DECLARATION
of 26 July 2023
amending Decree No 155 / 2005 Coll., on the method of making call marks, identification numbers and codes, their use and the types of radio communications services for which they are required, as amended by Decree No 103 / 2018 Coll.
The Ministry of Industry and Trade provides pursuant to Section 150 (2) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 110 / 2007 Coll., Act No. 153 / 2010 Coll., Act No. 468 / 2011 Coll., Act No. 214 / 2013 Coll., Act No. 258 / 2014 Coll. and Act No. 374 / 2021 Coll., to implement Section 16 (7) of the Act:
Decree No. 155 / 2005 Coll., on the method of making call marks, identification numbers and codes, their use and the types of radio communications services for which they are required, as amended by Decree No. 103 / 2018 Coll., is amended as follows:
1. In Article 1, at the end of point (x), the dot is replaced by a comma and the following point (y) is added:
"(y) registration number of the aircraft, registered in the Czech Aviation Register or in the Register of Authorised Persons to keep a register of sports flying equipment (4) and a pre-assigned registration number before registration in one of these registers.
4) Sections 4 and 84b of Act No. 49 / 1997 Coll., on Civil Aviation, as amended. '
2. In Article 1, the last sentence is deleted.
3. In Article 3, paragraphs 3 and 4 are added, including footnote 5:
"(3) The identification of identifiers under § 1 (s) to (w) used in the English language is set out in Annex 2 to this Decree.
(4) The identification number of the remote pilot-in-command of the unmanned aircraft shall be the identification number assigned by the Civil Aviation Authority, which shall appear on the online training certificate for subcategories A1 and A3 of the open category of operation in accordance with the directly applicable European Union Regulation governing the operation of unmanned aircraft (5).
(5) Article 3 of Commission Implementing Regulation (EU) 2019 / 947 of 24 May 2019 on rules and procedures for the operation of unmanned aircraft. ';
4. In Paragraph 9 (3) (h), at the end of point 4, the word "or 'is deleted.
5. In Article 9 (3) (h), at the end of point 5, the comma is replaced by "or 'and the following point 6 is added:
"6. Ten characters, the first two being OK letters, the other two being PL letters and the remaining digits being the number of the pilot pilot's parachute glider. '
6. in Paragraph 9 (3) (j) (6):
"6. call signs starting with OL0 to OL4 and OL6 to OL9 and two or more letters or figures, the last of which must be a letter, shall be assigned only for special temporary use opportunities, for the duration of such opportunities only, but not more than 14 months, ';
7. in Paragraph 9 (3) (j), the following point 7 is inserted after point 6:
"7. call signs starting with OL5 and two or more letters or figures, the last of which must be the letter, with the exception of call signs referred to in point 8, shall be assigned only for special temporary use opportunities, but not more than for the duration of such opportunities, ';
Points 7 and 8 shall be renumbered 8 and 9.
8. In Article 9 (4), the words "with the exception of a call sign for special temporary use 'shall be inserted after the words" an authorisation'.
9. In Article 10, the following paragraphs 3 to 5 are inserted after paragraph 2, including footnotes 6 and 7:
"(3) The national call sign of the station for communication by remote-control pilots of unmanned aircraft for the purpose of ensuring safe air traffic control shall be assigned in accordance with the principles:
(a) seven characters, the first three being the designation of an air operator, if published by the International Civil Aviation Organisation, or the letters of the DRN, if not published by the designation of an air operator by the International Civil Aviation Organisation, and the remaining characters being the last four characters are the identification number of the remote pilot-in-command of an unmanned aircraft; or
(b) seven characters, the first two being OK letters and the other five being the same as the aircraft registration mark, if any.
(4) The national call sign for the operator of the station managing the property of the State forming the railway transport route (6) forms a combination of one-word expressions where, in the case of:
(a) the fixed station is a combination of expressions corresponding to the working classification of the staff member and the place of work;
(b) moving stations shall be a combination of expressions corresponding to the working grade of the service staff member, the place of work and the exact position of the service staff member.
(5) The holder of an individual authorisation for the use of ground-based mobile service radio frequencies shall establish call signs for each station in accordance with paragraph 4 in accordance with the conditions laid down in such an individual authorisation for the use of radio frequencies and in accordance with international traffic regulations and the directly applicable European Union Regulation on the technical specification for interoperability for the traffic operation and management subsystem, maintenance subsystem or telematics use subsystem in passenger and freight transport7).
6) Act No. 77 / 2002 Coll., on the joint stock company České dráhy, state organization Railway Administration and amending Act No. 266 / 1994 Coll., on Railways, as amended, and Act No. 77 / 1997 Coll., on State Enterprise, as amended.
(7) Point 2.1 of Part C1 of Appendix C to Commission Implementing Regulation (EU) 2019 / 773 of 16 May 2019 concerning the technical specification for interoperability relating to the "operation and traffic management" subsystem of the rail system in the European Union and repealing Decision 2012 / 757 / EU, as amended. ';
Paragraph 3 shall become paragraph 6.
10. Annex 2 shall read as follows:
