DECLARATION
of 22 May 2006
on the details of the major accident prevention system
The Ministry of the Environment provides, pursuant to § 7 (2), § 9 (5), § 11 (5), § 17 (5), § 19 (5) and § 25 (5) of Act No. 59 / 2006 Coll., on the prevention of major accidents caused by selected hazardous chemicals or chemicals and on the amendment of Act No. 258 / 2000 Coll., on the protection of public health and on the amendment of certain related acts, as amended, and Act No. 320 / 2002 Coll., on the amendment and repeal of certain laws in connection with the cessation of the activities of the county authorities, as amended (Act on the prevention of major accidents) (hereinafter "the Act '):
§ 1
Preliminary provisions
This decree (1) implements the relevant European Communities2) and regulates the way in which a major accident analysis and risk assessment is carried out, the way in which the security programme is processed, the way in which and the structure of the internal emergency plan, the way in which it is processed, the way in which the written documentation for the establishment of the emergency planning zone, the way in which the security programme is updated, the security reports, the internal emergency planning and the extent and manner in which information and the procedure for ensuring information to the public in the emergency planning zone.
§ 2
Method of analysis and assessment of major accident risks
(K § 7 (2) of the Act)
(1) A major accident risk analysis and assessment (hereinafter referred to as "risk analysis and assessment") is carried out and documented to the extent appropriate to the risk of a major accident, that is the likelihood of its occurrence and the severity of the possible impacts, using qualitative and quantitative analytical methods.
(2) Risk analysis and assessment shall be carried out for:
(a) all phases of the life cycle of an object or plant, starting from the processing of project documentation to disposal;
(b) normal and exceptional operating conditions, including possible failure of the human factor or potential external threat.
(3) A risk analysis and assessment shall be carried out:
(a) identification of the sources of risk, their valuation and selection for a detailed risk analysis to determine the extent to which individual sources of risk contribute to the overall risk of the analysed object or plant;
(b) identifying possible scenarios of events and their causes that may result in a major accident and selecting representative scenarios of such events in which sources of risk with the most serious impact on the health and lives of persons, livestock, the environment and property must be included;
(c) an estimate of the impact of representative major-accident scenarios on human life and health, livestock, environment and property;
(d) an estimate of the likelihood of representative major accident scenarios;
(e) the determination of the level of risk of representative major-accident scenarios based on the results of the assessment carried out of the consequences of the scenarios, the estimation of their impact and the likelihood of such scenarios;
(f) assessment of the acceptability of major accident risk.
(4) Where the resulting value of a major accident risk appears unacceptable for a given source of risk, a more detailed risk analysis shall be carried out and organisational and technical measures shall be established and implemented as necessary to reduce that risk, as verified by repeated analysis and risk assessment. The acceptability or non-acceptability of the risk to the object or installation shall be given by a summary of the results of the risk analysis and assessment carried out and of other local conditions and factors, in particular social, economic, territorial and other factors.
(5) The process of processing and the scope of analysis and risk assessment is set out in Annex 1.
Method of processing the security programme
(K § 9 (5) of the Act)
§ 3
(1) The security programme shall be broken down into the following parts:
(a) basic information on the premises or facilities, activity and number of employees;
(b) analysis and assessment of major accident risks to the extent appropriate to the risk of major accidents and the severity of their consequences;
(c) the principles, objectives and policy for the prevention of a major accident;
(d) a description of the safety management system;
(e) a final summary.
(2) The description of the safety management system shall include:
(a) organisation of major accident prevention,
(b) management of the operation of the premises and equipment;
(c) control of changes in the object and equipment;
(d) emergency planning;
(e) monitoring the implementation of the major accident prevention programme;
(f) audit and control.
(3) The safety management system shall include a description of the organisational structure, the determination of responsibilities and the determination of planning activities, rules, practices, procedures, processes, including resources to develop, implement, implement and validate a major accident prevention policy.
(4) A description of the safety management system may be processed by means of a separate document or may be used by documents for management systems developed under other legislation or standards, provided that they are processed in the relevant structure and scope and comply with their content with the requirements for major accident prevention or are supplemented and modified within the meaning of those requirements.
§ 4
(1) The principles of prevention are based on the analysis and assessment of major-accident risks and must be consistent with the nature of the risk sources and set out in a framework so that they are always clearly and clearly directed towards ensuring the adequate structure and functioning of the major-accident prevention and safety management system.
(2) The overall objectives include a description of the framework tasks to ensure an adequate level of major accident prevention. The setting of the specific objectives and tasks necessary to comply with the principles and framework objectives for the prevention of a major accident shall cover all areas of the safety management system and shall include the establishment and introduction of indicators, parameters and criteria enabling the monitoring of the level of performance of the tasks and the evaluation of the effectiveness of the measures implemented.
(3) A major accident prevention policy includes an operator's declaration declaring commitment, intent and principles for the implementation of the major accident prevention.
(4) The content of the parts and chapters of the security programme document is set out in Annex 2.
§ 5
Method of processing and structure of the security report
(Paragraph 11 (5) of the Law)
(1) The safety report shall be broken down into the following parts:
(a) basic information on the premises or equipment;
(b) descriptions, information and data of the object or equipment and its surroundings;
(c) analysis and assessment of major accident risks;
(d) a description of the major accident prevention system;
(e) a description of the preventive safety measures to limit the possibility of a major accident occurring and the consequences;
(f) a final summary.
(2) The contents of the parts and chapters of the safety report document are set out in Annex 3.
§ 6
Method of processing the safety report assessment report
(Paragraph 11 (5) of the Law)
(1) The report on the assessment of the safety report (the assessment report) is based on the changes made to the change sheets included in the safety report.
(2) The assessment report is divided into the following parts:
(a) basic information on the premises or equipment;
(b) a list and a description of the changes leading to changes in the safety management system, technical changes and facts and findings in the field of security measures implemented or applied in the building or installation;
(c) an assessment of the impact of the changes described on operational safety (risk change, adequate safety measures and acceptability of risk) and, where appropriate, a detailed factual and technical justification as to why the update of the safety report was not implemented or did not need to be updated;
(d) a final summary.
(3) Where there is insufficient information on any part or chapter, this shall be explicitly indicated in the assessment report.
(4) The content of the parts and chapters of the assessment report document is set out in Annex 4.
§ 7
Method and structure of internal emergency plan processing
(Paragraph 17 (5) of the Law)
(1) The internal emergency plan is a written document setting out:
(a) how emergency preparedness is ensured, including information, material, human and economic resources in the event of an accident;
(b) the way in which possible accidents are handled;
(c) measures to ensure appropriate monitoring of the consequences and remediation of the accident site;
(d) the method of documentation of protocols, amendments and updates.
(2) The internal emergency plan is updated on the basis of:
(a) changes resulting from the update of the safety report;
(b) the results of audits and practical exercises, employee initiatives and inspections.
(3) The process and structure of the internal emergency plan are set out in Annex 5.
§ 8
Method of processing and structure of the operator's written documentation for setting the emergency planning zone
(Paragraph 19 (5) of the Law)
(1) Data shall be provided for the establishment of the emergency planning zone on the basis of the assessment of major accident scenarios in accordance with Sections 1 and 3, in particular with regard to dangerous substances located and taking into account the effects of the major accident on the health and lives of persons, livestock, the environment and property.
(2) The content of the chapters of the documentation for the establishment of the emergency planning zone is set out in Annex 6.
§ 9
How to update the security programme, the safety report, the internal emergency plan and the documentation for setting the emergency planning zone
(C 9 (5), 11 (5), 17 (5), 19 (5) of the Act)
The update of the safety programme document (§ 3), the safety report (§ 4), the internal emergency plan (§ 6), the written documentation for the establishment of the emergency planning zone (§ 7) shall be carried out in one of the following ways:
(a) a complete new document or documents and their confusion with invalid documents or documents;
(b) the Appendix to the existing document or supporting documents or their annexes;
(c) new relevant pages of the document or supporting documents and their confusion with those which are invalid if the document structure makes this possible and the changes are minor.
§ 10
Scope and method of information and procedure for ensuring public information in the emergency planning zone
(Paragraph 25 (5) of the Law)
(1) The information to the public shall contain, in a simple and comprehensible manner, data on hazardous substances and the nature of the risk of a major accident, including an estimate of the consequences and their impact on the lives and health of humans, livestock, the environment and property in the emergency planning zone.
(2) The information to be provided to the public shall include information on the manner of warning of persons and their desirable behaviour, which shall be provided following an external emergency plan, processed in accordance with a specific legislation3).
(3) Information to the public shall be made by sending written information.
(4) The persons who have their place of residence in the emergency planning zone, those who have their place of work in the emergency planning zone and those who have their place of business in the emergency planning zone shall be informed.
(5) Details of the content of the information to the public in the emergency planning zone are set out in Annex 7.
§ 11
Efficacy
This Decree shall take effect on 1 June 2006.

Process and scope of risk analysis and assessment
The risk analysis and assessment shall include the following chapters.
1. An overview of the objects or equipment, indicating the type and quantity of hazardous substances in them.
2. An overview of all hazardous substances in the building or plant, their classification and properties needed for risk analysis and assessment.
3. Results of assessment and descriptions of hazardous chemical reactions in undesirable contact with chemicals in an object or facility or under undesirable operating conditions.
4. Results of assessments and descriptions of possible situations in an object or plant which have the potential to cause damage to human health, livestock, environment and property.
5. Results of assessments and descriptions of possible situations outside an object or installation that may cause a major accident.
6. Results of identification and description of major accident risk sources, relative evaluation of their severity and selection of risk sources for a detailed risk analysis, including the identification of significant risk sources on the farm map.
7. The procedure and results of identifying possible scenarios of events and their causes which may result in a major accident and the selection of representative scenarios of such events, including their description.
8. The procedure and results of the implementation of the estimates of the consequences of the representative major accident scenarios and their impacts on the lives and health of humans, livestock, environment and property, including the graphic presentation of the most important estimates.
9. The procedure and results of the estimation of the probability of representative major accident scenarios.
10. The results and procedure for assessing the influence (reliability and error) of the human factor in relation to relevant sources of risk.
11. Indication of the methodologies used in risk analysis.
12. Detailed descriptions of the unpublished methodologies used.
13. Results of the determination of risk ratios of representative major accident scenarios.
14. Results of the assessment of the acceptability of major accident risk.
15. Description of measures for unacceptable sources of risk, their implementation plan and the system for monitoring the implementation of this plan.
16. Description of the system of continuous monitoring of the effectiveness of risk control measures.
17. Information on the assessment carried out of the adequacy of security and safeguard measures in relation to existing risks.

Content of parts and chapters of the security programme

BASIC INFORMATION ON THE OBJECT OR EQUIPMENT
1. Identifying information on the object or equipment (§ 2 (a) and (b) of the Act)
(a) business name, place and postal code, tel. / fax / e-mail, ID,
(b) the name and address of the establishment or establishment in the case of a separate establishment or plant;
(c) the name, surname and address of the natural person authorised to act on behalf of the operator within the meaning of § 2 (c) of the Act.
2. Activity and Employee Data
(a) principal and ancillary activities, permits and authorisations for such activities;
(b) the year of establishment of the business firm or establishment and the relevant dates for the construction, reconstruction and change of operations;
(c) the number of employees on the premises, including the number of employees on each shift.

ANALYSIS AND EVALUATION OF RISK OF SERIOUS HAVARIA FOR THE OBJECT OR EQUIPMENT INCLUDED IN THE GROUP AND
The risk analysis and evaluation shall be carried out in the structure set out in Annex 1 in the range and depth corresponding to the risk level of the object or equipment.

PRINCIPLES, OBJECTIVES AND PREVENTION POLICY
1. Overall objectives and principles for the prevention of a major accident
1.1 Written statement on a major accident prevention policy.
1.2 Information on the public accessibility of the written declaration (press, bulletin, etc.).
1.3 Indicating objectives and principles for all system components.
1.4 Information as to whether the objectives and principles of the prevention of a major accident and the reduction of its possible consequences are consistent with the nature of the sources of risk and of the risks of major accidents and whether they are part of the work safety and environmental programmes.

DESCRIPTION OF THE SAFETY MANAGEMENT SYSTEM
1. Safety management system
1.1. Information on the safety management system shall be provided in the area
(a) major accident prevention organisation;
(b) management of the operation of the premises and equipment;
(c) control of changes in the object and equipment;
(d) emergency planning;
(e) monitoring the implementation of the major accident prevention programme;
(f) audits and controls.
1.2 Information on the accessibility of the security programme document to employees.
1.3 Information on organisational arrangements for the implementation of the safety management system.
1.3.1. Means of identifying the sources of risk (hazards), analysis, valuation and assessment of the risks of a major accident.
1.3.2 Identification and implementation of legislative and technical documents requirements.
1.3.3 Determination of major accident prevention objectives and tasks.
1.3.4 Determination of evaluable indicators, parameters and criteria for assessing the achievement of the objectives, tasks and effectiveness of the measures implemented.
1.3.5 The prioritisation and timing of the implementation or improvement of preventive measures.
1.3.6 Indication of the rules and deadlines for carrying out checks aimed at monitoring the achievement of the objectives set.
2. Organisation of major accident prevention
2.1. Information on the organisation and planning of necessary resources, including:
(a) the way in which technical, financial and human resources are secured and backed up for the purpose of implementing the major accident prevention programme;
(b) whether these resources are also secured in the light of a rapid and effective response in relation to changing or unusual circumstances, as well as the possibility of, for example, changing or eliminating production.
2.2 Information on human resources, i.e. workers involved in the reduction of major accident risks, including:
(a) an indication of the employment position (functional classification), a description of the tasks and duties of these staff members, their substitutability,
(b) identification of these workers in the organisation scheme;
(c) an indication of the location of the storage of the current list of such personnel;
(d) the identification of persons (functions) responsible for the establishment and functioning of the safety management and prevention system of a major accident;
(e) reference to documents defining the responsibilities and responsibilities of workers, external organisations and visitors in the major accident prevention sector;
(f) the indication and identification of the responsibilities of managers for:
(fa) ensuring the necessary resources (including human resources) for the development, implementation and functioning of the management system;
fb) analysis and assessment of the risk of the object and equipment,
(fc) ensuring the knowledge of employees and suppliers of existing risks and determining their risk reduction tasks;
(fd) implementation, monitoring and evaluation of corrective actions;
f) management and management of emergency and emergency situations;
(ff) identifying training needs, ensuring the execution of training and evaluating its effectiveness;
(fg) the introduction of the control mechanisms necessary for the major accident prevention programme;
(fh) coordination in the process of implementing the management system, including information to senior management;
(fi) monitoring the functioning of the management system, evaluating its effectiveness and carrying out controls and audits;
(g) a description of the system for controlling the performance of tasks at all stages of management;
(h) an indication of how to deal with serious accident prevention issues at all stages of the procedure;
(i) an indication of the procedure for informing employees of the results of the major accident prevention proceedings;
(j) an indication of the procedure for dealing with accidents and accidents without consequences (major accidents, accidents, accidents, technical disturbances, accidents, etc.) and the implementation of measures to prevent them,
(k) an indication of how the qualifications of external suppliers and service providers are checked;
