DECLARATION
of 16 August 2023
amending Decree No 71 / 2011 Coll., on the form, structure and manner of management and provision of data which a bank and a branch of a bank from a non-Member State is required to maintain and which is required to provide to the Financial Market Guarantee System, as amended by Decree No 431 / 2016 Coll.
The Ministry of Finance provides pursuant to § 41c (10) of Act No. 21 / 1992 Coll., on Banks, as amended by Act No. 156 / 2010 Coll., Act No. 375 / 2015 Coll. and Act No. 338 / 2020 Coll.:
Regulation No 71 / 2011 Coll., on the form, structure and manner of management and provision of data which a bank bank and a branch of a bank from a non-Member State are required to maintain and which is required to provide to the Financial Market Guarantee System, as amended by Decree No 431 / 2016 Coll., is amended as follows:
1. In Article 3 (1), the sentences second to fourth are replaced by the sentences "Data are provided to the Guarantee System in the CSV data file format compressed into one data file in the ZIP format and encrypted by the asymmetric encryption algorithm PGP. In agreement with the Guarantee System, another way of encryption of at least the same security may be used. '
2. In Section 3, at the end of the text of paragraph 2, the words "or on a secure USB data repository which the Guarantee System has lent to a bank or branch of a bank other than a Member State for that purpose 'shall be added.
3. In Paragraph 3 (5), the word "fax 'is deleted.
4. Point 1.1.6 of the Annex reads as follows:
"1.1.6. DESCRIPTION OF DATA EXCHANGE
The data dose is compressed by ZIP into one common file. Files belonging to one tranche are added to the compressed file without travel. The compressed file is encrypted with an asymmetrical PGP encryption algorithm, with the possibility that, in agreement with the Guarantee System, at least the same security encryption method can be used. '
5. In the Annex to point 1.2.2, at the end of the table "DIC file (authorised persons) - description of data elements', the following rows are added:

6. The second paragraph of point 1.2.4 of the Annex reads as follows:
"If the account is shown in the DIL file, it must also be shown in the DIA file, indicating the account owner or account holders and the total balance of the joint or management account. If there are more than one holder for a common or management account, one sentence and the total balance of the account shall be shown for each of them in the DIA file. Conversely, the authorised person listed in the DIL file but not the account holder shall not be included in the DIA file. If the account is shown both in the DIA file and in the DIL file, then the DIA status is not included in the total claim shown in the DIC file. '
7. In point 1.2.5 of the Annex, the following sentence is added at the end of the paragraph: "If the account is shown in the DII file, it must also be shown in the DIA file, indicating its owner, but on the contrary the beneficiary (shareholder) must not be included in the DIA file. '
8. In the Annex in point 1.2.6 in the table "DIN file (control messages) - description of data elements', in row 6, after the word" description ', the words "the reason for the order and in the case of blocking the indication of the person or institution requesting the blocking' are inserted.
9. In the Annex in point 1.3.3 in the table "DIM file (control messages) - description of data elements', in row 6, after the word" description ', the words "the reason for the order and in the case of blocking the indication of the person or institution requesting the blocking' are inserted.
Efficacy
This Decree shall take effect on 1 January 2024.
