DECLARATION
of 10 August 2023
amending Decree No. 263 / 1999 Coll., laying down the grounds for providing duty leave to professional soldiers for obstacles to service and the scope of duty leave, as amended
According to § 39 (5) of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
Decree No. 263 / 1999 Coll., setting out the reasons for providing professional leave to professional soldiers for obstructions and the scope of duty leave, as amended by Decree No. 105 / 2005 Coll., Decree No. 64 / 2006 Coll. and Decree No. 222 / 2007 Coll., is amended as follows:
1. The following Section 2a is inserted after Section 2, including the title:
Staff leave for long-term care
If it is about providing long-term care, in cases under the sickness insurance law, the soldier shall be granted additional leave of absence for the entire duration of long-term care. '
2. In Annex 2 (3) (a):
'(a) a child, mother, father, husband or wife, spouse, partner or partner in a registered partnership to a medical institution for examination or treatment in the event of sudden illness or injury and for a pre-determined examination, treatment or treatment,';
3. In Annex 2, point 4 (a), the words "even if he does not live with a household soldier 'shall be inserted after the words" less than 10 years old'.
4. In Annex No 2, point 4 (b), the words "even if not living with a common household soldier 'are inserted after the words" that'.
5. In Annex 2, point 4 (ba), the words "due to an accident, emergency measures in the event of an epidemic or other unforeseen event 'shall be inserted after the words" competent authorities'.
6. In Annex 2 (4) (c):
"(c) in the treatment of a child who has reached at least 10 years of age, mother, father, husband or wife, partner or partner in a registered partnership, or any other person living with a common household soldier, if their health is strictly required by the doctor's decision, by another person."
footnote 2 is deleted.
7. In Annex 2, point 4, the words "child 'shall be added at the end of the text of the last paragraph.
8. In Annex 2, point 4, at the end of the text of the last paragraph, the word "cooperative 'is replaced by" species or cooperative or with a partner or partner in a registered partnership'.
9. In Annex 2, point 7, the words "interest of the armed forces of the Czech Republic 'are replaced by the words" important interest of the service'.
10. in Annex 2 (7) (a) and (b), the word "household" shall be inserted after the word "when moving."
11. In Annex 2, the following paragraph is added at the end of point 7:
"An important interest in the service shall, for the purpose of providing leave of service, mean, in particular, the proximity of a soldier's household to a designated place of service. ';
12. In Annex 2, point 8, in the last paragraph, "3 'is replaced by" 2'.
13. Point 10 of Annex 2 reads as follows:
"10.
(a) important personal, family or property matters which require the personal participation of a soldier and cannot be dealt with outside the service period;
(b) urgent matters in cases of illness or injury to a child, mother, father, husband or wife, spouse, partner or partner in a registered partnership where the immediate presence of a soldier is indispensable.
Staff leave shall be granted for the period strictly necessary, not exceeding 1 day, not exceeding 40 hours in the calendar year in total. ';
14. In Annex 2, point 13, the words "services in units of the multinational armed forces abroad 'are replaced by the words" foreign operations' and the words "units of the multinational armed forces abroad 'are replaced by the words" foreign operation'.
15. In Annex 2, point 14 is inserted after point 13:
"14. Medical activities related to the performance of the service
Staff leave shall be granted for the necessary period of time to a soldier who shall undergo a medical operation related to the performance of the service to the extent specified by the specific legislation or decision of the competent public health authority. ';
Efficacy
This decree shall take effect on the first day of the calendar month following its publication.
