THE LAW
of 10 June 2020
amending Act No 62 / 2003 Coll., on elections to the European Parliament and amending certain laws, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 62 / 2003 Coll., on elections to the European Parliament and amending certain laws, as amended by Act No. 320 / 2009 Coll., Act No. 222 / 2012 Coll., Act No. 58 / 2014 Coll., Act No. 114 / 2016 Coll., Act No. 322 / 2016 Coll., Act No. 90 / 2017 Coll. and Act No. 38 / 2019 Coll., is amended as follows:
1. in Paragraph 14 (d):
"(d) to discuss offences in the European Parliament elections section,"
2. Paragraph 62 (1) is deleted.
Paragraphs 2 to 4 shall be renumbered paragraphs 1 to 3.
3. In Paragraph 62 (1) (j), the word "or 'is deleted.
4. In Paragraph 62, at the end of paragraph 1, the dot is replaced by a comma and the following points (l) and (m) are added:
"(l) apply for the same elections to the European Parliament for registration in more than one Member State; or
(m) votes more than once in the same elections to the European Parliament. "
5. Paragraph 62 (2) and (3) read:
"(2) To deal with an offence under:
(a) points (a) to (d) and (f) to (k) of paragraph 1 shall be the competent authority; the decision of the Office is not subject to decomposition or review in the review procedure;
(b) paragraph 1 (e) shall be the competent regional authority according to the place of residence of the natural person; the fine is the revenue of the county budget which has imposed it,
(c) points (l) and (m) of paragraph 1 shall be the responsibility of the municipal office responsible according to the place of residence of the natural person.
(3) A fine may be imposed for an offence
(a) up to a maximum of CZK 5,000 if the offence referred to in paragraph 1 (l) is committed,
(b) up to 10 000 CZK if the offence referred to in paragraph 1 (m) is committed,
(c) from 10 000 CZK to 100 000 CZK, if the offence referred to in paragraph 1 (a) to (k) applies. "
Efficacy
This Act shall take effect on 1 January 2021.
