DECLARATION
of 18 July 2023
amending Decree No. 48 / 2005 Coll., on basic education and certain formalities for compulsory education, as amended
The Ministry of Education, Youth and Sports provides, pursuant to § 38 (8) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 472 / 2011 Coll. and Act No. 82 / 2015 Coll.:
Decree No. 48 / 2005 Coll., on primary education and certain formalities for compulsory education, as amended by Decree No. 454 / 2006 Coll., Decree No. 256 / 2012 Coll., Decree No. 197 / 2016 Coll., Decree No. 243 / 2017 Coll., Decree No. 140 / 2018 Coll., Decree No. 196 / 2019 Coll., Decree No. 271 / 2021 Coll., Decree No. 250 / 2022 Coll., and Decree No. 435 / 2022 Coll., are amended as follows:
1. In Paragraph 18 (2), the sentence "If the pupil's evaluation is made in Slovak, translation into the Czech language is not required."
2. In Paragraph 18 (3), the sentence "If the proof of compulsory education is produced in the Slovak language, translation into the Czech language is not required."
3. In Paragraph 18, the following paragraphs 5 and 6 are inserted after paragraph 4:
"(5) The student who passed the examinations referred to in paragraph 1 shall be registered in the relevant year and class according to the results of the examinations at the school during the course of compulsory schooling in a school outside the Czech Republic. In the school year in which the pupil does not take examinations, he is registered according to his age.
(6) A student who has not passed the examinations referred to in paragraph 1 shall be registered in the relevant year and class according to his age at the primary school during the course of compulsory schooling in a school outside the Czech Republic. "
Paragraphs 5 and 6 shall become paragraphs 7 and 8.
4. In Article 18a, the following paragraphs 3 and 4 are inserted after paragraph 2:
"(3) A pupil who has passed the examinations referred to in paragraph 1 shall be registered in the same year and class as the results of the examinations in the course of compulsory education abroad. In the school year in which the pupil does not take examinations, he is registered according to his age.
(4) A student who has not carried out the examinations referred to in paragraph 1 shall be registered in the year and class according to his age at the primary school during the course of compulsory education abroad. "
Paragraphs 3 and 4 shall become paragraphs 5 and 6.
5. In Paragraph 18b (2), the sentence "If a pupil from a foreign school in the Czech Republic is certified in Slovak, translation into the Czech language is not required."
6. in Paragraph 18b, the following paragraph 3 is inserted after paragraph 2:
"(3) The student is registered in the relevant year and class according to the results of the examinations at the school school in the Czech Republic, according to § 38 (1) (c) of the Education Act. In the school year in which the pupil does not take examinations, he is registered according to his age. If the pupil does not pass the examination in accordance with Paragraph 18c (2), he shall be registered in the relevant year and class according to his age. ';
Paragraph 3 shall become paragraph 4.
7. in Paragraph 18d, the following paragraph 1 is added:
"(1) The student is registered in the relevant year and class according to his age at the school set up by the diplomatic mission of the Czech Republic or the consular office of the Czech Republic."
The current text becomes paragraph 2.
8. in Article 18e (1), the words "if the document is made out in Slovak, translation into the Czech language is not required" shall be added at the end of the text in point (b).
Efficacy
This Decree shall take effect on 1 September 2023.
