THE LAW
of 3 July 2025
amending certain capital market laws relating to the establishment and functioning of a single European access point
Parliament has decided on this law of the Czech Republic:
Amendment of the Act on the Czech National Bank
In Article 2a of Act No. 6 / 1993 Coll., on the Czech National Bank, as amended by Act No. 92 / 2011 Coll. and Act No. 227 / 2013 Coll., the following paragraphs 3 and 4 are added:
"(3) The Czech National Bank is an authority in the Czech Republic collecting information pursuant to Article 2 (2) of Regulation (EU) 2023 / 285948 of the European Parliament and of the Council.
(4) The single European access point shall be the single European access point referred to in Article 1 (1) of Regulation (EU) 2023 / 285948 of the European Parliament and of the Council.
48) Regulation (EU) 2023 / 2859 of the European Parliament and of the Council of 13 December 2023 establishing a single European access point providing centralised access to publicly available information on financial services, capital markets and sustainability. ';
Amendment to the Capital Market Supervisory Act
Act No. 15 / 1998 Coll., on capital market supervision and amending and supplementing other laws, as amended by Act No. 148 / 2016 Coll., Act No. 183 / 2017 Coll., Act No. 204 / 2017 Coll., Act No. 96 / 2022 Coll. and Act No. 32 / 2025 Coll., is amended as follows:
1. At the end of footnote 40, the sentence "Article 3 of Directive (EU) 2023 / 2864 of the European Parliament and of the Council of 13 December 2023 amending certain Directives as regards the establishment and functioning of a single European access point shall be added to the separate line. '.
2. In Section 14, paragraph 6 is added, including footnote 45:
"(6) Where the decision referred to in paragraph 1 concerns the imposition of an administrative penalty for an offence, a remedy measure or any other measure in relation to an infringement of a provision incorporated in Directive 2004 / 109 / EC of the European Parliament and of the Council, the Czech National Bank shall make this decision available in a single European access point in the format from which the data referred to in Article 2 (3) of Regulation (EU) 2023 / 285945 of the European Parliament and of the Council can be obtained and shall provide it with at least the following metadata:
(a) the identification details of the person concerned, unless this Decision is to be published without such identification details in accordance with the procedure referred to in paragraph 2;
(b) the identification code of the legal person belonging to the person concerned, as specified in the directly applicable European Union Regulation, issued in accordance with Article 7 (4) (b) of Regulation (EU) 2023 / 285945 of the European Parliament and of the Council, when assigned to it,
(c) the type of information classified in accordance with the directly applicable European Union Regulation issued pursuant to Article 7 (4) (c) of Regulation (EU) 2023 / 285945 of the European Parliament and of the Council); and
(d) a statement as to whether the decision contains personal data.

1. In footnote 1, fourth sentence, the words "and 2013 / 50 / EU 'are replaced by the words", 2013 / 50 / EU and (EU) 2023 / 2864'.
2. In footnote 2, the sentence "Regulation (EU) 2023 / 2859 of the European Parliament and of the Council of 13 December 2023 establishing a single European access point providing centralised access to publicly available information on financial services, capital markets and sustainability 'is inserted after the line 17.
3. In Article 1, at the end of paragraph 3, the dot is replaced by a comma and the following point (r) is added:
"(r) a directly applicable European Union regulation governing a single European access point (112).
(112) Regulation (EU) 2023 / 2859 of the European Parliament and of the Council of 13 December 2023 establishing a single European access point providing centralised access to publicly available information on financial services, capital markets and sustainability. ';
4. In Paragraph 127, the following paragraphs 3 and 4 are inserted after paragraph 2:
"(3) The information required to be published shall be sent by the person referred to in paragraph 1 in accordance with paragraph 2 to the Czech National Bank in the format from which data may be obtained, in accordance with Article 2 (3) of Regulation (EU) 2023 / 2859112 of the European Parliament and of the Council, or in a machine-readable format as referred to in Article 2 (4) of Regulation (EU) 2023 / 2859112 of the European Parliament and of the Council, provided that the machine-readable format is required by other legislation; the information shall provide at least the following metadata:
(a) the identification data of the issuer to which the information required to be disclosed relates;
(b) the legal entity identification code referred to in paragraph 4 to the issuer;
(c) the type of information classified in accordance with the directly applicable European Union Regulation issued pursuant to Article 7 (4) (c) of Regulation (EU) 2023 / 2859112 of the European Parliament and of the Council),
(d) the size of the issuer according to the categories specified in the directly applicable European Union Regulation, issued pursuant to Article 7 (4) (d) of Regulation (EU) 2023 / 2859112 of the European Parliament and of the Council);
(e) the industrial sectors of the economic activities of the issuer specified in the directly applicable European Union regulation issued pursuant to Article 7 (4) (e) of Regulation (EU) 2023 / 2859112 of the European Parliament and of the Council; and
(f) a statement indicating whether the information required to be disclosed contains personal data.
(4) The issuer, which is a legal person, shall obtain the legal entity identification code specified in the directly applicable European Union regulation issued pursuant to Article 7 (4) (b) of Regulation (EU) 2023 / 2859112 of the European Parliament and of the Council. ';
Paragraph 3 shall become paragraph 5.
5. In Article 127a (1) of the Introductory Part of the provision, the words "and in a single European access point 'shall be inserted after the words" to the public'.
6. in Articles 161b (1) and 183 (1), the words "Article 21a (1)" shall be inserted after the words "7 to 11,";
7. In Article 199 (2), "§ 127 (3) 'is replaced by" § 127 (5)'.
EFFECTIVE
This Act shall take effect on 10 July 2026.
