Regulation on the scope of planning and pricing

Government Regulation
of 7 May 1954
on competence in planning and pricing.
The Government of the Czechoslovak Republic orders, with the consent of the President of the Republic pursuant to § 1 of the Constitutional Act No. 47 / 1950 Coll., on adaptations in the organisation of public administration:
§ 1.
The competence in the field of planning and pricing shall lie with the Government, the State Office of Planning, individual ministries, the Central Management of Water, the Government Committee for Construction, the State Committee for Physical Education and Sport, the Central Board of Cooperatives, the Central Association of Cooperatives ("Central Authorities') and the Executive Authorities of the Regional National Committees to the extent specified in this Regulation.
§ 2.
(1) The Government shall determine on a proposal:
(a) the State Office of the Planning Basic Price Planning Directive and the Directive for the preparation of major price adjustments, the State wholesale price of new products and changes in State wholesale prices;
(b) ministries of internal trade change of national retail prices, with the exception of the prices of pharmaceuticals, medical goods and medicinal and aromatic plants (hereinafter referred to as "pharmaceuticals"), in § 13 of the abovementioned agricultural means of production, electricity, gas and steam;
(c) Ministry of Transport, drawn up in agreement with the participating central authorities, principles for the development of passenger and freight tariffs for rail, road, air and water transport, port and port traffic tariffs, state prices for car repair and mail services and compensation in the field of foreign tourism;
(d) ministries of postal and telecommunications connections, after other performance rates provided by the State administration of the connections,
(e) ministries of the local economy principles for setting the prices of land and buildings and, on a proposal drawn up in agreement with the Central Council of Cooperatives, principles for determining the rent of land, buildings and rooms;
(f) Ministries of the local economy fare for urban transport by tram, trolleybus and bus in Prague, Kladno, Most, Ústí n. L., Plzeň, Liberec, Brno, Olomouc, Gottwaldova, Bratislava, Košice and Ostrava,
(g) ministries of the local economy, drawn up in agreement with the participating central authorities, the prices of barber services, tailors, seamstresses, shooters, laundry detergents, clothing cleaners, accommodation businesses and the principles for determining the prices of other services, provided by undertakings subject to the Ministry of the Local Economy or to the central associations of cooperatives;
(h) Central management of water management: principles for determining the remuneration for the supply of water from water pipelines and waterworks and for the disposal of waste water;
(ch) Ministry of Health changes in national retail prices of pharmaceuticals,
(i) ministries for the purchase of the State purchase price of agricultural products supplied for the fulfilment of the delivery obligation and of the State purchase price of agricultural products, as well as the extent and prices of the re-supply of industrial goods to farmers, the State wholesale price of feed and agricultural products intended for the supply of trade and industry and the State wholesale price of feed and agricultural products intended for non-market consumers and for exceptional assistance;
(j) State purchasing, State purchasing, State wholesale and State selling prices for seeds and seed, State retail prices for other agricultural means of production and State purchasing prices for medicinal and aromatic plants;
(k) Ministries of Culture the principles for determining the prices of books, newspapers, journals and other publications, the principles for determining the prices of gramophone boards and the principles for determining the admission fees to cultural enterprises;
(l) the Government Committee on the Construction of a Principle for the Budgetary Value of Construction Works and Geologic Exploration and Drilling Works,
m) State Committee on Physical Education and Sport principles for setting admission prices for sports enterprises and principles for determining compensation in the field of domestic tourism;
(n) ministries of fuel and energy prices and tariffs for electricity, gas and steam.
(2) The government is also reserved to determine all price, tariff and tariff changes.
(3) The Government may also reserve the fixing of prices, rates and tariffs other than those referred to in paragraph 1. It may also entrust the performance of a part of the field of pricing to other bodies.
§ 3.
State Planning Office
(a) coordinate and control the pricing activities of central and other authorities in charge of pricing;
(b) submit to the Government draft basic directives for price planning and for the preparation of major price adjustments;
(c) submit to the Government proposals for State wholesale prices for new products and changes to State wholesale prices;
(d) submit observations to the Government on the proposals of the central authorities submitted to the Government pursuant to Article 2 (1);
(e) lay down directives for the production and discussion of national wholesale prices and, on a proposal from the central competent authority, the Directive for the production and discussion of wholesale prices, national retail prices and retail prices.
§ 4.
Ministry of Internal Trade
(a) submit to the Government proposals for changes to national retail prices, with the exception of proposals for pharmaceutical prices, agricultural means of production referred to in Section 13, electricity, gas and steam;
(b) establish, in agreement with the central competent authority, the national retail prices of new products introduced into retail sales, with the exception of pharmaceuticals, agricultural means of production referred to in Section 13, electricity, gas and steam, and the prices and rates of performance and services provided in undertakings and establishments within its field of competence, other than those reserved for the government; State retail prices for new products and tariffs are set at the level of existing prices for comparable products and tariffs,
(c) after consulting the central authorities involved, propose to the State Office the planning directive for the consideration of proposals and for the creation of national retail prices for new products, except for pharmaceuticals, agricultural means of production referred to in Section 13, electricity, gas and steam;
(d) establish retail prices for vegetables and fruit in agreement with the Ministry of Buying and the Ministry of Agriculture; the exercise of that competence may be delegated by the competent executive bodies of the Regional National Committees, with the approval of the Government,
(e) establish, within the framework of the circulation and budget plan, the amount of trade reductions or surpluses (trade margins) for all goods sold on its trading network and in the network of mass caterers, with the exception of pharmaceuticals and agricultural means of production referred to in Article 13, the trade reductions or surcharges for goods sold exclusively within the scope of the other central authorities shall be determined by those central authorities;
(f) issue comprehensive price lists of national retail prices and additions thereto, including for goods sold exclusively by commercial organisations within the scope of other central authorities, with the exception of pharmaceutical, agricultural means of production referred to in Section 13, electricity, gas and steam;
(g) monitor compliance with national retail prices, with the exception of medicines, agricultural means of production referred to in Section 13, electricity, gas and steam; it controls not only the level of these prices but also compliance with the quality and performance of the products.
§ 5.
Ministry of Local Economy
(a) submit to the Government, in agreement with the central authorities involved, draft principles for the pricing of land and buildings and rental of land, buildings and rooms;
(b) submit to the Government proposals for urban transport tariffs for trams, trolleybus and bus in the cities referred to in § 2 (1) (f) and for changes to tariffs in its field of competence;
(c) establish, in agreement with the Ministry of Transport, the local economy's urban transport tariffs, with the exception of those referred to in § 2 (1) (f);
(d) submit to the Government, in agreement with the relevant central association of cooperatives, proposals for prices and principles for pricing referred to in Article 2 (1) (g).
§ 6.
Ministry of Forestry and Wood Industry
set the prices for bringing wood into the forest and for transporting wood with horse covers.
§ 7.
Ministry of Health
(a) submit proposals to the Government for changes to national retail drug prices;
(b) establish national retail prices for new medicinal products; These prices are set at the level of the existing prices of comparable products,
(c) determine the amount of trade reductions or surpluses (trade margins) for medicinal products in the context of the circulation plan and their budget;
(d) propose to the State Office a planning directive for the consideration of proposals and the creation of national retail prices for new medicines;
(e) issue comprehensive price lists of national retail drug prices and additions thereto;
(f) set the prices and rates for performance provided in undertakings and establishments in their field of activity;
(g) controls compliance with the national retail prices of pharmaceuticals and the prices and rates referred to in (f), not only with the level of these prices, but also with the quality and execution of the product.
§ 8.
(1) Production ministries (central authorities) in their field of competence
(a) establish the wholesale prices on a temporary basis for new products produced by subordinate undertakings and establishments in agreement with the main customer central authorities; These prices are set at the level of State wholesale prices for comparable products. The prices thus determined shall be valid until they are approved by the Government for these new products by the State wholesale prices,
(b) submit to the planning office on a quarterly basis the draft State wholesale prices in accordance with the directives issued by the State Planning Office;
(c) determine the wholesale prices of unit products produced for a preknown final customer, except where the product is supplied by a single production company which has agreed on the price of the product with the customer undertaking;
(d) set wholesale prices for products intended for further use exclusively in the field of own competence;
(e) provide, in agreement with the customer central authorities, for reductions, surcharges and allowances to cover the costs of its own sales and supply organisations;
(f) issue, for goods manufactured by undertakings in their field of competence, price lists of government wholesale prices and price lists of services and performances carried out by undertakings subject to them;
(g) issue collections and price lists for budgeting the value of construction, geological exploration and drilling works.
(2) According to the provisions of paragraph 1, the other central authorities shall also act in respect of products manufactured by undertakings directly by them and unless otherwise specified.
§ 9.
Ministry of Foreign Trade
(a) provide for temporary wholesale prices of newly imported product types in agreement with the main customer authorities; These prices are set at the level of the State wholesale prices of a comparable product. The prices thus determined shall be valid until they are approved by the Government for these imported products by the State wholesale prices,
(b) submit quarterly proposals for State wholesale prices of regularly imported raw materials and products to the planning authority in agreement with the customer central authority, and issue price lists for state wholesale prices of such goods approved by the government;
(c) establish, in agreement with the customer central authority, wholesale prices of raw materials and products imported on a one-off basis at the level of State wholesale prices of comparable goods.
§ 10.
Ministry of Transport
(a) submit to the Government, in agreement with the participating central authorities, draft principles for the development of passenger and freight tariffs for transport by rail, road, air and water, and draft port traffic tariffs; in agreement with the Ministry of the Local Economy, submit proposals for state prices for automotive repair services and mail,
(b) submit to the Government, in agreement with the participating central authorities, proposals for compensation in the field of foreign tourism;
(c) provide for secondary compensation in the fields referred to in (a) in agreement with the participating central authorities.
§ 11.
Ministry of Communications
submit proposals to the Government for the setting of postal and telecommunications charges, following other performance rates provided by the State administration of connections.
§ 12.
Ministry of Buying
(a) submit to the Government, in agreement with the Ministry of Agriculture, the participating production ministries and the Ministry of Internal Trade, proposals for State ransom prices for agricultural products supplied for the fulfilment of the delivery obligation, proposals for State purchase prices for agricultural products and proposals for the extent and prices of the resupply of industrial goods to farmers; in agreement with the Ministries of Agriculture and Food, proposals for State wholesale feed and agricultural products intended for the supply of trade and industry and proposals for State wholesale feed and agricultural products intended for non-market consumers and for emergency assistance,
(b) issue price lists for the State ransom and wholesale prices of the products referred to in (a);
(c) provide in agreement with the ministries of agriculture and the food industry for the purchase prices of those agricultural products for which no State purchase prices are fixed, with the exception of the products and means of production referred to in Article 13 (c), as well as wholesale prices of feed for which no State wholesale prices are fixed,
(d) establish in agreement with the customer ministries the prices of services provided exclusively by its organisations;
(e) establish, within the framework of the circulation plan and within its budget, a margin of trade to cover the costs of its own ransom organisations.
§ 13.
Ministry of Agriculture
(a) submit to the Government, in agreement with the Ministry, proposals for State ransom, State purchases, state wholesale and state retail seed and planting prices and, in agreement with the Ministry of Health, proposals for State ransom prices for medicinal and aromatic plants and issues price lists for those State prices;
(b) submit to the Government proposals for State retail prices of agricultural production resources exclusively sold on the network of the Ministry of Agriculture and not mentioned under (a) and issue price lists for those State prices;
(c) fix the purchase, purchase, wholesale and retail prices of vegetable and other seedlings, vine, hops, nurseries and ornamental material, breeding, production and laboratory animals, hatching eggs and agricultural means of production for which no State prices are fixed and which are exclusively sold on the network of the Ministry of Agriculture, and issue prices for such products;
(d) fix compensation for treatments and operations in veterinary institutes and establishments and pay for insemination;
(e) establish a trade margin for goods sold by the organisations of the Ministry of Agriculture;
(f) provide, in agreement with the Ministry, for the payment of machine and other agricultural works.
§ 14.
Ministry of Culture
(a) submit to the Government draft principles for setting prices for books, newspapers, journals and other publications, draft principles for setting prices for gramophone boards and draft principles for determining admission fees for cultural enterprises;
(b) provide for admission to cultural enterprises in accordance with the principles laid down by the Government;
(c) establish, in agreement with the central authorities involved, prices for books, newspapers, journals and other publications, with the exception of the prices of textbooks and scripts issued by the Ministry of Education and the prices of gramophone records;
(d) establish retail prices of products and the rental and service prices in its field of competence in agreement with the central authorities involved.
§ 15.
Ministry of Education
determine the prices of textbooks and scripts issued in its field of competence.
§ 16.
Ministry of Fuel and Energy
submit proposals for electricity, gas and steam charges in agreement with the participating central authorities.
§ 17.
Central Water Management
submit proposals to the Government for the principles for determining the remuneration for the supply of water from water pipelines and waterworks and for the drainage of waste water.
§ 18.
Government Construction Committee
(a) submit to the Government, in agreement with the participating central authorities, in particular the Ministry of Construction and the Ministry of the Local Economy, draft guidelines for budgeting the value of construction, geological exploration and drilling works;
(b) coordinate anecdotes and price lists for budgeting the value of construction, geological exploration and drilling work by individual central authorities.
§ 19.
State Committee on Physical Education and Sport
(a) submit to the Government draft principles for setting admission prices for sports enterprises and for fixing refunds in the field of domestic tourism;
(b) establish, in agreement with the central authorities involved, the price of admission to sports enterprises and the reimbursement of domestic tourism.
§ 20.
Central Board of Cooperatives and Central Association of Cooperatives
coordinate and control compliance with the pricing rules for cooperative entities, with the exception of undertakings subject to other central authorities; in the case of cooperatives directly subject to the central associations of cooperatives, these associations have similar jurisdiction to those of the production ministries pursuant to § 8.
The Central Council of Cooperatives collaborates with the Ministry of the Local Economy on draft principles for the determination of rent from land, buildings and rooms.
In agreement with the Ministry, the Central Association of Consumer Cooperatives provides for prices for the purchase of agricultural surpluses by its own ransom apparatus and, on the basis of these prices, retail prices and trade margins when selling such surpluses. The retail prices thus determined may not exceed the national retail prices of the same products.
In agreement with the Ministry of Internal Trade, the Central Association of Consumer Cooperatives sets prices for products produced in its food production testing centres.
§ 21.
Price proposals (tariffs) are discussed by the competent central authorities with the Ministry of Finance and with the main customer central authorities. The same applies when it comes to the determination of trade haircuts or surpluses (ranges) in its own field of competence of central authorities.
§ 22.
(1) The Executive Authorities of the Regional National Committees shall determine, in accordance with the directives issued by the State Authority, the planning, retail and wholesale prices of products produced by local industry, production and consumption cooperatives, unless they are directly subject to central authorities.
(2) The government shall determine the detailed scope of the management bodies of the Regional National Committees in the field of pricing.
§ 23.
The executive bodies of the national committees shall also check compliance with the prices set.
§ 24.
(1) The authorities responsible for the production or control of prices may request from each Member State an explanation of the stocks of goods, the prices applied for or paid for, and any circumstances necessary to produce prices and to supervise such production. Staff of these authorities must be allowed access to all work rooms and warehouses and be given access to company records and documents. Furthermore, to the extent strictly necessary, such staff may require samples of each type of goods to be confirmed and carry out the necessary protective measures on the spot. The restrictions applicable to entry into undertakings shall remain unaffected.
(2) Persons responsible for carrying out tasks under this Regulation or participating in them, in particular staff of the supervisory service and experts, shall be obliged to remain silent against unauthorised persons on all the facts which they have learned in their activities, unless they are exempted from that obligation in the public interest. The obligation to remain silent shall not cease to exist or to serve.
§ 25.
Measures of a general nature in the field of planning and pricing shall be declared in official documents.
§ 26.
(1) All provisions contrary to this Regulation, in particular Government Decree No. 235 / 1949 Coll., on Planning and other pricing are repealed.
(2) The provisions issued pursuant to Decree-Law No 235 / 1949 Coll. and the provisions in force under it remain in force unless they contravene that regulation.
§ 27.
This Regulation shall enter into force on the day of its publication; All members of the government will do it.
