GOVERNMENT REGULATION
of 20 July 2016
amending Government Regulation No 197 / 2005 Coll., laying down the conditions for granting aid for the implementation of measures to improve the general conditions for the production and marketing of apiculture products, as amended
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll., Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll., Act No. 179 / 2014 Coll.:
Government Regulation No 197 / 2005 Coll., laying down the conditions for granting the subsidy for the implementation of measures to improve the general conditions for the production and marketing of apiculture products, as amended by Government Regulation No. 285 / 2007 Coll., Government Regulation No. 373 / 2010 Coll., Government Regulation No. 173 / 2011 Coll., Government Regulation No. 251 / 2013 Coll. and Government Regulation No. 400 / 2013 Coll., is amended as follows:
1. footnote 2 shall read:
"(2) Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922 / 72, (EEC) No 234 / 79, (EC) No 1037 / 2001 and (EC) No 1234 / 2007, as amended. Commission Delegated Regulation (EU) 2015 / 1366 of 11 May 2015 supplementing Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council with regard to aid in the apiculture sector. Commission Implementing Regulation (EU) 2015 / 1368 of 6 August 2015 laying down detailed rules for the application of Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council as regards aid in the apiculture sector. '
2. In Article 3 (1) of the Introductory Part of the provision, the words "civil association, 4) 'are replaced by the words" association which'.
footnote 4 is deleted.
3. In Article 3 (2), "30 June of the calendar year 'is replaced by" 1 August of the beekeeping year 12' and "calendar 'is replaced by" apiculture'.
Footnote 12 reads:
"(12) Article 2 of Commission Implementing Regulation (EU) 2015 / 1368. '
4. in Article 3 (3) (a), the word "association" shall be replaced by "association" and the words "aim of its activities" shall be replaced by "purpose of the association."
5. in Article 3 (3) (b), the words "officials authorised to act on behalf of the association" shall be replaced by the words "persons authorised to act on behalf of the association."
6. In Paragraph 3 (3) (c), the word "association 'is replaced by" association'.
7. in Article 3 (4) (a), the words "submitted to the Ministry of the Interior, including any subsequent amendments thereto," shall be deleted.
8. in Paragraph 4 (1) (a), the words "in civil society" shall be replaced by the words "in society."
9. in Paragraph 4 (1), (2) and (4), at the end of point (e), the comma shall be replaced by a dot and point (f) shall be deleted;
10. in Article 4 (2) (d) and Article 6 (2) (b), the words "bee breeders" shall be inserted after the words "commitment."
11. in Articles 4 (4) (a) to (e), 5 (3), 6 (3), 7 (2) (a), 7 (3) and 8 (3), "31 August of the relevant calendar year" shall be replaced by "31 July in the relevant apiculture year."
12. in Article 4 (4) (a), (c) and (e), the words "calendar year" shall be replaced by the words "apiculture year"; the words "civil association" shall be replaced by the words "group" and the words "calendar year" shall be replaced by "apiculture year";
13. in Article 6 (1), the words "outside a permanent post" shall be inserted after the words "for the diving of hives."
14. in Article 6 (2) (a), the words "and whose minimum number of weaning hives is 20" shall be replaced by the words "outside the permanent post and whose minimum number of hives registered under the special legislature3) on 1 September in the relevant apiculture year is 20."
15. in Article 6 (3), "calendar" is replaced by "apiculture."
16. The heading of Section 8 reads: "Restoration of hives."
17. In Article 8, the words "bee breeders in the Czech Republic" shall be added at the end of the text of paragraph 3.
18.Paragraph 10 (1) reads as follows:
"(1) The amount of the subsidy for the measure referred to in Article 4 shall not exceed:
(a) CZK 6,000 for the organisation of a maximum of one practical course for bee breeders according to § 4 (1) (a) in one day in one place, even if more than one practical course is organised in one day in one place,
b) CZK 6,000 for the organisation of not more than one seminar pursuant to § 4 (1) (b) in one day in one place, even if several seminars are held in one day in one place,
c) CZK 3,000 for holding a maximum of one lecture for bee breeders pursuant to § 4 (1) (c) in one place and on one day, even if more lectures are held in one day in one place,
(d) the actual costs incurred for each installation referred to in Article 4 (1) (d) not exceeding the amount referred to in Part A of Annex 2 to this Regulation and for all installations not exceeding CZK 100,000; or
(e) 15 000 CZK for the relevant apiculture year for the management of a single apiculture ring according to § 4 (1) (e), but not more than 2 apiculture rings led by one apiculture ring leader. "
19. Paragraph 10 (3) reads:
"(3) The amount of the subsidy for the measure referred to in Article 6 shall be the actual cost of the individual installation referred to in Article 6 (1), not exceeding the amount referred to in Part D of Annex 2 to this Regulation and not exceeding CZK 150 000 for all installations."
20. in Paragraph 10 (5), "300" is replaced by "200."
21. in Paragraph 10 (6), the words "paragraphs 2 and 4" shall be replaced by "paragraphs 1 (e), 2, 4 and 5" and "paragraphs 1, 3 and 5" shall be replaced by "paragraphs 1 (a) to (d) and 3."
22. In Article 10, the following paragraph 7 is added:
"(7) If the total of all eligible entitlements referred to in paragraphs 1 to 5 does not reach the financial amount declared in accordance with paragraph 9 and adjusted in accordance with paragraph 14, the Fund shall increase the remaining funds for the payment of the subsidies referred to in paragraph 5 in a proportionate manner. ';

5. FORMIDOL 41 g (hive boards).

7. APIGUARD A.U.V. (gel).
8. THYMOVAR, 15 g (hive strips).
9. BEE SAFE.
10. Other means of application decided by the authority responsible for veterinary care. "

Transitional provisions
1. Proceedings for applications for grants initiated pursuant to Government Regulation No 197 / 2005 Coll., as effective before the date of entry into force of this Regulation, and which were not definitively completed before the date of entry into force of this Regulation shall be completed in accordance with Government Regulation No 197 / 2005 Coll., as effective before the date of entry into force of this Regulation.
2. The application for a subsidy pursuant to Article 3 of Decree No 197 / 2005 Coll., as effective from the date of entry into force of this Regulation, for the apiculture year 2016 / 2017 shall be submitted by the applicant to the State Agricultural Intervention Fund by 31 August 2016.
Efficacy
This Regulation shall enter into force on 1 August 2016.
