DECLARATION
of 4 September 2023
amending Decree No 269 / 2015 Coll., on the breakdown of heating costs and the joint preparation of hot water for the house, as amended by Decree No 376 / 2021 Coll.
According to Section 14a of Act No. 67 / 2013 Coll., which regulates certain issues related to the provision of services related to the use of flats and non-residential premises in the house with flats, as amended by Act No. 104 / 2015 Coll.:
Decree No 269 / 2015 Coll., on the breakdown of heating costs and the joint preparation of hot water for the house, as amended by Decree No 376 / 2021 Coll., is amended as follows:
1. In the first sentence of Paragraph 3 (1), "30% to 50% 'is replaced by" 40% to 60%'.
2. In Paragraph 3 (1), at the end of the second sentence, the words "according to the classification class of the energy performance indicator of the building according to the average coefficient of heat transmittance according to Annex 6 to this Decree; The essential component thus determined may subsequently be reduced or increased by up to 10 percentage points'.
3. In Section 3 (2) of the introductory part of the provision, "20% 'is replaced by" 30%'.
4. in Article 3 (2) (a), "80%" is replaced by "70%."
5. in Article 6 (a) and (e), the words "or MWh" shall be inserted after the words "GJ."
6. In Article 6 (b), the words "or CZK / MWh 'shall be inserted after the words" GJ'.
7. The following Annex 6 is added, including the title:
"Annex No 6 to Decree No. 269 / 2015 Coll.
Percentage of basic component
The percentage of the basic component shall be determined according to the average coefficient of heat transmittance Uem according to § 3 (1) (d) of Decree No 264 / 2020 Coll., on the energy performance of buildings, determined according to Annex 2 to Decree No 264 / 2020 Coll., on the energy performance of buildings, by
(a) for the Uem value of less than or equal to the limit value for the 60% energy performance class C of the building;
(b) for a value of Uem higher than the limit value for classification C of the energy performance of the building and lower or equal to the value for classification E of this indicator of 50%;
(c) for other buildings and buildings where the Uem value is not known or cannot be ascertained at 40%. ';
Transitional provisions
1. The breakdown and billing of heating costs between the recipients of the service for the settlement period which began before the date of entry into force of this Order shall be carried out in accordance with Decree No. 269 / 2015 Coll., as effective before the date of entry into force of this Order.
2. If, for the settlement period prior to the date of entry into force of this Order, the value of the basic component has been determined by the service provider above the value of the basic component in accordance with Paragraph 3 (1) of Decree No 269 / 2015 Coll., as effective from the date of entry into force of this Order, and the provider does not specify for the settlement period from 1 January 2024 to 31 December 2024 any other value of the basic component shall be used for that settlement period the value of the basic component determined before the date of entry into force of that Order.
Efficacy
This Decree shall take effect on 1 January 2024.
