DECLARATION
of 15 July 2025
amending Decree No. 489 / 2021 Coll., on the procedures for the registration of aid with a market operator and implementing certain other provisions of the Act on Supported Energy Sources (Registration Order), as amended by Decree No. 366 / 2024 Coll.
According to Article 53 (2) (c) to (f) and (i) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 131 / 2015 Coll., Act No. 382 / 2021 Coll. and Act No. 87 / 2025 Coll.:
Decree No. 489 / 2021 Coll., on the procedures for registration of aid with a market operator and the implementation of certain other provisions of the Act on Supported Energy Sources (Registration Order), as amended by Decree No. 366 / 2024 Coll., is amended as follows:
1. In Section 1, the words "procedures for the selection and modification of green electricity bonus schemes' are replaced by the words" procedure for the selection of the form of electricity support and its amendments'.
2. In Paragraph 2 (b), the word "hourly 'is replaced by" quarter-hour', the words "annual 'are inserted after the word" heat' and the words "annual 'are inserted after the word" biomethane'.
3. In Paragraph 8 (1), the words "including the form of support and the green or auction bonus scheme 'are deleted.
4. Paragraph 8 (3) reads as follows:
"(3) In the case of registration of aid in the form of an auction bonus or an auction bonus on biomethane, the producer or producer of biomethane shall indicate the reference auction price. ';
5. In Article 11 (2), the words "in the case of aid in the form of an auction bonus for biomethane, with details in the decision granting the right to aid from an auction," shall be inserted after the words "amending the decision granting a gas production licence."
6. in Paragraph 13 (4), point (a) shall be deleted;
Points (b) and (c) shall become points (a) and (b).
7. In Annex 2, point 14, point (f) is deleted.
8. In Annex 3, point 8, point (f) is deleted.
9. In Annex 4, point 12, point (f) is deleted.
10. In Annex 5 (1) (a):
"a. Form and scheme for the promotion of electricity from renewable energy sources:
i. Purchase price.
ii. Green bonus for electricity:
I. Annual scheme.
II. Quarterly mode.
iii. Auction bonus:
I. Quarterly mode.
II. Reference auction price of the decision granting the right to aid from the auction. '
11. In Annex 5, point 1, at the end of point (b), the words "II. Reference auction price of the decision granting the right to aid from the auction shall be added to the separate line."
12. In Annex 5, point 3 (a):
"a. Form and aid scheme for biomethane:
i. Green bonus for biomethane:
I. Annual scheme.
ii. Biomethane auction bonus:
I. Monthly mode.
II. Reference auction price of the decision granting the right to aid from the auction. '
Efficacy
This Decree shall take effect on 1 January 2026.
