Regulation of the Minister for Health
of 7 May 1954
on sanitary and anti-epidemic air protection.
The Ministry of Health hereby orders, pursuant to Section 15 of Act No. 4 / 1952 Coll., on Sanitary and Anti-Epidemic Care:
Air protection task.
The objective of hygienic and anti-epidemic air protection ("air protection ') is to ensure that air is not contaminated by harmful substances, as well as to monitor the implementation of the necessary measures and monitor their effectiveness.
Essential air quality requirements.
(1) The air in the working and environment of humans must comply with the essential hygiene requirements laid down by the main hygienist and must be protected against excessive pollution in particular by dust, soot, ash, smoke, gases, vapour and odours.
(2) Anyone who establishes or operates any installation which may adversely affect the quality of the air and who is responsible for the quality of the air in the working environment of people must take all measures necessary to protect the air, in particular those provided for in other provisions of this Regulation, to meet these requirements. These measures shall be implemented to protect the air, in particular in housing, plant, health and education facilities, spa, climatic and recreational areas and in the areas of forests, parks and gardens.
Air protection measures.
In particular, the following measures shall be implemented to protect air:
(a) the method of building the settlements must be defined in such a way as to allow them to be properly ventilated;
(b) construction and demolition of buildings, landscaping, cleaning of public spaces and removal of waste shall be carried out without dust as far as possible;
(c) the type of heat and propulsion energy must be selected and its use adjusted to avoid excessive smoke in the air or as ash pollution;
(d) the extent and location of green areas must be determined in such a way that there is an open area in residential, working and recreational areas with crops which allow air cleaning and regeneration;
(e) communication must be conducted and the types of means of transport and roads must be chosen and adapted so as to minimise the risk to the health of the air;
(f) landfills of solid waste and raw materials and effluents and tanks and sewage treatment plants must be located and secured in such a way as to avoid air pollution;
(g) the operation of the plants must be ensured in such a way as to avoid excessive air pollution;
(h) all sources of air pollution must be phased out in spa, climatic and recreational places and around medical and educational facilities and these areas must be secured before new such sources are created;
(ch) in the areas of forests, parks and gardens, measures must be taken to ensure that they are not damaged by contaminated air and ensure that their positive effect on the air remains fully affected.
(1) Sanitary protection zones are established around the plants and installations that cause air pollution and around the buildings and places whose air is to be protected.
(2) Where such zones need to be established, as well as their width and the manner in which they are adapted and used, the authorities shall establish hygienic and anti-epidemic services according to the nature of the object causing air pollution or the object to be protected by that zone and to the nature of the surroundings and local circumstances.
Measures shall be taken in enclosed spaces intended for housing, work, transport, assembly and purposes of education, health and recreation to allow for proper air exchange either by natural or artificial ventilation, after treatment, and to protect it from excessive pollution.
Provisions common, transitional and final.
(1) Sanitary and anti-epidemic services ensure compliance with all air protection measures and monitor their effectiveness by regular checks, in particular by physical, chemical and biological analyses.
(2) Sanitary and anti-epidemic services determine which air protection measures are to be taken. Before that, they will undertake the necessary research, in particular a survey of climate conditions and sources of pollution.
(3) The guidelines and binding opinions of the sanitary and anti-epidemic services bodies must be required to:
(a) anyone planning and implementing the construction or modification of housing sites or the construction of plants and other objects and equipment which could adversely affect the sanitary and epidemiological state of the air or its replacement, in the selection of the site and before the approval of the investment task, as well as the initial and technical project;
(b) the competent authority before it authorises the construction or modification of the settlements or the construction or operation of establishments, buildings and other facilities.
(4) Sanitary and anti-epidemic services may only give their consent to operate when the measures and modifications they have ordered have been implemented and their effectiveness checked.
The site, plant and other objects and equipment, polluting air which, at the beginning of the application of this Regulation, are established or are already in operation, shall be gradually within the limits of the national economic development plan, as instructed by the health and anti-epidemic service authorities, equipped with appropriate facilities for the disposal, disposal or use of air pollutants, after the manner in which they are operated and used, so as to bring them as close as possible to the requirements laid down in this Regulation.
This Regulation shall enter into force on the day of its publication.
