DECLARATION
Federal Ministry of the Interior

amending and supplementing Federal Ministry of the Interior Decree No. 10 / 1984 Coll., which gives more detailed regulations on weapons and ammunition
In agreement with the participating central authorities, the Federal Ministry of the Interior provides, pursuant to Sections 7 (2) and 62 of Act No. 147 / 1983 Coll., on Weapons and Ammunition, as amended by Act No. 49 / 1990 Coll.:
Čl. I
The Decree of the Federal Ministry of the Interior No. 10 / 1984 Coll., which gives more detailed regulations on weapons and ammunition, is amended as follows:
1. Paragraph 1 (2) reads as follows:
"(2) The applicant shall:
(a) attach a medical opinion on the physical and mental fitness to use the weapon;
(b) to attach a certificate to the employer or national committee, or, where appropriate, to present for inspection a valid concession when requesting the issue of a ball gun licence used in connection with the pursuit of a profession or profession;
(c) present for inspection a valid hunting ticket when requesting the issue of a gun licence for a ball gun intended for hunting purposes;
(d) present, for inspection, a valid proof of the achievement of the relevant performance class when requesting the issue of a ball gun licence for sporting purposes. ';
2. Paragraph 1 (3) shall be deleted.
3. The following Section 1a is inserted after Section 1:
„§ 1a
(1) A weapon the possession and carrying of which is to be authorised by the holder of a valid hunting licence for the exercise of hunting rights shall be considered as intended for hunting purposes.
(2) A weapon the possession and carrying of which is to be permitted for sporting activity by a performance class wearer in a shooting or other sporting discipline involving a shooting shall be considered to be intended for sporting purposes.
(3) Special expansion instruments referred to in Section 32 (1) of the Act and weapons whose possession and wearing are to be permitted by special rules in the pursuit of the profession or profession shall be considered to be used. ';
Article 4 (2) reads as follows:
"(2) An application for an extension of the period of validity of an arms licence shall have the formalities referred to in Article 1, except for a medical opinion on the physical and mental fitness to use a weapon. ';
5. Paragraph 2 (3) shall be deleted.
6. Article 6 (2) reads as follows:
"(2) A person who wishes to acquire ownership of a ball gun and holds a gun licence shall submit a written request for the issue of a purchase permit, which shall have the formalities referred to in Article 1, except for a medical opinion on the physical and mental fitness for use of the gun, and shall include details of the method of acquisition and the type of weapon and, where possible, of its mark, calibre and serial number."
7. Article 7 (5) shall be deleted.
Paragraphs 6 and 7 shall become paragraphs 5 and 6.

This decree shall take effect on the day of its publication.
