GOVERNMENT REGULATION
of 15 December 2004
defining Bird area Medium tank of water works Nové Mlýny
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The birds' zone is defined as the middle tank of the water works of the New Mill (hereinafter referred to as the "bird area").
(2) The protection of the birds' areas is the populations of the eagle (Haliaeetus albicilla), of the fish (Sterna hirundo), of the geese (Anser anser), of the field geese (Anser fabalis), of the whitefish geese (Anser albifrons) and of the water birds in numbers greater than 20,000 individuals and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
Definition of bird area
(1) The birds' area is situated in the territory of the South Moravian Region, in the cadastral territories of the Lower Vestonica, Upper Vestonica, Ivan, Mushov, Pouzranas and Strachotin.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The 1: 10 000 map documents, in which the territory of the bird aredrawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Regional Office of the South Moravian Region and the municipal authorities of the enlarged municipalities in whose administrative district the bird area is located.
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) can the birds' area
(a) to drive ships less than 200 m from the shores of the islands or from the colonies of the bluefin tuna, located outside the islands, between 15 April and 31 July;
(b) to fish for aquatic feathered game which can be managed by fisheries (3), along the whole body of the dam between the upper and the middle tank and in the case of ice from the tank level;
(c) to fish for aquatic feathered game which can be managed by fisheries (3), from 1 December to 15 January.
(2) The prior consent of the nature authority is not required
(a) in carrying out road operations4);
(b) the activities referred to in paragraph 1 in the case of activities carried out under special legislation5) in the territory of the designated conquest area and exclusive bearings.
The protection of the common fisherman shall be added between the water works of the New Mill. The protection of its biotopes is ensured in the context of a procedure under a special legislature6).
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border Bird areas Medium tank of water works Nové Mlýny
In the northwest corner of the central VDNM tank begins the border on crossing the state road *) Class I E 461 with the northern dam of the tank. Following its air (north) heel, the border of the area continues to the first bridge across the river Jihlava, continues to the bridge. At the end of the bridge, it passes again on the air heel of the dam of the central tank and continues along it to the first bridge over the river Svratek. It passes over this bridge, continues again on the air heel of the dam of the central tank to the pump station Pozdřany. From there it turns east and continues along the road * *) along the north bank of the tank. At the northwest corner of the Strakhotin pond, the border breaks sharply south again on the air heel of the artificial dam separating the central tank and the Strakhotin pond. In the wake of this dam on state road No II / 420 connecting Strachotín and Lower Vestonice the border continues along the dam of the central tank to the barrier at the Lower Vestonice. Here the border passes to the air (south) heel of the southern dam of VDNM, and continues to the fenced object of the Pøebníkárny Pohořelice a.s. This object of the border is circling the banks of the tank, defined by a stack of maximum load levels 170,35. The border continues along the eastern edge of the road E 461 Brno - Mikulov, and along this edge it continues towards the north until the northwest corner of the tank where it closes.
Explanatory notes:
*) If the text of the Annex indicates that the border leads on the road, it is indicated that it leads on the edge of the road auxiliary parcel, namely the edge facing into the bird's area.
* *) If the text of the Annex indicates that the border leads along the way, it is expressed that it leads along the edge of the road, namely the border heading into the bird's area.
