on certain measures to mitigate the effects of a coronavirus epidemic known as SARS CoV-2 on cultural events
Parliament has decided on this law of the Czech Republic:
§ 1
Subject matter
This law regulates certain measures in the field of cultural festivals, shows and similar cultural events (hereinafter referred to as "cultural events') in relation to an epidemic of coronavirus known as SARS CoV-2.
§ 2
Scope
This Act shall apply to cultural events with an estimated date of holding by 30 September 2021.
§ 3
Withdrawal period
(1) Protection period is the period by which the obligation of the organiser of a cultural event under Article 2 (hereinafter referred to as "organiser") to refund the admission fee for a cultural event under Article 2 paid by or for the benefit of the customer.
(2) The period of protection begins on the date of notification by the organiser of the cancellation of a cultural event by means of mass media and ends on 31 October 2022, unless it ends earlier in accordance with this Act.
A voucher for a cultural event
§ 4
(1) By 31 December 2021, the customer may ask the organiser for a voucher for a cultural event (hereinafter referred to as the voucher). The organiser is obliged to issue the voucher at least at the value of the fee paid.
(2) The voucher is valid for the duration of the protection period.
(3) The voucher contains in particular:
(a) a cash amount corresponding to at least the value of the entry fee paid; and
(b) the company or name or name and surname of the organiser, its identification number and address of the registered office.
(4) The organiser shall issue a voucher in paper form to the customer; in electronic form, the voucher may be issued to the customer if the original contract has been concluded by means of distance communication or has been approved by the customer.
§ 5
(1) For the duration of the protection period, the organiser shall offer the customer a replacement cultural event on the basis of a voucher. The organiser may not require the customer, in addition to the voucher, to pay any difference in the price of the entry fee compared to the original contract.
(2) The withdrawal period shall end if the organiser:
(a) has not issued a voucher to the customer within 1 month of his request; or
(b) has not offered a replacement cultural event to the customer within 6 months of the issue of the voucher with the date of the event until 31 October 2022.
(3) If the customer is a person who, at the date of notification of the organiser of the cancellation of a cultural event, holds the card of a person with a disability (1), a person registered as a job seeker, a person pregnant, a person on maternity or parental leave or a person over 65 years of age, or a single parent (2) caring for an uninsured person (3), the protection period shall also end if the organiser requests the organiser to return the admission fee.
(4) The obligation to return the admission fee, the performance of which has been deferred for the duration of the protection period, shall be deemed to have been fulfilled by using the voucher to pay the admission fee for a replacement cultural event which is not less than the amount of money referred to in Article 4 (3) (a).
(5) Upon request, the organiser will return all payments paid to the customer no later than 14 days after the end of the period of protection.
§ 6
The organizer shall, in a clear, comprehensible and clear manner, instruct the customer about his rights under this law.
§ 7
Efficacy
This Act shall take effect on the day of its publication.
