GOVERNMENT REGULATION
of 15 June 2020
amending Government Regulation No 262 / 2012 Coll., on the establishment of vulnerable areas and an action programme, as amended
The Government orders pursuant to § 33 (2) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll.:
Government Decree No. 262 / 2012 Coll., on the establishment of vulnerable areas and action programme, as amended by Government Decree No. 448 / 2012 Coll., Government Decree No. 400 / 2013 Coll., Government Decree No. 117 / 2014 Coll., Government Decree No. 235 / 2016 Coll., Government Decree No. 351 / 2016 Coll. and Government Decree No. 27 / 2018 Coll., is amended as follows:
1. Paragraph 4 (2) reads as follows:
"(2) Where the farm operator's commercial plant is partly located in a vulnerable area,
(a) the measures of the action programme shall apply to agricultural parcels as referred to in Article 5 located in vulnerable areas;
(b) the requirements of Sections 7a and 8 (1) shall also apply to agricultural parcels not listed in (a); and
(c) the requirements laid down in Article 9 (1) and (2) shall apply to the whole commercial establishment. ';
2. In Article 5, paragraphs 3 and 4 are added:
"(3) If an agricultural entrepreneur is included in the land use register according to user relations under the Agriculture Act, the part of the soil block located in the vulnerable area is considered to be a part of the soil block located in the vulnerable area.
(4) Where an agricultural entrepreneur is not included in the land use register according to user relations under the Agriculture Act, an agricultural parcel situated in a vulnerable area of more than 2 hectares shall be considered as an agricultural parcel situated in a vulnerable area. ';
3. In Article 6 (2), the words "to fertilisers used for winter crops in an application levy containing not more than 5 kg N / ha shall be inserted after the words" not applicable, "'.
4. In Article 6, the following paragraph 3 is inserted after paragraph 2:
"(3) The derogation from the fertilisation ban referred to in paragraph 1 shall be possible for fertilisers with rapidly released nitrogen on agricultural parcels with an average inclination not exceeding 5 degrees, within a period of not more than 14 days from the start of the ban period and on days where the average daily air temperature is above 5 ° C. This fact, supported by measurements confirmed by the Czech hydrometeorological institute, will then be documented by the agricultural entrepreneur for the purposes of checking the Central Control and Testing Institute for agriculture."
Paragraph 3 shall become paragraph 4.
5. In Article 7 (1), the words "and cultures' shall be inserted after the words" crop needs', the words "fertilisation of individual crops' shall be replaced by the words" nitrogen intake 'and the sentence "In the case of lower yields achieved, the nitrogen intake shall be reduced proportionately'.
6. In Article 7 (2), the words "with the exception of the crops listed in Tables 5 and 6 'are replaced by the words" for the marketing year listed in Table 4' and the words "provided for in Decree No 327 / 1998 Coll., laying down the characteristics of the soil and the management and updating procedure, as amended 'are replaced by the words" established in accordance with Decree No 227 / 2018 Coll., on the characteristics of the soil and the management and updating procedure'.
7. in Article 7 (5), the following point (d) is inserted after point (c):
"(d) nitrogen available for use in the first year by a crop following a crop bound by air nitrogen in accordance with Annex 4 to this Regulation shall be included in the nitrogen supply,
1.50 kg N / ha of post-harvest and root residues of multi-annual net crops of clover and one year old leguminous crops grown for seed with prepared straw; or
2.25 kg N / ha of the post-harvest and root residues of other crops bound by air nitrogen, including their mixtures with other crops, and '
Point (d) shall be renumbered as point (e).
8. in Article 7 (7) (a), "Table 1 of Annex 2 to this Regulation" is replaced by "Section 6."
9. in Article 7 (7) (b), "No 327 / 1998 Coll." is replaced by "No 227 / 2018 Coll."
10. in Article 7 (8) (b):
"(b) in the case of the use of manure to promote the degradation of straw, a maximum of 30 kg N / ha may be used in fertilisers referred to in points A and B for the fertilisation of rape or 20 kg N / ha for the fertilisation of other winter crops,"
11. Paragraph 7 (9) reads:
"(9) Direct or subsequent fertilisation shall be considered as fertilisation in support of straw decomposition until the start of the fertilisation prohibition period referred to in § 6 on the agricultural parcel with all straw left. The stubble after harvesting maize for silage of at least 40 cm height shall be considered straw. A rapeseed extract used for green fertilisation is considered as an intermediate crop. Fertilisation to an intermediate crop shall not be considered as fertilisation in less than 2 weeks before the harvest of the intermediate crop or its green fertilisation crop. ';
12. in Article 7 (11), "80" is replaced by "120" and "40" is replaced by "60."
13. the following Section 7a is inserted after Section 7, including the title:
Nitrogen balance
(1) The agricultural operator shall process the nitrogen balance by 31 December for the period 1 July to 30 June of the following calendar year (hereinafter referred to as the marketing year). The method of calculating the nitrogen balance is set out in Annex 5 to this Regulation.
(2) The nitrogen balance value of three consecutive marketing years on average must not exceed 70 kg N / ha of farm land of the commercial plant. The nitrogen balance shall not include areas, fertilisation and yields in nurseries, fruit orchards, vineyards, hops, greenhouses, foils, strawberries, ornamental plants, fast growing trees and Christmas trees. The nitrogen balance shall not be counted for a commercial plant which, after subtracting the area under the second sentence, manages less than 30 hectares of agricultural land.
(3) The obligation to process the nitrogen balance does not apply to feces and urine referred to in Section 7 (13). "
14. in Paragraph 8 (1), "annual" is replaced by "in the marketing year."
15. Paragraph 8 (3) reads:
"(3) The calculation of the nitrogen levy applied on average per ha shall be done on the basis of data on the supply of total nitrogen in the organic, organo-mineral and livestock fertilisers used, including the production of nitrogen by grazing livestock or other residence on agricultural land. This data shall be obtained from fertilisation records. ';
16. in Paragraph 9 (3) of the introductory part of the provisions, the words "and compost" shall be replaced by the words "compost and digestor" and the words "and digestor" shall be inserted after the word "Compost";
17. in Article 9 (3) (e):
"(e) solid manure or digestor assembly arranged in a layer of a minimum height of 1,7 m and the size of the shorter side of the pile not more than 20 m, with the orientation of the complex by the longer side of the back."
18. In Article 10, the following paragraph 3 is added:
"(3) Maize in the third application zone as defined in Table 4 of Annex 2 to this Regulation may not be grown more than two consecutive years."
19. in Article 11 (1), the words "erosion-hazardous crops" shall be deleted and the words "and sorghum" shall be replaced by "or sorghum."
20. In Paragraph 11 (3), "80 'is replaced by" 120' and "40 'is replaced by" 60'.
