GOVERNMENT REGULATION
of 7 February 2018
amending Government Regulation No 262 / 2012 Coll., on the establishment of vulnerable areas and an action programme, as amended
The Government orders pursuant to § 33 (2) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll.:
Government Decree No. 262 / 2012 Coll., on the establishment of vulnerable areas and action programme, as amended by Government Decree No. 448 / 2012 Coll., Government Decree No. 400 / 2013 Coll., Government Decree No. 117 / 2014 Coll., Government Decree No. 235 / 2016 Coll. and Government Decree No. 351 / 2016 Coll., is amended as follows:
1. in Article 7 (6) (c):
"(c) the collection and analysis of soil samples shall be carried out by a person who is competent to have an accreditation certificate under Section 16 of the Technical Requirements Act on Products,"
2. In Article 7, at the end of paragraph 6, the dot is replaced by "and 'and the following point (e) is added:
"(e) nitrogen available for use by the cultivated crop in the first year calculated in accordance with paragraph 5 (b). (c) only manure applied after the date of sampling of the soil shall be taken into the nitrogen supply."
3. in Article 7 (8) (a):
"(a) the maximum total levies laid down for each fertiliser and fertiliser as referred to in points A and B shall not be added among themselves,";
4. In Article 12 (1) (b), the word "liquid 'is deleted and the words" except for solid fertilisers' are inserted after the word "nitrogen '.
5. In Annex 2, Table 1, explanatory note * * *:
"* * * applies also to treated sludges; in the absence of subsequent cultivation of crops in the relevant calendar year, fertilisation shall also be prohibited between 1 June and 31 July. ';
6. In Annex 3, Table 1, "34 'is replaced by" 35'.
7. In Annex 3, Table 5, including the title, reads:

Explanatory note:
* The limit refers to the total nitrogen intake over all years of cultivation. That limit shall not include any fertilisation of the cover crop until the harvest. ';
Transitional provision
Proceedings initiated before the date of entry into force of this Regulation shall be completed in accordance with Government Decree No. 262 / 2012 Coll., as effective before the date of entry into force of this Regulation.
Efficacy
This Regulation shall take effect on 1 March 2018.
