of 19 May 2006
laying down the model forms and languages of the Member States of the European Union used in cross-border cases to provide financial assistance to victims of crime
According to Section 14f of Act No. 209 / 1997 Coll., on the provision of financial assistance to victims of crime and on the amendment and addition of certain laws, as amended by Act No. 204 / 2006 Coll., hereinafter referred to as "the Act ':
§ 1
This decree implements the relevant provisions of the European Community1) and provides for forms for the provision of assistance to victims of crime in cross-border cases, for the transmission of requests for assistance and for the transmission of decisions in such cases. It specifies which languages other than the official languages of the Member States of the European Union may be used in the application of applications for assistance.
§ 2
(1) The model form of the Czech Republic for the application for assistance in cross-border cases is set out in Annex 1. The model form of the Czech Republic in English is set out in Annex No 1a, the model form of the Czech Republic in Slovak is set out in Annex No 1b.
(2) Models of forms of other EU States are available at the Ministry of Justice.
§ 3
The model form for the transmission of requests for assistance in cross-border cases is set out in Annex 2.
§ 4
The model form for the transmission of decisions on claims for compensation in cross-border cases is set out in Annex 3.
§ 5
Other than the official languages in which the Member States of the European Union accept requests for assistance and their annexes pursuant to § 14c (1) (g) of the Act, additional information and a list of all documents referred to in § 14c (1) (f) of the Act, requests for additional information pursuant to § 14d (1) (b) of the Act and information pursuant to § 14d (2) of the Act are listed in Annex 4.
§ 6
In cross-border cases, the Ministry of Justice accepts requests for assistance and annexes pursuant to § 14d (1) (a) of the Act and additional information or a list of all documents referred to in § 14d (1) (c) of the Act in the Czech, Slovak and English languages.
§ 7
The Ministry of Justice shall publish the forms in Annexes 1 to 4, as well as the models of the forms of the other European Union States for applying for assistance in cross-border cases in a manner that allows remote access and makes the content of the forms available without charging.
§ 8
This Decree shall take effect on 1 July 2006.
