DECLARATION

amending Decree No. 108 / 1997 Coll., implementing Act No. 49 / 1997 Coll., on Civil Aviation and amending and supplementing Act No. 455 / 1991 Coll., on Business Business (Trade Act), as amended
The Ministry of Transport provides, pursuant to Section 102 (1) of Act No. 49 / 1997 Coll., on Civil Aviation and on the amendment and amendment of Act No. 455 / 1991 Coll., on Commercial Enterprise (Trade Code Act), as amended, as amended, Act No. 146 / 2000 Coll., Act No. 258 / 2002 Coll., Act No. 225 / 2006 Coll., Act No. 301 / 2009 Coll., Act No. 407 / 2010 Coll., Act No. 137 / 2011 Coll. and Act No. 127 / 2014 Coll.:

Decree No. 108 / 1997 Coll., implementing Act No. 49 / 1997 Coll., on Civil Aviation, and amending and supplementing Act No. 455 / 1991 Coll., on Business Business (Trade Code Act), as amended, as amended, Decree No. 101 / 1999 Coll., Decree No. 244 / 2003 Coll., Decree No. 359 / 2006 Coll., Decree No. 410 / 2006 Coll., Decree No. 64 / 2010 Coll., Decree No. 314 / 2010 Coll. and Decree No. 4 / 2013 Coll., are amended as follows:
1. In Article 1 (1), the words "it follows directly applicable European Union20 'shall be inserted after the words" European Union17'.
Footnote 20 reads:
"(20) Regulation (EC) No 1108 / 2009 of the European Parliament and of the Council of 21 October 2009 amending Regulation (EC) No 216 / 2008 in the field of airports, air traffic management and air navigation services and repealing Directive 2006 / 23 / EC. Regulation (EU) No 996 / 2010 of the European Parliament and of the Council of 20 October 2010 on the investigation and prevention of accidents and incidents in civil aviation and repealing Directive 94 / 56 / EC. Commission Regulation (EU) No 805 / 2011 of 10 August 2011 laying down implementing rules for the granting of licences and certain air traffic controllers' certificates pursuant to Regulation (EC) No 216 / 2008 of the European Parliament and of the Council. ';
2. Article 1 (1) (c) shall be deleted;
Points (d) to (n) shall be renumbered (c) to (m).
3. In Article 1 (1) (c), the words ", operation and certification of their competence 'are replaced by the words" and operational competence'.
4. in Paragraph 1 (1) (i), "§ 55b" is replaced by "§ 55c";
5. In Article 1 (1) (j), the words "the conditions of issue of a licence, an air carrier certificate 'are replaced by the words" the particulars of the application and the documents to be attached to the application for a licence to operate a commercial air transport service, an air operator certificate'.
6. In Article 1 (1) (l), the words "models of certificates of inspection officers in the exercise of State supervision and 'are deleted.
7. In Article 1 (1) (m), the words "and the amount of the fees for certain acts carried out by the Office 'are deleted.
8. In Paragraph 1, the dot is replaced by a comma at the end of paragraph 1 and the following point (n) is added:
"(n) data transmitted for the purpose of the statistical survey by the Ministry of Transport and data on the number of passengers checked in by the airport operator."
9. in Paragraph 2 (2) (e), the word "certificate" is replaced by the word "decision."
10. in Article 6 (e), the words "certificate" are replaced by the words "decision."
11. in Article 6 (j), the word "certificate" is replaced by "decision."
12. In Paragraph 6a, the words "the European Communities' are replaced by the words" the European Union '.
13. In the heading of Section 8b, "(to Paragraph 17b (5)) 'is replaced by" (to Paragraph 17b (6))'.
14. Sections 8d to 8n are deleted, including the headings.
15. in Article 9a (c), the words "the European Communities" shall be replaced by the words "the European Union";
16. Article 10 shall be deleted;
17. in Article 13 (1) of the Introductory Part of the provision, the words "Areas defined in land planning documents or land use decisions may be used" shall be replaced by the words "Areas defined in land planning documents or in land use decisions for take-offs and landings (hereinafter referred to as" land designated for take-off and landing ") may be used."
18. in Paragraph 13 (2), the words "Areas defined in the planning documentation or in the territorial decision on the use of the territory" shall be replaced by the words "Areas defined for take-off and landing."
19. In Paragraph 13 (3), the words "areas defined in the planning documentation or in the territorial decision on the use of the territory 'are replaced by the words" areas defined for take-off and landing'.
20. In Article 13 (4), the words "in land planning documents or in land use decisions' are replaced by the words" take-off and landing '.
21. In Paragraph 13 (5), the first sentence shall be replaced by the sentence "Take-off and landing may be carried out only on a day-by-day basis in accordance with visual flight rules laid down by the relevant legislation6) and the operator of that area has agreed to use the area defined for take-off and landing."
22. In Section 14 (1) of the Introductory Part of the provision, the words "Areas not covered by the airport or areas defined in the planning documentation or in the territorial decision on the use of the land intended for take-off and landing of aircraft may be used 'are replaced by the words" Areas not covered by the airport or area defined for take-off and landing may be used'.
23. in Article 14 (2), the words "Areas not covered by the airport or areas defined in the planning documentation or in the territorial decision on the use of the land intended for take-off and landing of aircraft" are replaced by the words "Areas not covered by the airport or area defined for take-off and landing."
24. In Article 14 (3), the words "areas which are not airports or areas defined in the planning documentation or in the land use decision for take-off and landing 'are replaced by the words" areas which are not airports or areas designated for take-off and landing'.
25. in Article 14 (4), the words "in the planning documents or in the territorial decision on the use of the territory designated" and the word "aircraft" shall be deleted;
Article 26 (14b) shall be deleted;
27. In the heading above Article 15, the words "(K 44 (6)) 'are replaced by the words" (k 44 (7)'.
28. In Article 15 (4), "Article 44 (5) 'is replaced by" Article 44 (6)' and "Article 44 (4) (a) and (b) 'is replaced by" Article 44 (5) (a) and (b)'.
29. in Article 16 (1), "Article 44 (5)" is replaced by "Article 44 (6)";

31. in Paragraph 16a (8):
"(8) The flight process development service is designed to create, verify and update instrument flight procedures. Instrument flight procedures shall include:
(a) instrument approach;
(b) standard instrument arrival;
(c) standard instrument departure;
(d) en route flight. ';
32. in Article 16g (2):
"(2) The database of field and obstacle data consists of:
(a) a database of terrain data, which shall not include obstacles and which shall contain digital data sets showing the surface of the terrain in the form of continuous above sea height values at all points defined by the network related to the horizontal and vertical reference system; and
(b) a database of obstacle data containing digital data sets describing each or part of a fixed and mobile object;
1. where such an object or part thereof is on an area intended for the ground movements of aircraft,
2. if such an object or part of it interferes with an area intended to protect aircraft in flight; or
3. where such an object or part of it is outside an area intended to protect aircraft in flight but does not endanger the safety of air traffic. ';
33.In Article 16g, the following paragraph 3 is inserted after paragraph 2:
"(3) Each point of the network and any obstacle shall be described within the scope of the information set out in Annex 14 to this Regulation. ';
Paragraphs 3 to 7 shall be renumbered paragraphs 4 to 8.
Article 34 (16i), including the title, reads:
„§ 16i
Category of reporting events and data contained in the report
(to § 55d (5) of the Law)
The categories of events subject to reporting and the data contained in the report are set out in Annex 7 to this Decree. ';
Article 35 (16j), including the title, shall be deleted.
36. In the heading of Section 16k, the words "(Article 55a (3)) 'are replaced by the words" (Article 55a (6))'.

„§ 16l
Model of the certificate of professional natural person according to § 55c of the Act
(to § 55c (5) of the Act)
The model of the certificate is set out in Annex 16 to this Decree. '
38. Paragraph 16m, including the title and footnote 11b, is deleted.
39. in Paragraph 17 (2) (d), "the European Communities" shall be replaced by "the European Union";
40. In Section 18, the word "carrier 'is replaced by" operator'.
41. in Paragraph 18 (1) of the introductory part of the provision, the word "domestic" shall be inserted after the word "lodged" and after the word "applications."
42. In Section 18 (2) of the introductory part of the provision, the word "domestic 'is inserted after the word" application'.
43. In Paragraph 18 (2) (a), the word "unlawful" is replaced by "unlawful."
44. Article 18a and 19 shall be deleted, including the headings and footnotes No 11d.
45. In Section 25, the words "Paragraph 82 (7) 'are replaced by the words" Paragraph 82 (6)'.
46. In the heading of Section 29b, "to § 91a (12) 'is replaced by" to § 91a (11)';
(47) Paragraph 30, including the title and footnote 13, is deleted.
48. In Section 31, the words "to § 98 (3) 'are replaced by the words" to § 98 (2)';
49. in Article 31 (4) and (5), the words "the European Communities" shall be replaced by the words "the European Union";
50. After Paragraph 31, the following Section 31a is inserted:
„§ 31a
Data transmitted for statistical surveys
(to § 98a (3) of the Act)
The list of data to be transmitted for the purpose of the statistical survey to the Ministry of Transport, the list of data to be transmitted by the groundhandling service provider to the airport operator and their structure is set out in Annex 18 to this Decree. '.
(51) Annexes 2, 6 and 11 to 13 are deleted.
52. In Annex 7, the title reads as follows:
"Category of reporting events and data contained in the report
(to § 55d (5) of the Act) '.
53. In Annex 7, heading I reads:
"Events reported in connection with operations, maintenance, repairs and aircraft production '.
54. In Annex 7, the heading of Part II reads:

(a) The vertical accuracy value shall indicate the degree of conformity between the estimated or measured value and the actual value.
b) The vertical resolution value shall indicate the number of units or digits used to express the measured or calculated values. (For example, if the vertical resolution is set at 0,01 m, the vertical position shall be indicated with precision and rounding to 2 decimal places. If the measured value is e.g. 100 m, it will be declared as 100,00 m; or if it is measured as 52,548 m, it will be reported as 52,55 m)
(c) The value of the horizontal accuracy shall indicate the degree of conformity between the estimated or measured value and the actual value.
d) The value of the degree of assurance indicates the probability that the actual value of the parameter lies within a certain interval around the estimated value.
(e) The integrity value shall indicate the degree of security against the loss or alteration of aeronautical data or their value from their origin or approved change.
(f) Significant change is the observed change in height above sea level of at least 2 points of the field model network by a value greater than vertical accuracy for a given category of territory or an update of such data, the ignorance of which could have a negative impact on air traffic safety (e.g. horizontal position, altitude above sea level, height above ground and others).
(g) Field data transmitted by the Ministry of Defence may not achieve the specified accuracy in the areas of permanent forest crops.

g) Data on obstacles transmitted by the Ministry of Defence have a vertical resolution of 1 m. '
58. In Annex 16, the title reads:

Data transmitted for statistical surveys by the Ministry of Transport and the airport operator
(to § 98a (3) of the Act)
I. List of data transmitted by individual entities to the Ministry of Transport
A. Airport Operator
A. 1 For commercial air transport, the airport operator shall transmit:
1. the number of movements of aircraft,
2. Data on the number of incoming passengers,
3. information on the number of passengers,
4. data on the number of passengers coming and going, in total;
5. Data on the number of passengers who continue to fly with the same number as that on which they arrived,
6. load weight data,
7. load weight data,
8. the total weight of loaded and unloaded cargo,
9. Data on the weight of the mail loaded,
10. data on the weight of the unloaded mail,
11. total weight of mail loaded and unloaded.
The aerodrome operator shall transmit the data referred to in points 1 and 6 to 11 separately structured for:
- international scheduled transport,
- international irregular transport,
- international transport in total,
- national regular and irregular transport,
- total international and national transport,
- exclusive carriage of cargo and mail,
- irregular commercial flights operated by aircraft with a total passenger seating capacity not exceeding 30.
The aerodrome operator shall transmit data in accordance with points 2 to 5 separately structured for:
- international scheduled transport,
- international irregular transport,
- international transport in total,
- national regular and irregular transport,
- total international and national transport,
- irregular commercial flights operated by aircraft with a total passenger seating capacity not exceeding 30.
A. 2 For non-commercial air transport, the airport operator shall transmit:
1. total number of movements of aircraft;
2. Data on the number of incoming passengers,
3. information on the number of passengers,
4. data on the number of passengers coming and going.
A. 3 The operator of an international airport which operates at least 90% of the total passenger or cargo carried in the Czech Republic and the airport operator which operates at least 1 million passengers or 100 000 tonnes of cargo per year shall also transmit:
1. initial and final flight site data;
2. the number of passengers transported;
3. data on weight of cargo carried,
4. the weight of the mail transported.
The airport operator shall transmit the data referred to in points 1 to 4 separately in a structured manner for each flight of regular international commercial air transport and for each flight of irregular international commercial air transport.
A. 4 The operator of an international airport which operates at least 90% of the total passenger or cargo carried in the Czech Republic and the airport operator which operates at least 1 million passengers or 100 000 tonnes of cargo per year shall also transmit:
1. data on air traffic revenue, broken down into revenue from aircraft charges, passenger charges and other air traffic charges;
2. data on revenue from groundhandling charges;
3. income data relating to the provision of services other than air services broken down by fuel storage and replenishment, the operation of bars, cafés, catering and duty-free shops, car parking and other than rental revenue;
4. data on rental income,
5. data on other revenue related to the operation of the airport;
6. data on total revenue (sum of revenue under points 4.1 to 4.5.),
7. data on operating subsidies,
8. total revenue data, including operating subsidies;
9. Data on operating and maintenance costs, including staff costs, broken down by personnel, supplies and services costs from subcontractors;
