DECLARATION
Federal ministries of metallurgy, engineering and electrical engineering
of 15 December 1989
amending and supplementing Decree No. 135 / 1964 Coll., issuing the basic conditions for the supply of engineering products, as amended by Decree No. 57 / 1972 Coll. and Decree No. 107 / 1981 Coll.
The Federal Ministry of Steel, Engineering and Electrical Engineering, in agreement with the participating central authorities and the State Arbitration of the Czechoslovak Socialist Republic, pursuant to Section 392 (1) of Economic Code No. 109 / 1964 Coll., in the full version published under No. 80 / 1989 Coll. (hereinafter referred to as "the Act"), provides:
Decree of the Ministries of General Engineering and Heavy Engineering No. 135 / 1964 Coll., which issues the basic conditions for the supply of engineering products, as amended by Decree No. 57 / 1972 Coll. and Decree No. 107 / 1981 Coll. is amended as follows:
1. In the title, the words "and electrical" shall be inserted after the word "mechanical engineering."
2. Article 1 (1) (a) reads as follows:
"(a) mechanical and electrical products and spare parts for them,"

Draft contract (order)
(§ 152 and 165 of the Act)
The order, in addition to determining the subject and the time of filling, shall include a requirement for the first equipment of spare parts if the customer applies it. ';

"(2) In the case of sub-deliveries to export investment firms and to buildings classified as the nominal tasks of the State Plan, including binding public procurement, if so indicated in the order, the time limit for refusing the order shall be no more than 10 days. The time limits for comments on orders for these deliveries shall be calculated from the date of receipt of the order. ';
5. Paragraph 4 (4) shall be deleted.
6. In Paragraph 4, paragraph 5 is renumbered paragraph 4 and the second sentence is deleted.
Section 7 5 is deleted.
8. In Paragraph 6 (2), the text in brackets is replaced by the following: "or the consignee of the supply 'and the brackets are deleted.
9. In the last sentence of Paragraph 6 (3), the word "engineering 'is deleted.
10. In Section 7, the words "in the planning act or 'are deleted.
11. § 9 is deleted.
12. Paragraph 10 shall become paragraph 1 and the following paragraph 2 shall be added:
"(2) A supplier of products who is late in supplying products intended for sale to citizens and supplying spare parts to a service organisation shall be obliged to pay the customer for the first day of delay a penalty of 10% of the price of the non-delivered products and, if the delay is more than one month, a further penalty of 10% of the price of the products not delivered even during the month following the delivery period. The penalty payable by the supplier for the first day of delay shall be reduced to 1% of the price of the undelivered products delivered by the supplier no later than 15 days after the agreed delivery period. '
13. Paragraph 15 is deleted.
14. Paragraph 16 is deleted.
15. Paragraph 18 (1) reads as follows:
"(1) The guarantee period shall be 12 months after delivery, unless the technical standard provides for a different guarantee period. The warranty period for subcontracting of all stages shall be for the period during which the customer is obliged to fulfil his obligations under liability for defects, but not more than 4 years after the delivery has been completed. ';
16. In Section 27, the words "the time limits for submitting orders' are deleted.
17. In Section 34, the words "on time limits for the submission of draft contracts (orders) and 'are deleted.
18. the following Part Four A is inserted after Section 34:
SUPPORT FOR INTERNAL TRADE ORGANISATIONS AND CONSUMPTION
The provisions of the Decree shall apply to supplies to internal trade organisations and consumer cooperatives, unless otherwise provided for in this Part.
Cooperation agreements on supply security for the internal market
In order to enhance cooperation between production and trade organisations, to improve the satisfaction of the internal market, to ensure the production of consumer goods in advance and with a multiannual perspective and to create production conditions, the organisations conclude cooperation agreements pursuant to Section 164 of the Act.
The contract shall include in particular:
(a) the system, forms and methods for examining consumer demand, so that they can serve as a basis for the long-term development of production and sales, for drawing up plans and for ensuring the supply of products;
(b) arrangements for the establishment of guarantee conditions, the way in which the guarantee repairs are carried out and their evaluation;
(c) promotion and advertising arrangements, catalogues, etc.,
(d) quality, packaging and labelling arrangements;
(e) contractual arrangements, in particular the organisation, course and procedure for concluding contracts for the supply of products;
(f) an arrangement that, if the contractual negotiations do not end by concluding a contract for the supply of products, the participating organisations shall conclude the contract no later than 30 days after the conclusion of the contractual negotiations, under the agreed property penalty. "
19. Paragraph 35 (4) shall be deleted.
1. Decree No. 57 / 1972 Coll., amending and supplementing the Decree of the Ministries of General Engineering and Heavy Engineering No. 135 / 1964 Coll., which issues the basic conditions for the supply of engineering products, is hereby repealed.
2. Decree No. 107 / 1981 Coll., amending and supplementing Decree No. 135 / 1964 Coll., issuing the basic conditions for the supply of machinery products, as amended by Decree No. 57 / 1972 Coll., is hereby repealed.
This Decree shall take effect on 1 April 1990.
