of 14 April 1953
on the transfer of competence in certain matters of pension and sickness insurance.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42 paragraph 1 of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
§ 1.
(1) The Regional National Committees shall:
(a) the scope which has been exercised so far by district national insurance undertakings in respect of pension benefits;
(b) the other scope which has been exercised so far by district national insurance undertakings in respect of pension insurance for members of single agricultural cooperatives, self-employed and cooperating members of their families, as well as persons voluntarily continuing national pension insurance.
(2) In agreement with the Ministry of the Interior, the State Pension Insurance Office may delegate to the Regional or Regional National Committees the execution of additional tasks, except for decisions on pension benefits.
§ 2.
(1) The county national committees carry out sickness insurance for non-occupational pensioners and members of single agricultural cooperatives of the III and IV type, which are still under the responsibility of the Central National Insurance Corporation (regional national insurance companies).
(2) The Central Board of Trade Unions may, in agreement with the Ministry of the Interior and Health and the State Pension Office, transfer by an official decree to the Regional National Committees the implementation of sickness insurance for certain other persons not in employment.
§ 3.
The management and supervision of the matters referred to in Sections 1 and 2 shall be carried out by the State Pension Insurance Office.
§ 4.
The Ministry of Labour in the field of placement of persons with altered working capacity is transferred to the State Pension Security Office.
§ 5.
(1) The county and regional national committees will take over the necessary number of employees of regional national insurance companies.
(2) Property (rights and obligations) of the Central National Insurance Corporation, where they serve to carry out tasks transferred to national committees, is transferred to the State and entrusted to the administration of national committees. The entries in the land books shall be made by the court on a proposal from the competent national committee.
(3) The determination of the assets referred to in paragraph 2 shall be agreed between the Ministers of the Interior and Health, the Chairman of the State Pension Insurance Commission and the Central Council of the Unions.
§ 6.
Measures taken in conformity with the provisions of this Regulation before its effect shall be deemed to have been taken under it.
§ 7.
More detailed provisions for the implementation of this Regulation shall be adopted by: State Pension Office in agreement with the Ministry of the Interior and other participating central offices and the Central Council of Trade Unions.
§ 8.
The provisions contrary to this Regulation shall be repealed.
§ 9.
(1) This Regulation shall enter into force on 1 May 1953, with the exception of the provisions of Sections 1 (1) (b), 2 (1) and 4, which shall take effect on 1 July 1953.
(2) This Regulation shall be implemented by the Minister for the Interior and the Chairman of the National Pension Commission in agreement with the participating members of the Government and the Central Board of Trade Unions.
