GOVERNMENT REGULATION
of 24 August 2011
amending Government Regulation No. 77 / 2008 Coll., on the establishment of the thresholds for the purposes of the Act on Public Procurement, on the definition of goods acquired by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion into Czech currency of the amounts laid down in the Act on Public Procurement in euro, as amended by Government Regulation No. 474 / 2009 Coll.
The Government orders pursuant to § 159 (1) of Act No. 137 / 2006 Coll., on Public Procurement, as amended by Act No. 179 / 2010 Coll., ("the Act ') to implement § 12 (1) and § 154 of the Act:
Government Decree No. 77 / 2008 Coll., on the establishment of the thresholds for the purposes of the Act on Public Procurement, on the definition of goods acquired by the Czech Republic - Ministry of Defence, for which a specific financial limit applies, and on the conversion into Czech currency of the amounts laid down in the Act on Public Procurement in Euro, as amended by Government Decree No. 474 / 2009 Coll., are amended as follows:
1. In Section 1 of the introductory part of the provisions and in Section 2 (2) (b) (2), the words "European Communities' are replaced by the words" European Union '.
2. in Article 1 (a), the word "regions" shall be inserted after the word "contracting entities."
3. footnote 1 shall read:
"(1) Article 16 of Directive 2004 / 17 / EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors. Article 7 and 8 of Directive 2004 / 18 / EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts. Article 8 of Directive 2009 / 81 / EC of the European Parliament and of the Council of 13 July 2009 on the coordination of procedures for the award of certain works contracts, supply contracts and service contracts by contracting entities in the field of defence and security and amending Directives 2004 / 17 / EC and 2004 / 18 / EC. Communication from the Commission Corresponding thresholds under Directives 2004 / 17 / EC, 2004 / 18 / EC and 2009 / 81 / EC of the European Parliament and of the Council (2009 / C 292 / 01). '.
4. footnote 3 shall read:
"(3) Annex III to Regulation (EC) No 2195 / 2002 of the European Parliament and of the Council of 5 November 2002 on the Common Procurement Dictionary (CPV), as amended by Commission Regulation (EC) No 2151 / 2003, Commission Regulation (EC) No 213 / 2008 and Regulation (EC) No 596 / 2009 of the European Parliament and of the Council.";
5. In Article 2, the following paragraph 4 is added:
"(4) The financial limit under Article 12 (1) of the Act for contracting entities referred to in Article 2 (2) or (6) of the Act in the case of defence or security contracts shall be:
a) for supplies and services 10 020 000 CZK,
b) for construction work 125 451 000 CZK. "

This Regulation shall take effect on the 13th day following its publication.
