GOVERNMENT REGULATION

amending Government Regulation No 75 / 2015 Coll., on the conditions for the implementation of agri-environmental climate measures and amending Government Regulation No 79 / 2007 Coll., on the conditions for the implementation of agri-environmental measures, as amended, as amended
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 179 / 2014 Coll. as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No. 75 / 2015 Coll., on the conditions for the implementation of agri-environmental climate measures and amending Government Regulation No. 79 / 2007 Coll., on the conditions for the implementation of agri-environmental measures, as amended, as amended, as amended, Government Regulation No. 113 / 2015 Coll., Government Regulation No. 63 / 2016 Coll., Government Regulation No. 236 / 2016 Coll., Government Regulation No. 47 / 2017 Coll., Government Regulation No. 49 / 2017 Coll. and Government Regulation No. 315 / 2017 Coll., are amended as follows:
1. In Article 12 (2), the words "including the location of the technical equipment referred to in Part C of Annex 2 to this Regulation 'are deleted.
2. In Article 15 (2), the words "including the location of the technical equipment listed in Part C of Annex 2 to this Regulation 'are deleted.
3. In Article 15 (5) of the Introductory Part of the provision, the words "in the relevant calendar year 'shall be inserted after the words" which'.
4. Paragraph 18 (2) reads as follows:
"(2) The condition referred to in paragraph 1 shall not apply to the part of the soil block included in the treatment of grassland referred to in § 2 (d) (1) on which:
(a) by 31 July of the calendar year concerned, the applicant shall carry out the grazing operation; or
(b) the land use register on the date on which the application for the grant is submitted shall record the implementation of the renewal referred to in Article 9 (5) with the date of commencement of the recovery at the latest by the date of the application for the grant. "
5. In Article 19 (12), the words "or a reduction in the limit on nitrogen input by grazing referred to in paragraph 11 (b) 'shall be inserted after the words" paragraph 11 (a)' and the words "or the condition of minimum nitrogen input by grazing 'shall be added.
6. in Paragraph 21 (7) (b), "31." is replaced by "15."
7. in Articles 21 (7) (c) and 21 (8) (b) (2), "1 April" is replaced by "16 March."
8. In Article 30 (1) (b) (6), the words "the part concerned 'are replaced by the words" the production area concerned'.
9. In Article 30 (2) (b), the words "the subsidy shall not be granted for the relevant part of the soil block on which the non-compliance was established 'shall be added at the end of the text of point 1.
10. Part D of Annex No 2 reads as follows:
"D. Model record keeping of values of meteorological elements and evaluation of data found in the set in the sub-measure of integrated fruit production (§ 12) and growing vegetables or strawberry in the sub-measure of integrated vegetable and strawberry production (§ 15)
"
Transitional provisions
1. The procedure for applications for grants initiated pursuant to Government Regulation No. 75 / 2015 Coll., as effective before the date of entry into force of this Government Regulation, shall be completed in accordance with Government Regulation No. 75 / 2015 Coll., as effective before the date of entry into force of this Regulation.
2. In the case of an application for a grant for 2017, compliance with the condition under Article 21 (7) (b) or (c) or Article 21 (8) (b) (2) of Government Regulation No 75 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be assessed in accordance with Government Regulation No 75 / 2015 Coll., as effective from the date of entry into force of this Regulation.
3. In the event of non-granting of the subsidy for 2017 pursuant to Article 30 (1) (b) (6) or (2) (b) (1) for non-compliance with the conditions set out in Article 12 (7) (a) or (b), Article 15 (6) (a) or (7) (a) of Government Regulation No 75 / 2015 Coll., as effective before the date of entry into force of this Regulation, as from the date of entry into force of this Regulation, Article 30 (1) (b) (6) or (2) (b) (1) of Government Regulation No 75 / 2015 Coll.
Efficacy
This Regulation shall take effect on 1 March 2018.
