GOVERNMENT REGULATION
of 18 January 2021
on the manner and extent of the declaration of the acquisition or transfer of ownership of a C-I weapon and the keeping of records of such weapons by the holder of an arms licence
The Government orders the implementation of § 14a (6) of Act No. 119 / 2002 Coll., on Firearms and Ammo (Act on Weapons), as amended by Act No. 13 / 2021 Coll.:
Subject matter
This Regulation provides for:
(a) the manner and extent of the notification of the acquisition or transfer of ownership to a weapon of category C-I;
(b) keeping a register of arms of category C-I which are the subject of the business of an entrepreneur, in relation to an arms and ammunition entrepreneur; and
(c) a model form for the declaration of acquisition or transfer of ownership to a category C-I weapon.
Announcement of acquisition or transfer of ownership to a C-I weapon
(1) The declaration of acquisition or transfer of ownership to a C-I weapon shall indicate:
(a) for a person acquiring ownership, personal data of a natural person or data identifying a legal person;
(b) for a person transferring ownership, personal data of a natural person or data identifying a legal person;
(c) details of the weapon;
(d) the date of acquisition or transfer; and
(e) a communication to the Reporting Financial Institution by means of a postal service provider or electronically, with a guaranteed identity, whether it requires the transmission of a C- I arms checklist to its person in the Central Arms Register, taking into account the notification concerned, to its data box or to its e-mail address provided by the Central Arms Register administrator.
(2) The model form for the declaration of acquisition or transfer of ownership to a C-I weapon by the holder of a C-I weapon is set out in the Annex to this Regulation.
Keeping a C-I weapons register by a licence holder in the Central Arms Register
(1) The prescribed electronic forms by which holders of arms licences and their authorised persons record in the Central Arms Register any change in the status of a C-I weapon shall consist of a set of web forms for manual entry and editing of records. Set of web forms are part of the weapons register.
(2) The individual access data by which the holder of the arms licence or the authorised person enters the Central Arms Register are a certificate issued by a qualified trust service provider, a username and a password. The individual access data shall include the security code (PUK) used by the authorised person to prove his identity in case of a forgotten password. The Central Arms Register administrator may also allow access to the Central Arms Register by means of a guaranteed identity access using an identity card with machine-readable data and a contact electronic chip or other electronic identification device, as appropriate.
(3) The weapons register allows for the search of a weapon of category C-I according to the criteria set, the transfer of a weapon of category C-I from the weapons register, the taking-over of a weapon of category C-I to the weapon of category C-I, the insertion of data on the weapon produced and imported in the Czech Republic, the modification and repair of the weapon of category C-I, the degradation of the weapon of category C-I or the production of a weapon of category C-I. The registration book also allows editing of a category C-I weapon record.
Efficacy
This Regulation shall enter into force on 30 January 2021.
