amending Decree No. 416 / 2004 Coll., implementing Act No. 320 / 2001 Coll., on Financial Control in Public Administration and amending certain laws (Financial Control Act), as amended by Act No. 309 / 2002 Coll., Act No. 320 / 2002 Coll. and Act No. 123 / 2003 Coll., as amended by Decree No. 274 / 2018 Coll.
The Ministry of Finance provides pursuant to Section 33 of Act No. 320 / 2001 Coll., on Financial Control in Public Administration and on the amendment of certain laws (Act on Financial Control):
Decree No. 416 / 2004 Coll., implementing Act No. 320 / 2001 Coll., on Financial Control in Public Administration and amending certain laws (Financial Control Act), as amended by Act No. 309 / 2002 Coll., Act No. 320 / 2002 Coll. and Act No. 123 / 2003 Coll., as amended by Decree No. 274 / 2018 Coll., is amended as follows:

(1) Approval procedures for managing controls may be carried out in electronic form.
(2) When using electronic means in the approval procedures governing the control, the signature of mandatory persons may not comply with the conditions laid down in the Trust Services Act for electronic transactions. When using the information system in the management control approval procedures, the signature of the mandatory persons may replace the unchanged record in the information system. ';
footnote 6 is deleted.
2. In Article 32 (2), the words "The administrator of the State Budget Chapter, the Region and the City of Prague shall submit a report pursuant to Article 22 (2) of the Act 'are replaced by the words" The public administration shall submit a report'.
3. Paragraph 32 (3) is deleted.
Paragraph 4 shall become paragraph 3.
4. In Article 32 (3), the text "Paragraph 22 (6) 'is replaced by" Paragraph 22 (5)'.
5. in Article 33 (1) (c), the words "and Article 9 (1) 'are replaced by the words", Article 9 (1) and Article 9a (1)';
6. in Article 33 (1) (d), the text "and Article 9 (1)" is replaced by the text ";
7. in § 33 (2) (e), the text "and § 9 (2)" shall be replaced by "§ 9 (2) and § 9a (2)."
8. in Article 33 (2) (f), the text "and Article 9 (2)" is replaced by the text ";
9. In Paragraph 33, the following paragraph 5 is inserted after paragraph 4:
"(5) The information on the serious findings of the checks carried out pursuant to Article 32 (3) shall contain a brief description of the findings."
Paragraph 5 shall become paragraph 6.
10. In Article 33 (6), the words "and 5 'shall be inserted after the words" paragraph 1' and the words "financial controls' shall be inserted after the words" and in information on serious findings'.
11. the following Section 33a is inserted after Section 33:
The Annual Report on the Results of Financial Checks pursuant to § 22 (1) of the Act contains at least:
(a) summary information on the results of the financial checks carried out by public authorities pursuant to Article 32;
(b) summary information on serious findings pursuant to Article 22 (5) of the Act;
(c) summary information on the results of the financial checks carried out by the Ministry of Finance;
(d) summary information on the results of the financial checks entered into the monitoring system under the Regional Development Support Act (10); and
(e) a summary of the audit findings submitted for further procedure under the Rules of Procedure (8) in the reference calendar year sent to the authorities of the Financial Administration of the Czech Republic as a suspected breach of budgetary discipline. "
Efficacy
This decree shall take effect on the day of its publication.
