GOVERNMENT REGULATION
of 15 December 2004
delimiting the Bird Region
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The Bird Region of Poodrí (hereinafter referred to as the "bird region") is hereby established.
(2) The protection of the birds' areas is the populations of the flounder (Botaurus stellaris), the motak of the understand (Circus aeruginosus), the iceberg (Alcedo atthis) and the hives (Anas streperis) and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
Definition of bird area
(1) The bird region is situated in the territory of the Moravian-Silesian Region, in the cadastral territories of Albrechtka, Bartošovice, Bernartice nad Odra, Butovice, Smoké Livovice, Hukovice, Jeseník nad Odra, Jistebnik, Košatka nad Odra, Kunín, Mankovice, Nová Horka, Petřvaldík, Polanka nad Odrou, Proskovice, Pustlejov, Stará Belá, Stará Ves nad Ondříník, Studenka nad Odrou, Suchdol nad Odrou, Svinov, Šenov u Nové Jicin, Vradná u nad Oder, Vyškovice near Ostrava and Zábřahr nad odra.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The map material of the 1: 50 000 scale, in which the territory of the bird region is drawn, is stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Poodří Landscape Administration, the Regional Office of the Moravian-Silesian Region and the municipal authorities of the enlarged municipalities, in whose administrative district the bird area is located.
Protection conditions for birds
(1) Only with the prior agreement of the competent authority of nature protection (2) may the territory of the municipalities be located outside the bird area at the same time as the municipality (3)
(a) carry out activities causing a change in the level of established surface and groundwater levels which could cause a change in the biotope of the species for which the bird area is established;
(b) change the type of land and the means of usingit (4);
(c) to enter the lithoral crops of ponds from 1 April to 31 July, except for owners and tenants of land and hunting for the purpose of care of ducks released,
(d) change the water level between 1 April and 31 July by more than 20 cm in a period of less than 14 days on the Great Oška, Kotvice and Horní Bartošovický ponds;
(e) use fertilisers and biocides when managing ponds;
(f) remove lithoral crops;
(g) to draw up new tourist and cycling routes (5);
(h) carry out activities carried out by the flow manager in the course of interventions into banks and coastal areas, with the exception of interventions in an emergency situation where damage to property is imminent or the safety and health of persons is directly threatened.
(2) Prior consent of the competent nature conservation authority is not required
(a) the activities referred to in paragraph 1 (a), in the case of a procedure in accordance with the waterworks rules (6);
(b) the activities referred to in paragraph 1 (b), where such activities are subject to a decision pursuant to a specific legislation (7) and have been given an opinion by the competent nature conservation authority;
(c) the activities referred to in paragraph 1 (d) in the event of a flood, emergency or exceptional climate situation;
(d) for the activities referred to in paragraph 1 (h), where such activities have been notified at least 20 days in advance to the competent nature conservation authority;
(e) the activities referred to in paragraph 1 in the case of activities carried out under special legislation8) in the territory of the designated conquest area and exclusive bearings;
(f) in the implementation of road operations9);
(g) the activities referred to in paragraph 1 (c) and (f) in the railway protection zone under special legislation (10).
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the Bird Region
The border of the bird region of Poodří leads from the railway crossing at the stop in Mankovice to the groove body towards the east. In the place where it touches the railway body of the line Přerov - Bohumín, it passes to this body and continues after it to the northeast through the railway station Suchdol nad Odra, Smooth Life, Studenka, Jistebnik and the station Polanka nad Odra, about 2 km from the stop Polanka nad Odrou the border bends along the railway track to the east to the bridge over the river Odra. Behind the bridge it descends to the river and continues along its right bank to the south to the southwest to where the Odra River overloads the road *) from Polanka nad Odrou to Stará Belá. Here it crosses the border to this road and follows it to Old Belé. At the intersection on the edge of the village, the border turns again to the southwest and leads along the road via Proskovice to Staré Vsi nad Ondřednice. Here at the crossroads it turns right to the bridge via Ondřejnice, along the road it continues 250 m and at the next crossroads it turns right and further leads along the road to the northwest to Košatka, passes through the village and at the crossroads before the bridge through Odra it turns southwest to Petřvaldík. At the intersection in the centre of Petřvaldík it turns down the road down the hill and after 50 metres it passes to a local narrow road leading southwest to Albrechtiček. Here at the edge of the village, it turns left on the road and is falling to the south after 400 metres, changing direction again and continuing along the road again to the southwest until the intersection in Nová Horce, where it turns northwest towards the castle and under the lock north to the mill building, where it dodges again in the southwest direction, cruises the road from Příbora to Stadénka and then along the road passes through Bartošovice and Hukovice to Kunín. In Kunín, the border beyond the bridge via Jichinka turns at the intersection to the south and continues along the road towards Nový Jicin. At the intersection on the edge of the village of Šenov the border is turned west by road to Bernartice nad Odrou, at the point of crossing with K. Bernartice nad Odrou is turned along with the road to the southwest, intersects the village and leads along the road to the intersection on the north edge of Horka. Here the border turns northwest towards the road from Old Jičín to Oder, followed by Jeseník nad Odrou, crossing the water flow of Luha and the railway line and further leading to the village of Vražná. In the Murder border at the intersection behind the bridge through the stream turns right on the road to the village of Mankovice, surpasses Odra and on the railway crossing connects with its beginning.

*) If the text states that the border of the bird's area leads on the road, it is stated that it leads on the edge of the road auxiliary parcel, and that it leads on the edge of the bird's area.
