DECLARATION
of 13 September 2023
laying down the conditions under which the recovered asphalt mixture and the recovered penetration macadam are by-products or cease to be waste
The Ministry of the Environment and the Ministry of Industry and Trade provide, pursuant to Sections 8 (2) and 9 (7) of Act No. 541 / 2020 Coll., on Waste, hereinafter referred to as "the Act":
§ 1
Subject matter
This decree implements the relevant provisions of the European Union1) and provides for:
(a) the specific purpose for which the recovered asphalt mixture and the recovered penetration macadam may be used as by-products;
(b) the authorised processing process for the recovered asphalt mixture and the recovered penetration macadam by-product;
(c) qualitative criteria to ensure that the treatment of recovered asphalt mixtures and recovered penetration macadam by-product does not endanger the environment and human health;
(d) the moment when the recovered asphalt mixture, the recovered penetration macadam and the asphalt mixture cease to be waste;
(e) the specific purpose for which the recovered asphalt mixture, the recovered penetration macadam which will cease to be waste, may be used;
(f) the requirements for a recovered asphalt mixture entering the recycling or recovery process from which the recovered asphalt mixture or asphalt mixture is produced and which no longer constitutes waste;
(g) requirements for re-obtained penetration macadam entering the recycling or recovery process from which re-obtained penetration macadam is generated, which will cease to be waste;
(h) the qualitative criteria which the recovered asphalt mixture, the recovered penetrative macadam and the asphalt mixture must meet to stop being waste;
(i) sampling and testing requirements; and
(j) the particulars of the accompanying documentation.
§ 2
Definition of terms
For the purposes of this decree:
(a) an asphalt mixture of a homogeneous mixture consisting of natural or artificial aggregate, filer, road or modified asphalt binder and other additives, additives and constituents, including mixtures where a former asphalt or tar binder has been used;
(b) by penetration macadam, a mixture of natural or artificial stoneware and asphalt or tar binders and other additives which are used in a construction which has been created by the spillage of the stoneware by asphalt or tar binders;
(c) a reacquired asphalt mixture obtained from a degraded or otherwise degraded asphalt layer of infrastructure or airport, handling, storage or other similar transport areas; and
(d) recovered by penetration macadam of penetrating macadam resulting from the demolition of structural layers of infrastructure or airport, handling, storage or other similar transport areas.
§ 3
Conditions for recovered asphalt mixture and re-obtained penetration macadam
(1) A reclaimed asphalt mixture or re-obtained penetration macadam is distinguished by the total content of polycyclic aromatic hydrocarbons into a recovered asphalt mixture or re-obtained penetration macadam of the quality class ZAS- T1, ZAS- T2, ZAS- T3 or ZAS- T4. The total content of polycyclic aromatic hydrocarbons for classification in the quality class ZAS-T1, ZAS-T2, ZAS-T3 and ZAS-T4 is set out in Table 1.1 of Annex 1 to this Decree.
(2) Reacquired asphalt mixture or re-obtained penetration macadam quality class ZAS- T1, ZAS- T2, ZAS- T3 or ZAS- T4 are by-products or cease to be waste if:
(a) are not contaminated by substances other than those used for their manufacture, laying, maintenance or normal operation; such pollution is permissible unless it threatens the possibility of using a recovered asphalt mixture in a manner that complies with this Decree;
(b) meet the criteria of use set out for the relevant quality class ZAS-T1, ZAS-T2, ZAS-T3 or ZAS-T4 in § 5 or 6; and
(c) for a particular use, the total content of polycyclic aromatic hydrocarbons in a recovered asphalt mixture or recovered penetration macadam shall not exceed the maximum permissible total content of polycyclic aromatic hydrocarbons laid down for the relevant qualitative class in Table 1.1 of Annex 1 to this Regulation.
(3) The total content of polycyclic aromatic hydrocarbons in a recovered asphalt mixture or recovered penetration macadam is determined by performing sampling and testing in accordance with the requirements laid down in the Act and Sections 9 and 10. The sampling and testing shall be carried out before the start of works in which the asphalt mixture is recovered or the penetration macadam is recovered, unless that decree allows the recovery of the asphalt mixture without sampling.
(4) In the case of a recovered asphalt mixture from a structural layer of infrastructure or airport, handling, storage or other similar transport areas for which the new asphalt mixture was placed after 1 January 2000, sampling and testing need not be carried out. If sampling and testing are not carried out in such a case, the recovered asphalt mixture for the purposes of this Decree shall be considered as a recovered asphalt mixture of the quality class ZAS-T3 and the benzo (a) pyrene content shall be considered to be less than 50 mg / kg in the dry matter.
(5) If, during sampling and testing, individual layers are found to fulfil the conditions for inclusion in different qualitative classes and these individual layers are not demolished separately, the recovered asphalt mixture or the recovered penetration macadam shall be classified in the qualitative class by layer with the highest total content of polycyclic aromatic hydrocarbons.
§ 4
The moment when the recovered asphalt mixture and the recovered penetration macadam cease to be waste
The re-acquired asphalt mixture or re-obtained penetration macadam shall cease to be waste when the conditions laid down by the law and this decree are fulfilled and the accompanying documentation is drawn up in accordance with Section 11.
§ 5
Use criteria for recovered asphalt mixture or re-obtained penetration macadam quality class ZAS-T1 or ZAS-T2
(1) The milling of the recovered asphalt mixture or re-obtained penetration macadam of the quality class ZAS-T1 or ZAS-T2 does not become waste but is a by-product, or the milling or pre-milking of the recovered asphalt mixture or re-obtained penetration macadam of the quality class ZAS-T1 or ZAS-T2 leaving the waste recovery facility cease to be waste if it meets the following criteria of use:
(a) shall be used as necessary in quantities:
1. for the manufacture of hot, hot or cold asphalt mixtures; it is not possible to use re-obtained penetration macadam in this way,
2. as a non-capped base layer of infrastructure or airport, handling, storage or other similar transport areas,
3. as construction of the ground body of infrastructure or railway line construction,
4. as a non-cemented structural layer of permanently reinforced field or forest paths,
5. as a hydraulically contiguous ground layer of infrastructure or airport or other similar transport areas or construction of railway track construction; or
6. as linings of unpaved edges or central dividing strips of infrastructure; it is not possible to use the re-obtained penetration macadam in this way; and
(b) in the case of a recovered asphalt mixture or re-obtained penetrating macadam of the quality class ZAS-T2, it shall not be used in uncumulated applications in the implementation of construction works in the water source protection zone (2).
(2) The milling of the recovered asphalt mixture or re-obtained penetration macadam of the quality class ZAS-T1 or ZAS-T2 shall no longer become waste, but shall be a by-product when used in on-site recycling technology and, in the case of the milling of the recovered asphalt mixture or of the recovered penetration of the quality class ZAS-T2, shall not be used in non-contiguous applications in the implementation of construction work in the water source protection zone (2).
(3) Reacquired asphalt mixture of quality class ZAS-T1 or ZAS-T2, broken down in a way other than milling, does not become waste, but is a by-product, provided that its transfer to the asphalt mixture packaging plant is ensured, where it is used after pre-treatment and reclassification to produce the asphalt mixture produced hot, hot or cold.
(4) If, prior to the recovery of the recovered asphalt mixture or of the recovered penetration macadam referred to in paragraph 1, 2 or 3, temporary storage on an intermediate basis is necessary, the following conditions shall also be met:
(a) the storage is in accordance with other legislation3); and
(b) interdeponia does not lie within the water source protection zone (2), on land forming part of the agricultural land fund, or on land intended for the performance of forest functions.
§ 6
Use criteria for recovered asphalt mixture or penetration macadam quality class ZAS-T3 or ZAS-T4
(1) The recovered asphalt mixture or re-obtained penetrating macadam of the quality class ZAS-T3 or ZAS-T4 do not become waste but are a by-product if they are used in an essential amount in the original place in the cold recycling technology on the spot or in the original place in the use of the cold recycling technology at the mixing centre; in both cases, when using an asphalt binder in the form of a asphalt emulsion or a fouled asphalt separately or in combination with an appropriate hydraulic or special inorganic binder. The use of a hydraulic binder only is not permitted in such cases. The use of special inorganic binders separately is permitted.
(2) Reacquired penetration macadam of the quality class ZAS-T3 or ZAS-T4 is no longer a waste but is a by-product if it is used in an essential quantity within the ground-plan profile of the infrastructure or airport, handling, storage or other similar transport areas from which it was obtained, such as:
(a) a non-tinted supporting layer of infrastructure or airport, handling, storage or other similar transport areas; or
(b) the construction of the infrastructure body.
(3) Before the start of the degradation of the recovered asphalt mixture or recovered penetration macadam for the purposes of the use referred to in paragraph 1 or 2, it shall be verified by examination that the material meets the requirements for the maximum permitted content of pollutants in the leaching set out in Table 2.1 of Annex 2 to this Regulation.
(4) Where a binder is used as part of the use referred to in paragraph 1 or 2, the test shall be carried out on a material with a grain size of not more than 11,2 mm, covered by the same binder and at the same dosage as that used in the construction. In such a case the test shall be carried out after at least 48 hours of maturation of the material in the air in the laboratory environment without further partitioning.
(5) Where, prior to the recovery of the recovered asphalt mixture or the recovered penetration macadam referred to in paragraph 1 or 2, for technological reasons, temporary storage on an intermediate basis is necessary, the following conditions shall also be met:
(a) the deposit shall be limited to the necessary period and the total deposit period shall not exceed 1 year; after 1 year, no stored material or any pollution derived from stored material may remain in the place of interdeponia,
(b) the location of the intermediate depot is defined in the project documentation of the construction from which the recovered asphalt mixture or the recovered penetration macadam has been obtained and used;
(c) the storage is in accordance with the project documentation of the construction referred to in (b) and other legislation3;
(d) interdeponia does not lie within the water source protection zone (2), on land forming part of the agricultural land fund, or on land intended for the performance of forest functions;
(e) it shall be ensured that the leaching of pollutants from the stored material into the environment is avoided;
(f) the minimum distance between the location of interdeponia and the housing installation shall not be less than 300 m; and
(g) in the case of the use of a cold recycling technology in a mixing centre, the mixing centre shall be located at the site of this intermediate depot.
§ 7
Conditions for asphalt mixture produced from waste recovered asphalt mixture
(1) An asphalt mixture produced from a waste recovered asphalt mixture ceases to be waste if:
(a) the input waste recovered asphalt mixture is not contaminated by substances other than those used for its manufacture, laying, maintenance or normal operation; such pollution is permitted unless it endangers the quality of the asphalt mixture produced and increases the total content of polycyclic aromatic hydrocarbons;
(b) the total content of polycyclic aromatic hydrocarbons in the input waste recovery asphalt mixture shall not exceed the maximum permissible total content of polycyclic aromatic hydrocarbons set out for the quality class ZAS-T3 in Table 1.1 of Annex 1 to this Decree; and
(c) the total content of polycyclic aromatic hydrocarbons, within the scope of Table 1.2 of Annex 1 to this Regulation, in a manufactured asphalt mixture shall not exceed 25 mg / kg in the dry matter; compliance with this condition shall be demonstrated in the manner defined in the operating rules of the waste facility.
(2) The total content of polycyclic aromatic hydrocarbons in the input waste recovered asphalt mixture is determined by performing sampling and testing in accordance with the requirements laid down in the Act and Sections 9 and 10.
§ 8
The moment when the asphalt mixture produced from the waste recovered asphalt mixture ceases to be waste
The asphalt mixture produced from the waste recovered from the asphalt mixture shall cease to be waste at the time when its production has been completed, provided that the conditions laid down by the law and this Decree are met, and the accompanying documentation is drawn up in accordance with Article 11 (4).
§ 9
Sampling
(1) Sampling prior to the start of the works is carried out in the form of core spindles so that it is possible to assess the whole line and separately each layer in which the material to be handled under this decree is located.
(2) The minimum number of samples taken in relation to the diagnostic examination of the area of construction to be demolished is set out in Table 3.1 of Annex 3 to this Decree.
(3) The minimum number of samples taken from the recovered asphalt mixture or recovered penetration macadam is set out in Table 3.2 of Annex 3 to this Decree.
(4) The requirements for the method of sampling are set out in points 1 and 2 of Annex 4 to this Regulation.
§ 10
Laboratory tests
(1) The requirements for the preparation of test samples for the determination of the total content of polycyclic aromatic hydrocarbons are set out in points 1 and 3 of Annex 4 to this Regulation.
(2) In laboratory tests, the range of determined polycyclic aromatic hydrocarbons listed in Table 1.2 of Annex No 1 to this Regulation must be respected.
(3) The requirements for carrying out laboratory tests are set out in point 4 of Annex 4 to this Regulation.
(4) In the case of multiple samples being taken from a certain quantity of recovered asphalt mixture or a certain area of the structural layer from which the recovered asphalt mixture is to be demolished, the whole quantity or area of the structural layer shall be represented by a sample with the highest total content of polycyclic aromatic hydrocarbons.
(5) In the case of multiple samples taken from a structural layer or from a structural line of one of the areas assessed or taken from a homogeneous stock of recovered asphalt mixture, the result of the testing of samples exceeding the maximum permissible total content of polycyclic aromatic hydrocarbons for inclusion in a specific quality class may not be taken into account if:
(a) the number of samples exceeding the maximum permissible total content of polycyclic aromatic hydrocarbons corresponds to the permissible number of samples with a higher total content of polycyclic aromatic hydrocarbons as set out in Table 1.3 of Annex 1 to this Regulation;
(b) for all other samples, the total content of polycyclic aromatic hydrocarbons is equal to or less than the total content of the respective grade; and
(c) for each of the samples, the total content of polycyclic aromatic hydrocarbons shall not exceed twice the maximum authorised total content of polycyclic aromatic hydrocarbons for the appropriate quality class.
§ 11
Supporting documentation
(1) The content of the accompanying documentation of the recovered asphalt mixture or the recovered penetration macadam, which is a by-product or which has ceased to be waste, is set out in point 1 of Annex 5 to this Decree.
(2) When using a recovered asphalt mixture or recovered penetration macadam in the on-site recycling technology, the accompanying documentation shall be considered as the building documentation indicating that the technology is present in the present case. The building documentation shall be accompanied by a sampling report and a laboratory test report, or an indication that it is a recovered asphalt mixture from a structural layer of infrastructure or airport, handling, storage or other similar transport areas for which the new asphalt mixture was placed after 1 January 2000.
(3) In the event that the recovered asphalt mixture or the recovered penetration macadam contains 50 mg / kg benzo (a) pyrene in the dry matter and more, the accompanying documentation, including the accompanying documentation referred to in paragraph 2, shall include an addendum to demonstrate compliance with the requirements of Sections 37 and 40 of Act No. 258 / 2000 Coll., on the protection of public health and amending certain related laws, as amended, and under Section 17 of Government Regulation No. 361 / 2007 Coll., laying down the conditions for the protection of health at work, as amended. The contents of the Appendix are set out in point 2 of Annex 5 to this Decree.
(4) In the case of an asphalt mixture produced from a waste recovered asphalt mixture, the accompanying documentation shall include at least a clear identification of the waste facility in which the asphalt mixture was produced and an indication of the proportion of the input of the recovered asphalt mixture of the quality class ZAS-T3.
§ 12
Notification
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
§ 13
Transitional provision
Where sampling of a recovered asphalt mixture or recovered penetration macadam has been carried out before the date of entry into force of this Decree or the recovered asphalt mixture or recovered penetration macadam has been placed in the quality class ZAS-T4 without testing before the date of entry into force of this Decree, the recovered asphalt mixture or recovered penetration macadam shall be considered as a by-product or a recovered asphalt mixture or recovered penetration macadam which ceased to be waste if the conditions of this Decree or Decree 130 / 2019 Coll., as effective before the date of entry into force of the law. By 1 March 2024 at the latest, for unused material according to the first sentence, the contents of benzo (a) pyrene shall be known and the requirements for the content of accompanying documentation laid down in this Decree shall be met.
§ 14
Efficacy
This decree shall take effect on 1 October 2023.

Requirements for sampling, treatment and testing
1. Sampling and preparation of the sample from the area assessed by diagnostic survey - core drilling
An incremental sample from the infrastructure or other similar transport area shall always take the form of a core drill. The minimum diameter of the core drill is 100 mm or more (according to ČSN EN 12697-27 asphalt mixture - Test methods - Part 27: Sampling, Chapter 4.7.2).
Where necessary, core drilling shall be divided into different layers by a process consistent with proven scientific methods suitable for this purpose. The individual incremental samples shall be split manually or using appropriate equipment into coarse particles and clumps. The minimum possible temperature (not more than 40 ° C) should be used for fragmentation in order to minimise the heating of the material under consideration in order to avoid affecting the PAHs in the prepared sample.
A composite sample shall be prepared from such a treated asphalt mixture or penetration macadam, from which a laboratory sample of a minimum mass determined according to EN 12697-28 - Test methods - Part 28: Preparation of samples for the determination of the binder content, water content and granularity, Chapter 5.5 shall be obtained by a laboratory sample of a minimum mass determined according to EN 12697-5 of the asphalt mixture - Test methods - Part 5: Determination of maximum bulking mass, Chapter 7.2.
2. Sampling of already destroyed recovered asphalt mixture or recovered penetration macadam
Sampling shall be carried out in accordance with EN 14899 Waste characterisation - Waste sampling - Principles for the preparation of the sampling programme and its use and in accordance with other generally accepted methods. The sampling procedure is considered to be correct if it is in accordance with TNI CEN / TR 153102. The quantity of the sub-sample collected shall be determined by the size of the maximum grain of aggregate used in the recovered asphalt mixture in accordance with Table 4.1.

In order to ensure that the AGL does not cause any damage to the material, it is necessary to establish the minimum mass of the laboratory sample in accordance with EN 12697-5.
3. Additional requirements for sample preparation
Preparation of test samples for the analysis of polycyclic aromatic hydrocarbons shall be carried out from the whole laboratory sample (multi-phase milling or crushing accompanied by homogenisation and reduction of the sample after checking the prescribed granularity, or grinding or roasting of the whole quantity to the directly prescribed granularity, subsequent homogenisation and then reducing the sample). Before grinding or mechanical crushing, it is appropriate to freeze or cool the sample with dry ice first.
4. Requirements for carrying out laboratory tests
The analysis shall be carried out on a sample of material with a fineness of grinding to allow at least 95% of the sample to pass through a 1,0 mm standard sieve. The laboratory must include a fine grinding check in its standard operating procedure according to which it must perform the check.

1. Contents of accompanying documentation of recovered asphalt mixture or recovered penetration macadam which are by-product or which have ceased to be waste
(a) the name and, where applicable, the names and surname or business name or, where applicable, the name, address of the registered office and, if assigned, the identification number of the person who has classified the recovered asphalt mixture or the recovered penetration macadam as by-product or as the recovered asphaltic mixture or the recovered penetration macadam which has ceased to be waste;
(b) an indication of whether it is a by-product or a recovered asphalt mixture or a recovered penetration macadam which has ceased to be waste;
(c) the place of origin of the recovered asphalt mixture or of the recovered penetration macadam by-product, at least the road number and the kilometre or the address of the site of demolition, or an indication of the installation where the recovered asphalt mixture or the recovered penetration macadam has ceased to be waste, at least the address and identification number of the establishment;
(d) the quality class of the recovered asphalt mixture or the recovered penetration macadam and the total content of polycyclic aromatic hydrocarbons;
(e) the quantity of the recovered asphalt mixture or the recovered penetration macadam to which the accompanying documentation relates;
(f) a list of the uses which are permitted under this Decree for a given recovered asphalt mixture or reclaimed penetration macadam,
(g) the signature of the person or the representative of the person who has classified the recovered asphalt mixture or the recovered penetration macadam as a by-product or as a recovered asphalt mixture or the recovered penetration macadam which has ceased to be waste; and
(h) a sampling report and a laboratory test report, or a copy of those reports, if the holder of a recovered asphalt mixture or a recovered penetration macadam is a person other than the one who classified them as a by-product or as a recovered asphalt mixture or a recovered penetration macadam which has ceased to be waste; the sampling report shall indicate the sampling site of the recovered asphalt mixture or the recovered penetration macadam.
2. Contents of the Appendix to the accompanying documentation
(a) the number of persons exposed to benzo (a) pyrene;
(b) the place of work, including, where appropriate, the location of the interdeponement, their nature, the date of start of work and their likely duration, the type, the definition of the controlled zone and the way in which the place of work against the entry of unauthorised persons is ensured;
(c) technological processes to be used to reduce exposure to benzo (a) pyrene and dust with higher concentrations of polycyclic aromatic hydrocarbons;
(d) technical and organisational measures to protect the health of persons working with materials containing benzo (a) pyrene and other persons present at the workplace and in the vicinity of the workplace where exposure of these substances occurs or may occur;
(e) the equipment of persons working in the controlled zone with protective working clothing and personal protective equipment to prevent the exposure of chemical substances to the respiratory tract, the place and manner of storage, the way in which they are cleaned, washed and the process of checking their functionality after use and, where appropriate, the method of disposal;
(f) the extent and manner of application of regime measures, in particular the prohibition of food, drinking and smoking in areas where there is a risk of exposure to benzo (a) pyrene and substances and dust with higher concentrations of polycyclic aromatic hydrocarbons;
(g) a description of the method of handling the recovered asphalt mixture or the recovered penetration macadam or, where appropriate, a description of the method of temporary storage;
(h) the identification data of the occupational health service provider to the extent specified in the decision authorising the provision of health services;
(i) the name and surname and qualifications of the person responsible for the performance of the employer's tasks in the care of safety and health at work; and
(j) the manner in which the documentation on the individual exposure register is provided.
