation system.
§ 2
Cold
(1) For the purposes of this Decree, the source of cold is the part of the air conditioning system which produces cold
(a) by compressor direct cooling,
(b) by compressor indirect cooling,
(c) by absorption cooling,
(d) adiabatic cooling,
(e) a trigeneration system; or
(f) using heat pump energy.
(2) A common air-conditioning and heating system is considered to be a source of cold for the purposes of this Decree.
§ 3
Method for determining the rated output of the air conditioning system operated or the combined air conditioning and ventilation system
The rated output of the operated air conditioning system or combined air conditioning and ventilation system shall be determined as the sum of the rated output of all installed cold sources that are part of the building. For residential buildings, only sources that supply more than one unit with cold are considered.
§ 4
Scope and frequency of control of operated air conditioning system or combined air conditioning and ventilation system
(1) The control of the operated air conditioning system or the combined air conditioning and ventilation system applies to a cold source, with the exception of a cold source which is exclusively used for technological processes, a distribution system and a cold sharing system, a regulation system and an automation and control system pursuant to Decree No. 38 / 2022 Coll., on the control of the operated heating system and a combined heating and ventilation system. In the case of a combined air conditioning and ventilation system, the check shall also apply to the forced ventilation system, provided that the internal environment is controlled by cooling or moisture treatment. The control of the forced ventilation system shall not be carried out when the building has been inspected in the framework of the control of the heating system according to Decree No. 38 / 2022 Coll., on the control of the operated heating system and the combined heating and ventilation system.
(2) Parts of the air-conditioning system or combined air-conditioning and ventilation system referred to in paragraph 1 shall be accessible for inspection.
(3) The first check of the air conditioning system or the combined air conditioning system and ventilation system newly put into service shall be carried out within 3 years of its entry into service. It shall then be checked at the frequency referred to in paragraph 4.
(4) For an air conditioning system already in operation or a combined air conditioning and ventilation system, the check shall be carried out at least every 5 years.
§ 5
Method of carrying out control of the operated air conditioning system or combined air conditioning and ventilation system
(1) Control of the air-conditioning system operated or the combined air-conditioning and ventilation system is carried out under typical operating conditions.
(2) The control of the air conditioning system operated or the combined air conditioning and ventilation system includes an assessment of the operational parameters according to Section 6. The control of the operated air conditioning system or combined air conditioning and ventilation system also includes a control of the dimensioning of the cold source by comparing it with the requirements for cooling the building according to the project documents2). The measurement of the cold source dimension shall be carried out for the air-conditioning system operated or the combined air-conditioning and ventilation system in the event of a major change in the finished building or other than a major change in the finished building where the energy performance requirements for the modified building envelope or technical systems are demonstrated.
(3) An energy specialist or person referred to in Article 6a (4) (b) of the Act (hereinafter referred to as "energy specialist") with the contracting entity to check the air conditioning or combined air conditioning and ventilation system (hereinafter referred to as "contracting entity") provides for a control plan for the air conditioning or combined air conditioning and ventilation system, based on its visual inspection and analysis of the available supporting documents.
(4) The supporting documents for checking the air-conditioning system or combined air-conditioning and ventilation system shall be requested by an energy specialist from the owner of the building, the community of unit owners or, in the absence of a unit owner community, the administrator or the building operator.
(5) The control plan for the air-conditioning or combined air-conditioning and ventilation system in operation contains an inventory of recommendations and conditions for the evaluation of its operational parameters.
§ 6
Method of evaluation of operational parameters
(1) In case the air conditioning system is equipped with an automation and control system capable of regulating, subsequently collecting and evaluating data, the energy specialist shall only evaluate the operating parameters of the air conditioning system operated or the combined air conditioning and ventilation system and determine the efficiency of the source or sub-sources of cold from the measured data.
(2) Operating parameters are evaluated by an energy specialist
(a) by verifying the efficiency of the cold source by the direct method set out in Annex 1 to this Decree; where, in a duly and unambiguously justified case, a direct method cannot be used for technical reasons, the energy specialist shall make an expert estimate;
(b) a visual inspection of the accessible parts of the cold distribution and of the regulatory elements;
(c) visual inspection of accessible cold-sharing devices and checking their operation;
(d) visual inspection of the accessible parts of the distribution and equipment of the forced ventilation system and checking their operation; and
(e) by checking the operating conditions of the forced ventilation system equipment, in particular with regard to the setting of possible air flow reductions at a time when the ventilation space is not fully used.
§ 7
Contents and templates of reports on control of air conditioning or combined air conditioning and ventilation systems
(1) The report on the control of the air conditioning system or combined air conditioning and ventilation system contains:
(a) identification details of the owner of the building, of the unit owners' community or, where the unit owners' community has not been established, the administrator or operator, contracting entity, energy specialist and the registration number of the report on the control of the air conditioning system or combined air conditioning system and ventilation from the Ministry's records of the activities of energy specialists carried out, in accordance with the model of the report on the control of the air conditioning system or combined air conditioning and ventilation system set out in Annex 2 to this Regulation;
(b) identification of the building, its description and description of the subject matter of the inspection;
(c) conclusions from the control carried out, including recommendations and options to improve the energy efficiency of the air conditioning system proposed by the energy specialist;
(d) evaluation of the dimensioning, operating parameters and setting and functionality of the automation and control system if it is part of the air-conditioning system;
(e) a list of recommendations proposed by an energy specialist to ensure the energy efficient operation of the controlled air-conditioning system or combined air-conditioning and ventilation system, and a proposal for other options for efficient energy management within the scope of Annex 2 to this Decree; and
(f) an annex to the report on the control of the air conditioning system or combined air conditioning and ventilation system containing at least:
1. a list of all supporting documents requested and provided;
2. the air conditioning system control plan referred to in Section 5 (3);
3. photo documentation from visual inspection,
4. a set of calculations, measurement and evaluation of the dimensioning and efficiency of the cold source; and
5. evaluation of the dimensioning and operating conditions of the forced ventilation system equipment.
(2) The model of the report on the control of the air conditioning system or combined air conditioning and ventilation system is set out in Annex 2 to this Regulation.
§ 8
Synergy of owner of individual equipment operated by air conditioning or combined air conditioning and ventilation systems
(1) Where the contracting authority is not the owner of the installation which is part of the subject-matter of the check and if the objective of the control of the air-conditioning system operated or of the combined air-conditioning and ventilation system so requires, the energy specialist shall ask the owner of the installation to cooperate.
(2) An energy specialist shall, in a demonstrable manner, require the owner of the equipment of the air-conditioning system or combined air-conditioning system and ventilation information necessary for carrying out its inspection.
(3) In the event that the owner of the installation does not provide the energy specialist with the required data, the energy specialist shall use a commented expert estimate. The data thus used shall be referred to as "expert estimate 'and shall be given in accordance with Annex 2 to this Order.
§ 9
Transitional provisions
(1) The owner of the building, the unit owners' community or, where the unit owners' community has not been established, the administrator or operator shall ensure that the air-conditioning system or combined air-conditioning and ventilation system under this Decree is checked, no later than 1 year after the date of entry into force of this Decree, provided that the inspection under Decree No. 193 / 2013 Coll., on the control of air-conditioning systems has not been carried out.
(2) In the case of an inspection of the air-conditioning system carried out pursuant to Decree No. 193 / 2013 Coll., on the control of air-conditioning systems, as effective before the date of entry into force of this decree, from which more than 5 years have elapsed, the owner of the building, the unit owners' community or, in the event that the unit owners' community has not been established, the administrator or operator shall ensure the control of the air-conditioning system under this decree within 2 years of the date of entry into force of this decree.
(3) In the case of an inspection of the air conditioning system carried out in accordance with Decree No. 193 / 2013 Coll., as effective before the date of entry into force of this Decree, from which less than 5 years have elapsed, the period for the regular implementation of the inspection pursuant to Section 4 (4) of this Decree shall begin as from the last day of the calendar year in which the inspection of the air conditioning system under Decree No. 193 / 2013 Coll., as effective before the date of entry into force of the Decree.
§ 10
Repeal
Decree No. 193 / 2013 Coll., on control of air conditioning systems, is deleted.
§ 11
Efficacy
This decree shall take effect on the 15th day following its publication.

Annex No 1 to Decree No 284 / 2022 Coll.
Measurement of the efficiency of the cold source
(1) The efficiency of the cold source is determined by a direct method. The direct method of determining the efficiency of the cold source consists of determining the ratio of the quantity of cold transmitted to the heat carrier to the amount of energy supplied to the energy source by the energiser in the same period of time.
(2) The efficiency of the cold source is determined by the following relationship:

(3) The evaluation of the efficiency of the cold source shall be carried out by comparing the determined cold source efficiency with the declared cold source efficiency by the manufacturer. The determined and declared efficiency shall be compared with the same operating parameters.
(4) The measurements referred to in paragraph 2 shall be carried out:
(a) during the operation of the cold source; at the time of measurement the outdoor temperature shall not be less than 18 ° C;
(b) on the basis of measurement of the consumption of the energiser and measurement of the quantity of cold produced; and
(c) at steady-state operating conditions.
(5) The measurements referred to in paragraph 4 need not be made where the data referred to in paragraphs 3 and 4 obtained from measurements made in accordance with the requirements of paragraph 4 are not more than two years old.
(6) The cold source complies with the declared efficiency of the cold source declared by the manufacturer at the same operating parameters.
(7) Air conditioning control also includes visual inspection, which includes at least inspection
(a) the manufacturer's label (cold source identification), accompanying technical documentation (installation and use instructions) and operational documentation;
(b) the external state of the cold source, including thermal insulation;
(c) the external state of cold and cooled air distribution, including thermal insulation and indicative temperature of external cold and cooled air distribution surfaces; the temperature of the heat insulation surface shall not be lower than the dew point temperature in the environment through which the manifolds are conducted;
(d) leakage and leakage of refrigerants and lubricants and heat carriers;
(e) the state of the accessible parts of the cold source, the functionality and completeness of all parts;
(f) the state of the accessible parts of the cold-sharing device, the functionality and completeness of all parts;
(g) the functionality of control and safety equipment; and
(h) documents of inspection of technical condition and operation.
