GOVERNMENT REGULATION
of 9 December 2002
laying down technical requirements for the efficiency of new hot water boilers burning liquid or gaseous fuels
The Government orders pursuant to Article 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll. and Act No. 205 / 2002 Coll., ("the Act ') to implement Sections 11 (2), 11a (2) (c), 12 (1) and (3) and 13 (2) of the Act:
§ 1
Basic provisions
(1) This Regulation implements the relevant provisions of the European Community (1) and lays down technical requirements for the efficiency of new hot water boilers burning liquid or gaseous fuels with a rated power of not less than 4 kW and not more than 400 kW (hereinafter referred to as "boiler") and for components of boilers placed on the market separately (hereinafter referred to as "component").
(2) For the purposes of this Regulation:
(a) the liquid or gaseous fuel boiler shall be considered as a device composed of a boiler body and a burner, intended for heating water with heat energy derived from the combustion of liquid or gaseous fuel;
(b) the boiler component shall consider:
1. boiler body designed for mounting with burner,
2. a burner designed for installation with boiler body,
(c) the rated power (expressed in kW) shall mean the maximum heat output determined and guaranteed by the manufacturer in permanent operation with the efficiency indicated by the manufacturer;
(d) the efficiency (expressed in%) shall be considered as a certain period of time to the temperature calculated as the product of the calorific value of the fuel at its constant overpressure and the consumption of that fuel in the same period of time;
(e) the partial load (expressed in%) shall consider the ratio of the boiler's power that is operated intermittently or at a power lower than its rated power to that rated power;
(f) partial power (expressed in kW) shall mean a partial load power of 30% of the rated power;
(g) the mean water temperature in the boiler shall be taken to mean the arithmetic mean of the water temperatures at the inlet and outlet of the boiler;
(h) the standard boiler shall consider the boiler where the temperature of the boiler may be limited by its design;
(i) the supplementary heat exchanger shall consider an exchanger intended to supply the central heating system and to be installed in the flue gas exhaust as part of a combination consisting of a supplementary heat exchanger and a gas heater;
(j) a low-temperature boiler shall consider a boiler which may be permanently operated at a water inlet temperature of 35 to 40 ° C and in which, under certain circumstances, condensation of water vapour contained in the flue gas may occur; a condensing boiler for liquid fuels is considered as a low-temperature boiler;
(k) the gas condensing boiler shall be considered as a gas boiler which is so designed as to continuously condense a large part of the water vapour contained in the flue gas;
(l) the boiler intended to be placed in the living space is considered to be a boiler with a rated output of less than 37 kW, designed by the radiator to transfer heat from its mantle to the living space in which it is installed, equipped with an open expansion tank and the supply of hot water is carried out by self-circulation - these boilers shall have on the external surface explicitly indicated that they are intended only for housing in the living space.
(3) For the purposes of this Regulation, boilers shall not be considered as boilers:
(a) boilers capable of burning different types of fuels, including solid fuel;
(b) equipment for the immediate preparation of hot water (flow heaters);
(c) boilers intended for the combustion of fuels whose characteristics differ substantially from those of liquid and gaseous fuels normally available on the market (e.g. waste industrial gases, biogas);
(d) stoves and appliances intended primarily for heating the space in which they are placed, which have as an additional function the supply of hot water for central heating or the supply of hot commercial water;
(e) appliances with a rated output of less than 6 kW, with self-contained circulation, intended only for the preparation of storage hot water for use in the container;
(f) boilers not manufactured in series but in individual pieces;
(g) equipment combining the production of useful heat and the production of electrical or mechanical energy simultaneously in a single production process.
(4) The specified products under this Regulation within the meaning of Section 12 (1) (a) of the Act are new boilers and components.
§ 2
Conditions for placing on the market and putting into service of boilers and components
(1) In order to be put into service, boilers must meet the technical requirements for the efficiency of boilers set out in Annex 1 (hereinafter referred to as the "technical efficiency requirements").
(2) The technical requirements for efficiency are deemed to be met if the boiler or component is in conformity with harmonised Czech technical standards or, where applicable, foreign technical standards transposing harmonised European standards in the Member States of the European Union (§ 4a of the Act). Any such boiler shall bear the CE marking and be accompanied by an EC declaration of conformity.
(3) In the case of boilers intended for heating and hot water preparation, the technical efficiency requirements apply only to the heating function.
(4) Additional heat exchangers and boilers intended to be placed in the accommodation can only be put into service if their efficiency, both at rated and partial output, is not reduced by more than 4%, compared to the efficiency determined for standard boilers.
(5) Each component shall bear the CE marking before being placed on the market and shall be accompanied by an EC declaration of conformity which contains the parameters of the relevant component which guarantee that, after installation of the boiler for which the component is intended, the relevant technical requirements for the efficiency of that boiler are met.
§ 3
Conformity assessment procedures
(1) Conformity of manufactured boilers with technical efficiency requirements is assessed
(a) EC type-examination (conformity assessment procedure B) as referred to in Annex 2 to this Regulation; and
(b) a certificate of conformity of the boiler with the type described in the EC-type examination certificate by one of the procedures set out in Annex 3 to this Regulation (conformity assessment procedure C, D or E).
(2) In the case of gas boilers, the conformity assessment procedures with the technical efficiency requirements must comply with the conformity assessment procedures applied for those boilers with the requirements of the special regulatory regulatory act (2).
§ 5
CE marking and other marking
(1) The CE marking, the graphic form of which is laid down in a separate legislation, (3) the boilers and components meeting the requirements of this Regulation shall be affixed in a visible, easily legible and indelible manner.
(2) Boilers and components must not bear a mark which could mislead anyone with regard to the CE marking. Boilers and components may bear a marking other than the CE marking, but this shall not impair the visibility or legibility of the CE marking.
(3) The CE marking on the boiler or component shall indicate that the product complies with the technical requirements laid down in all the legislation applicable to it and which provide for or allow such marking and that the procedure laid down in the conformity assessment procedure has been followed. However, if one or more laws allow the manufacturer, for a transitional period, to choose which provisions he will follow, the CE marking shall indicate compliance only with those laws or their provisions used by the manufacturer. In this case, the documentation, warnings or instructions required by the legislation concerned and annexed to the products concerned shall indicate the relevant European Community legislation or provisions applied by the manufacturer.
§ 6
Authorisation conditions
(1) The authorisation of legal persons under Section 11 (2) of the Act applies to the conditions of authorisation set out in Annex 5 to this Regulation. Legal persons meeting the criteria laid down in the relevant harmonised standards shall be deemed to comply with the relevant conditions.
(2) The Authorised Person becomes a Notified Person in accordance with the procedure laid down in Article 11 (7) of the Act.
Transitional and final provisions
§ 7
(1) Valid certificates or other documents issued under Government Decree No. 180 / 1999 Coll., as amended by Government Decree No. 289 / 2000 Coll., may be used for the purposes of conformity assessment under this Regulation unless they are repealed under the conditions laid down by law.
(2) Persons in charge of conformity assessment activities under Government Regulation No. 180 / 1999 Coll., as amended by Government Regulation No. 289 / 2000 Coll., shall be deemed to be persons in charge of activities under this Regulation.
§ 8
The following shall be deleted:
1. Government Decree No. 180 / 1999 Coll., laying down technical requirements for the efficiency of hot water boilers burning liquid or gaseous fuels.
2. Government Decree No. 289 / 2000 Coll., amending Government Decree No. 180 / 1999 Coll., laying down technical requirements for the efficiency of hot water boilers burning liquid or gaseous fuels.
§ 9
This Regulation shall enter into force on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.

TECHNICAL REQUIREMENTS FOR THE EFFICIENCY OF COTLES
The prescribed boiler efficiency values are given in the table below for operation at rated power Pn and at mean water temperature in the boiler equal to 70 ° C and also at partial power and at determined mean water temperature in the boiler, this temperature at partial power is determined in different ways for individual boiler types.

The required values of the technical efficiency requirements shall include the relevant tolerances for the methods of verification applied in the production and measurement, as set out in harmonised Czech technical standards relating to the technical requirements of this Regulation.

Annex No. 2 to Government Decree No. 25 / 2003 Coll.
EC TYPE REVIEW (conformity assessment procedure B)
1. EC type-examination is a procedure whereby the notified person ascertains and certifies that the sample representing the production envisaged complies with the relevant provisions of this Regulation.
2. The application for EC type-examination shall be submitted by the manufacturer or his authorised representative to the notified person at his choice.
The application shall contain:
(a) identification of the manufacturer (for a natural person, name and last name and permanent address or place of business, name or business name and registered office of the legal person). If the application is submitted by an authorised representative, it shall also contain its identification details,
(b) a written declaration that the same application has not been submitted to another notified person;
(c) the technical documentation, the content of which is given in point 3.
The applicant shall provide the notified person with a sample of the intended production (hereinafter referred to as "type '), where the notified person may require additional specimens of the type if necessary for the execution of the test programme.
3. The technical documentation shall include data relating to the design, manufacture and operation of the boiler or component necessary to assess the conformity of the boiler or component with the requirements of this Regulation and shall include:
(a) a general description of the type,
(b) design design, production drawings, drawings of assemblies, sub-assemblies, circuits, etc., necessary for conformity assessment;
(c) descriptions and explanations necessary to understand the drawings and graphs and the operation (s) of the boiler or component,
(d) the list of harmonised technical standards applied in whole or in part and the descriptions of the solutions adopted to meet the technical efficiency requirements where those standards have not been applied;
(e) the results of design calculations or tests carried out;
(f) checking protocols.
4. Noticed Person
4.1. It shall examine the technical documentation, verify that the type has been manufactured in accordance with this documentation and identify the elements which have been designed in accordance with the relevant provisions of the harmonised technical standards as well as the components which have been designed without the application of the relevant provisions of those standards.
4.2. It shall carry out or have carried out appropriate verifications and tests to determine whether, where harmonised technical standards have not been applied, the solution adopted by the manufacturer complies with the technical efficiency requirements.
4.3. It shall carry out or have carried out the relevant verifications and tests necessary to determine whether they have actually been used where the application of the relevant harmonised technical standards has been chosen.
4.4. It shall agree with the manufacturer or his authorised representative the place where the verification and the necessary tests are to be carried out.
5. Where the type complies with the relevant provisions of this Regulation, the notified person shall issue the EC-type examination certificate to the manufacturer or his authorised representative. This certificate shall contain the identification details of the manufacturer and, where applicable, his authorised representative, the test conclusions and the necessary data for the identification of the certified type.
The notified person shall attach to the EC type-examination certificate a list of the relevant part of the technical file. The copy shall remain with the notified person.
If the notified person refuses to issue an EC type-examination certificate to the manufacturer or his authorised representative, he shall inform him of the detailed reasons for the refusal and give him the opportunity to object to the refusal.
6. The applicant shall inform the notified person who owns the technical documentation for the certified type of any change to the approved boiler or component requiring additional approval. The additional approval shall be confirmed in the form of an addendum to the original EC-type examination certificate.
7. The notified person shall provide all relevant notified persons with information on the EC type-examination certificates and their additions which he has issued or revoked.
8. Other relevant notified persons may receive copies of EC type-examination certificates and additions thereto; their annexes shall be kept available for other notified persons.
9. The manufacturer or his authorised representative, together with the technical documentation, shall also keep copies of the EC type-examination certificates and their additions for at least 10 years after the date of the last manufacture of the product concerned.
Where the manufacturer is not established in the territory of the European Community or there is no authorised representative, the person who places the product on the market shall be responsible for providing evidence of conformity assessment at the request of the supervisory authority.

Annex No. 3 to Government Decree No. 25 / 2003 Coll.
1. CONFORMITY WITH TYPE (conformity assessment procedure C)
1.1. Conformity to the type specified in the EC-type examination certificate is the procedure whereby the manufacturer, or his authorised representative, is satisfied and declares that the boilers or components comply with the type described in the EC-type examination certificate issued in accordance with the conformity assessment procedure B and meet the relevant requirements of this Regulation. The manufacturer or his authorised representative shall affix the CE marking to each product and issue a written declaration of conformity.
1.2. The manufacturer shall ensure all measures necessary to ensure that the production process ensures compliance of the manufactured boilers or components with the type described in the EC-type examination certificate and with the technical requirements for efficiency.
1.3. The manufacturer or his authorised representative shall keep a copy of the declaration of conformity for at least 10 years after the date of the last manufacture of the product concerned. Where the manufacturer is not established in the territory of the European Community or there is no authorised representative, the person who places the product on the market shall be responsible for providing evidence of conformity assessment at the request of the supervisory authority.
1.4. The person selected by the manufacturer shall perform or have the product tested at random intervals. The appropriate sample of finished products selected at random by the notified person shall be examined and the relevant tests, as defined in the harmonised technical standards, shall be carried out or equivalent tests shall be carried out to determine whether the products comply with the requirements of this Regulation. Where one or more specimens of the products tested do not comply, the notified person shall take appropriate action.
2. PRODUCTION QUALITY SECURITY (conformity assessment procedure D)
2.1. The quality assurance of production is a procedure whereby the manufacturer, meeting the provisions of paragraph 2.2 above, is satisfied and declares that the boilers or components are in conformity with the type described in the EC type-examination certificate and comply with the requirements of this Regulation. The manufacturer or his authorised representative shall affix the CE marking to each product and draw up a written declaration of conformity. The CE marking shall be accompanied by the identification number of the notified person supervising the quality system referred to in point 2.4.
2.2. The manufacturer shall apply the approved quality system of production and inspection referred to in point 2.3 and shall be supervised in accordance with point 2.4.
2.3. Quality system
2.3.1. The manufacturer shall submit an application for the assessment of his production quality system for the relevant boilers or components notified to the person at his choice.
The application shall contain:
(a) any necessary information on boilers or components;
(b) documentation of the quality system of production,
(c) technical documentation relating to the certified type and a copy of the EC type-examination certificate.
2.3.2. The production quality system shall ensure compliance of boilers or components with the type described in the EC type-examination certificate and with the requirements of this Regulation applicable to them.
All measures taken by the manufacturer shall be documented in a systematic and proper manner in the form of written instructions, procedures and instructions. The quality system documentation shall allow a uniform interpretation of the programmes, plans, manuals and quality records.
The documentation shall include in particular a reasonable description of:
(a) the quality, organisational and responsibility objectives of the statutory bodies and their competence in relation to the quality of boilers or components;
(b) production, quality management and quality assurance procedures, other processes used and systematic activities;
(c) the examinations and tests to be carried out at the pre-production, production and post-production stages, including their frequency;
(d) quality records such as inspection reports and test data, calibration data, qualification records of relevant personnel and so on;
(e) means of monitoring whether the required quality of boilers or components and the effective functioning of the quality system have been achieved.
2.3.3. The notified person shall assess the quality system for compliance with the requirements referred to in point 2.3.2. The presumption of conformity with these requirements is met for quality systems which conform to the relevant harmonised technical standard. The procedure shall also include an assessment at the manufacturer's workplace. The competent team of assessors shall have at least one member with experience in assessing the relevant production technology.
The notified person shall forward his decision to the manufacturer, which shall include the results of the assessment relating to the boilers or components concerned and the proper justification for his decision.
2.3.4. The boiler or component manufacturer shall ensure that the obligations arising from the approved quality system are fulfilled and maintained in such a way that they remain adequate and effective.
The manufacturer or his authorised representative shall inform the notified person who approved the quality system of any intended change in the quality system.
The notified person shall assess the proposed changes and decide whether the modified quality system will continue to comply with the requirements set out in point 2.3.2 or whether a new assessment is necessary.
The notified person shall forward his decision to the manufacturer, which shall include the results of the assessment and the justification for his decision.
2.4. Supervision of the responsibility of the notified person
2.4.1. The purpose of supervision is to ensure that the manufacturer complies adequately with the obligations under the approved quality system.
2.4.2. For supervisory purposes, the manufacturer shall allow the notified person access to the premises of manufacture, inspection, testing and storage and provide the necessary supporting documents, in particular:
(a) documentation of the quality system;
(b) quality documents, such as inspection reports and test results, calibration data, qualification data for relevant personnel.
2.4.3. The notified person shall carry out regular supervision, including on-the-spot assessments, to ensure that the boiler or component manufacturer maintains and uses the quality system and shall report to the manufacturer on the results of the supervision.
2.4.4. In addition, the notified person may carry out unannounced surveillance with the manufacturer. During unannounced surveillance, the notified person may carry out tests or have them carried out to verify the proper functioning of the quality system. The notified person shall provide a report to the manufacturer on the results of the surveillance and, if the contents of the surveillance were tests, a test report.
2.4.5. The manufacturer shall keep for at least 10 years after the date of the last manufacture of the product concerned:
(a) the documents referred to in point 2.3.1 (b);
(b) details of changes in accordance with point 2.3.4.
(c) notifications, protocols and reports of a notified person as referred to in the last paragraph of point 2.3.4 and in points 2.4.3 and 2.4.4.
2.4.6. Each notified person shall communicate to all relevant notified persons information on the documents relating to the quality system approval issued or cancelled.
3. SAFETY OF PRODUCTION QUALITY (conformity assessment procedure E)
3.1. The quality assurance of the product is a procedure whereby a manufacturer, complying with the provisions of paragraph 3.2, is satisfied and declares that the boilers or components are in conformity with the type described in the EC type-examination certificate and comply with the requirements of this Regulation. The manufacturer or his authorised representative shall affix the CE marking to each boiler or component and draw up a written declaration of conformity. The CE marking shall be accompanied by the identification number of the notified person carrying out the supervision referred to in point 3.4.
3.2. The manufacturer shall apply an approved quality system of inspection and testing of the finished boilers or components referred to in point 3.3 and shall be subject to supervision in accordance with point 3.4.
3.3. Quality system
3.3.1. The manufacturer shall submit an application for an assessment of his quality system for the relevant boilers or components notified to the person at his choice.
The application shall contain:
(a) any necessary information on boilers or components;
(b) documentation of the product quality system,
(c) technical documentation relating to the certified type and a copy of the EC type-examination certificate.
3.3.2. Within the quality system, each boiler or component shall be tested according to harmonised technical standards, or equivalent tests shall be carried out to establish compliance with the technical efficiency requirements.
All measures taken by the manufacturer shall be documented in a systematic and proper manner in the form of written instructions, procedures and instructions. The quality system documentation shall allow a uniform interpretation of the programmes, plans, manuals and quality records.
The documentation shall include in particular a reasonable description of:
(a) the quality objectives, organisational structure and responsibilities of the statutory bodies and their competence with regard to the quality of boilers or components;
(b) reviews and tests to be carried out after production, other processes used and systematic activities;
(c) means of monitoring the effectiveness of the quality system;
(d) quality records such as inspection reports and test data, calibration data, qualification records of relevant personnel and so on.
3.3.3. The notified person shall assess the quality system for compliance with the requirements referred to in point 3.3.2. The presumption of conformity with these requirements is met for quality systems which conform to the relevant harmonised technical standard. The procedure shall also include an assessment at the manufacturer's workplace. The competent team of assessors shall have at least one member with experience in assessing the relevant production technology.
The notified person shall forward his decision to the manufacturer containing the results of the assessment relating to the boilers or components concerned and the justification for his decision.
3.3.4. The boiler or component manufacturer shall ensure that the obligations arising from the approved quality system are fulfilled and maintained in such a way that they remain adequate and effective.
The manufacturer or his authorised representative shall inform the notified person who approved the quality system of any intended change in the quality system.
The notified person shall assess the proposed changes and decide whether the modified quality system will continue to comply with the requirements set out in point 3.3.2 or whether a new assessment is necessary.
The notified person shall forward his decision to the manufacturer, which shall include the results of the assessment and the justification for his decision.
3.4. Supervision of the responsibility of the notified person

3.4.5. The manufacturer shall keep for at least 10 years after the date of the last production of the boiler or component concerned:
(a) the documents referred to in point 3.3.1 (c);
(b) details of the changes referred to in point 3.3.4 of the second paragraph;
(c) notifications and protocols of the notified person in accordance with the last paragraph of point 3.3.4 and points 3.4.3 and 3.4.4.
3.4.6. Each notified person shall communicate to all relevant notified persons information on the documents relating to the quality system approval issued or cancelled.

AUTORISATION CONDITIONS
1. The Authorised Person, its Director and the staff responsible for carrying out the verification tests shall not be the designers, manufacturers, suppliers or installers carrying out the installation of boilers or components they verify, nor shall the authorised representatives of any of these Parties. They shall not participate directly or as authorised representatives in the design, manufacture, placing on the market or maintenance of such boilers and components. This shall not preclude the possibility of exchanging technical information between the manufacturer and the authorised person.
2. The Authorised Person and its staff shall carry out verification tests at the highest level of professionalism and competence and shall avoid any coercion and motivation, in particular financial ones, which could affect their assessment of the results of the checks, in particular for persons or groups of persons interested in the outcome of the verification.
3. The authorised person shall have at his disposal the necessary staff and own the necessary facilities to ensure that administrative and technical operations related to verification are carried out properly; shall also have access to the equipment required for special verification.
4. The staff responsible for the inspection shall have:
(a) proper technical and professional training;
(b) satisfactory knowledge of the requirements of the tests they carry out and adequate experience for carrying out those tests;
