DECLARATION
of 26 July 2023
amending Decree No. 227 / 2015 Coll., on the elements of the safety documentation and the scope of the information provided to processors by the assessment
According to Article 54 (1) of Act No. 224 / 2015 Coll., on the prevention of major accidents caused by selected hazardous chemicals or chemical mixtures and amending Act No. 634 / 2004 Coll., on Administrative Charges, (Act on the Prevention of Major Accidents), ("the Act ') for the implementation of Sections 9 (3), 10 (6), 11 (3), 12 (6), 13 (3), 23 (8) and 27 (4) of the Act:
Decree No. 227 / 2015 Coll., on the elements of the safety documentation and the scope of the information provided to the processors by the assessment, is amended as follows:
1. in Paragraph 2 (2) (b) (3), "a" is replaced by a comma.
2. In Article 2 (2), the following point 5 is added at the end of point (b):
"5th evaluation of the range of emergency speeches, and."
3. In Article 3 (1), the words', a review of publicly available verified information on previous accidents and accidents with the same substances and procedures as used in the building, taking into account the relevant experience gained and a direct reference to a description of the specific measures taken to prevent such accidents' shall be inserted after the word "staff '.
4. In Annex 1, point 2.2 (d), the word "Graphic 'is replaced by the words" Evaluation of the range of emergency manifestations, including graphic expressions'.
5. In Annex No 2, Part II, points 1.1.4. and 1.1.5. are deleted.
Points 1.1.6. and 1.1.7. shall be renumbered 1.1.4. and 1.1.5.
6. In Annex No 2, Part II, the following points 1.3.5 and 1.3.6 are inserted after point 1.3.4:
"1.3.5. Information on the selection of suppliers and external bodies for major accident prevention and assessment activities, including a reference to the relevant internal regulation.
1.3.6. Information on the training of suppliers, external bodies, their staff and visitors and the verification of their knowledge, including the reference to the relevant internal regulation. '
Points 1.3.5 to 1.3.11 shall be renumbered 1.3.7 to 1.3.13.
'7. In Annex No 2, Part II, the following point 1.3.14 is added at the end of point 1.3:
"1.3.14. Information on how to ensure the continuity of personnel in the case of so-called ageing of human resources, including a reference to the relevant internal regulation. ';
8. In Annex No 2, Part II, point 2.9, the words ", monitoring the durability of relevant equipment 'are inserted after the word" controls'.
9. In Annex No 2, Part II, the following point 2.10 is inserted after point 2.9:
"2.10. Information on the management and control of the risks associated with ageing and corrosion in objects, technical equipment and technology. ';
Points 2.10 to 2.20 shall become points 2.11 to 2.21.
10. In Annex No 2, Part II, at the end of the text in point 3.5, the words "(e.g. unfavourable health status of the population in relation to an epidemic or pandemic of infectious diseases, blackouts or disruptions of energy supply, etc.) 'are added.
11. in Annex No 2, Part II, point 3.8, the word "legal" is replaced by "internal."
12. In Annex 3, Part I. (1), Annex 4, Part I. (1), Annex 5, Part I. (1), Annex 6, Part I. (1) and Annex 8, Part I. (1), the words "or any other unique identifier, if assigned, shall be added at the end of the text of point (a)," and at the end of the text of point (b), the geographical coordinates of the centre of the object shall be added. "
13. In Annex 3, Part I, at the end of point 4, point (f) is replaced by the following:
"(f) a list of potential natural phenomena that may cause or worsen a major accident (NaTech risk)."
14. In Annex 3, the following point 5 is added at the end of Part I:
"5. Lessons learned from the review of previous accidents and accidents with the same substances and procedures as used in the building that occurred
(a) in the premises of the operator;
(b) within the territory of the Czech Republic in the last 15 years; and
(c) within the territory of the other Member States of the European Union in the last 15 years;
and taking into account the relevant experience gained and a direct reference to the specific measures taken to prevent such accidents. ';
15. At the end of Annex 3, Part VI is added:
Documentation for processing information to the public pursuant to Decree No. 228 / 2015 Coll. '.
16. In Annex 4, Part II and Annex 6, Part II, point 2.2:
"2.2. Changes in the type, quantity, classification, properties or location of hazardous substances in the object. ';
17. In Annex 4, the following point 3 is added at the end of Part III:
'3. List of possible necessary changes in information to the public pursuant to Decree No. 228 / 2015 Coll. '.
18. In Annex 5, Part II, the words "and other specific characteristics' in point 1.2.4. are replaced by the words" the characteristics and the identified hazards to human health and the environment, both acute and chronic '.
19. In Annex 5, point 2.7 is added at the end of point 2:
"2.7. A list of potential natural phenomena that can cause or worsen a major accident (NaTech risk). '
20. In Annex 5, the following point 3 is added at the end of Part II:
'3. Lessons learned from the review of previous accidents and accidents with the same substances and procedures as used in the building that occurred
(a) in the premises of the operator;
(b) in the territory of the Czech Republic in the last 15 years,
(c) within the territory of the other Member States of the European Union in the last 15 years;
and taking into account the relevant experience gained and a direct reference to the specific measures taken to prevent such accidents. ';
21. In Annex 5, Part VI, the following point 5.2 is inserted after point 5.1:
"5.2. A description of the operator's progress, if necessary, to inform the emergency services of other Member States of the European Union or of other States concerned, in the event of a major accident with possible cross-border effects. ';
Points 5.2 and 5.3 shall become paragraphs 5.3 and 5.4 respectively.
22. At the end of Annex 5, Part VIII is added:

23. In Annex 6, the following point 3 is added at the end of Part IV:
'3. List of possible necessary changes in information to the public pursuant to Decree No. 228 / 2015 Coll. '.
24. Annex 9 shall read:
"Annex No 9 to Decree No. 227 / 2015 Coll.
Details of the content of the supporting documents for the establishment of the emergency planning zone and the processing of the external emergency plan, their structure and content of their individual chapters
1. Identifying information about operator and object:
(a) the name and address of the operator, tel. / fax / e-mail, ICO or other unique identifier, if assigned;
(b) the name and address of the object, the geographical coordinates of the object (defining point of the building building building according to the basic register of territorial identification, addresses and real estate 7),
(c) the name and, where appropriate, the name, surname and address of the natural person authorised to act as operator;
(d) an indication of the name and, where appropriate, the names, surname and functional classification of natural persons who are to be authorised by the operator to implement the preventive safety measures referred to in the internal emergency plan and who are authorised to communicate with the regional authority and the operational and information centre of the integrated rescue system, the components of the integrated rescue system or other emergency services.
2. Information about the object:
(a) a description of the main production activities;
(b) a description of the main technological processes;
(c) a schematic representation of the main production parts;
(d) a schematic representation of the interaction between the main technological parts, including an indication of whether there is sufficient physical or effective separation between storage tanks of dangerous substances if the technological part of the storage tanks;
(e) a list of external bodies within the facility.
3. Description of the major accident scenarios that may arise in the object and the effects of which may occur outside the object.
3.1. List of hazardous substances as defined in Table 1 and their quantities by their chemical or commercial names, including their classification and dangerous properties as specified in the proposal for classification
(a) located in the building,
(b) arising during the course of the activity;
(c) arising from interaction with other substances and mixtures in the event of a major accident.
3.2. Risk of major accident and description of scenarios including domino effects, the effects of which may occur outside the object:
(a) an overview of the major accident scenarios and the recommended scenarios with the greatest surface impact of the major accident beyond the building boundaries for setting the emergency planning zone;
(b) places where a major accident is likely to occur, such as warehouses, stalls, storage tanks, piping bridges, technological units, including graphical identification of identified sources of serious accident risk;
(c) a description of the scenarios foreseen for the major accident, including a possible domino effect.
4. An overview of the possible effects of a major accident on the lives and health of humans and animals, the environment and property, including ways of effectively protecting against these consequences for scenarios with off-site major accident effects and their schematic representation.
4.1. Information on possible consequences of a major accident for scenarios with off-site major accident effects:
(a) a description of the expected damage to the buildings, including the determination of the extent of the damage, resulting from the models used in assessing the consequences for each major accident scenario;
(b) a description of the expected loss of life or damage to the health of persons resulting from:
dispersion studies and other models, including the indication of expected hazardous concentrations and the determination of their range of effects;
(c) the expected environmental effects of the major accident, including an estimate of their extent and spread.
4.2. Means of protection against the potential effects of a major accident in relation
(a) to damage structures, including the effect of radiant heat in fire, the blast pressure wave, including the effect of flying debris;
(b) loss of life or damage to the health of persons at different concentrations of hazardous substances spread in the air in relation to the effect of radiant heat and toxic flame-retardants after fire or the effect of a blast pressure wave, including the effect of flying debris;
(c) immediate, medium- and long-term damage to the environmental components;
(d) the death of animals or their health.
5. Overview of preventive safety measures to mitigate the effects of a major accident
5.1. An overview of the preventive safety measures taken by the operator to mitigate the effects of a major accident outside the premises before establishing cooperation with the components of the integrated rescue system intended to carry out rescue and disposal operations in the event of a major accident:
(a) a description of the safety features affecting the identified and analysed emergency scenarios referred to in point 3.2 which prevent the occurrence of an accident, an emergency leak or reduce the amount of hazardous substance escaped or the extent of the emergency speech, irrespective of the action of the human factor. ';
(b) the operator's progress in the event of a major accident leading to a limitation of its effects in the vicinity of the object where the impact of the major accident is assumed;
(c) an overview of the components of the integrated rescue system with which the operator plans to cooperate in its emergency documentation and the procedure for limiting the effects of a major accident under other legislation6).
5.2. Information on how people are informed, warned and kept informed in and out of the building in the event of a major accident:
(a) the operator's process of activating the alert systems and providing further instructions and information;
(b) the operator's procedure, if necessary, to inform the emergency services of other Member States of the European Union or of other States concerned, in the event of a major accident with possible cross-border effects;
(c) means of communication and warning (sirens and visual devices, radio, telephone and other media or systems), including, in particular, indication of the type of sirens, alternative radio frequencies or special telephone numbers;
(d) a system of warning signals (sound, visual, other) and means and means of continuous information to persons;
(e) other means of information which are ready to inform persons in view of the potential congestion of the operator's communication networks (e.g. ready-to-use radio and television broadcasts).
5.3. A description of the desired behaviour of the persons at risk in the event of a major accident in accordance with the scenarios considered and the necessary information provided to the persons at risk.
6. List and description of the technical means of the operator available to deal with the consequences of the major accident.
7. Information to be used by the operator to process and update the plans for specific activities of the external emergency plan, to inform the public and public authorities of the potential risks and effects of threats beyond the building borders, and information on the effective way of protecting persons after a major accident:
(a) identification of entry and exit points to the operator's premises, planned evacuation areas and escape routes from the facility, including identification of the evacuation route;
(b) the planned interaction of the operator with the components of the integrated rescue system in the organisation of the evacuation, the number and registration system of staff and other persons intended for evacuation, including a description of the system of mass and spontaneous evacuation of persons from the building after a major accident has occurred;
(c) planned monitoring of the leakage of dangerous substances into the air, water and soil or monitoring of the effects of explosion and fire by the operator at the border and beyond the boundaries of the facility and the way in which data are transmitted to the components of the integrated rescue system and public authorities;
(d) the planned forces and means of the operator used to deploy and carry out the tasks of removing the effects of a major accident beyond the object's borders;
(e) the operator's organisational, technical or other measures which may prevent or restrict the possibility of a dominant effect following a major accident;
(f) recommended schemes for the protection of the health of persons and the method of protecting the population following a major accident;
(g) the forms, methods and procedures of the operator in providing information to legal and business natural persons in the vicinity of the object on the nature of the potential threat and on the measures prepared in the object on the communication in the context of preventive training activities, including the identification of the operator's persons responsible for communication with the public and mass information means;
(h) the forms, methods and procedures of the operator in providing information to the public and mass information on the actual threat and the measures subsequently taken to protect persons in and outside the premises in the event of an imminent major accident, including the identification of the operator's persons responsible for communication with the public and the mass information means;
(i) the method of management of the waste arising from a major accident and the identification of the person responsible for the disposal and disposal of the waste generated in the premises.
8. Other necessary data requested by the Regional Authority and the Fire Department of the Region.

Transitional provisions
1. The security programme approved under Section 10 (5) of the Act before the date of entry into force of this Decree must be aligned by the operator with Decree No. 227 / 2015 Coll., as effective from the date of entry into force of this Decree, at the latest on the first update of the security programme under Section 11 (2) or Section 14 (2) of the Act, which the operator of the building will be obliged to provide and submit to the Regional Authority for approval after the date of entry into force of the Decree.
2. The safety report approved under Section 12 (5) of the Act before the date of entry into force of this Decree must be brought into conformity by the operator with Decree No. 227 / 2015 Coll., as effective from the date of entry into force of this Decree, at the latest on the first update of the safety report under Section 14 (2) or (3) of the Act, which the operator of the building will be obliged to provide and submit to the Regional Authority for approval after the date of entry into force of the Decree.
3. The internal emergency plan submitted to the Regional Authority and to the Fire Safety Corps of the Region pursuant to Article 23 (6) of the Act before the date of entry into force of this Decree must be brought into line by the operator in accordance with Decree No. 227 / 2015 Coll., as effective from the date of entry into force of this Decree, at the latest on the first update of the internal emergency plan under Section 25 (2) of the Act, which the operator of the building will be obliged to ensure and submit to the Regional Authority for registration and storage and to the Fire Department after the date of entry into force of the Decree.
Efficacy
This Decree shall take effect on the 15th day following its publication.
