amending and supplementing Decree No. 104 / 1964 Coll., implementing the Law on the security of cooperative peasants in sickness and on the security of the mother and child
The Federal Ministry of Labour and Social Affairs shall, in agreement with the Federal Ministry of Agriculture and Nutrition, the Union of Cooperative Farmers and the Central Council of Trade Unions pursuant to Section 144 of Act No. 103 / 1964 Coll., on the Security of Cooperative Farmers in the Disease and on the Security of Mother and Child, as amended by Act No. 116 / 1967 Coll., on certain other changes in social security of Cooperative Farmers, and Act No. 103 / 1988 Coll., on the Changes in Disease Security:
Decree of the State Social Security Office No. 104 / 1964 Coll., implementing the Act on the Protection of Cooperative Farmers in Disease and Security of Mother and Child, as amended by Decree No. 142 / 1965 Coll., No. 117 / 1967 Coll., No. 92 / 1968 Coll., No. 180 / 1968 Coll., No. 76 / 1970 Coll., No. 128 / 1975 Coll., No. 54 / 1976 Coll., No. 164 / 1979 Coll., No. 80 / 1982 Coll., No. 153 / 1983 Coll., No. 74 / 1984 Coll., No. 133 / 1984 Coll., No. 58 / 1987 Coll., No. 150 / 1988 Coll., is amended as follows:
1. Paragraph 1a (2) (d) and (e) shall read as follows:
"(d) annual remuneration (annual premium) to managers provided under generally binding provisions on remuneration or intra-cooperative provisions on remuneration and on the material participation of managers, provided that their amount is not fixed at a percentage of the basic remuneration achieved for the calendar year;
(e) stabilisation and recruitment fees (contributions), ';
2. the following point (j) is added at the end of Paragraph 1a (2):
"(j) wage compensation and other cash benefits provided for the release and transfer of workers into mining or for the implementation of rationalisation and organisational measures.";
3. In Article 2, the following paragraph 5 is inserted after paragraph 4:
"(5) If a member of the cooperative has ceased work and has restarted work on the next subsequent working day, the relevant period shall be considered as if the previous work still existed. '
Paragraphs 5 to 10 shall be renumbered paragraphs 6 to 11.
4. In Paragraph 2 (9), "paragraph 5 'is replaced by" paragraph 6';
5. Article 2 (10) reads as follows:
"(10) Likely deductible income shall be collected if the incapacity for work has already occurred in the calendar month in which the member of the cooperative entered the cooperative or in which the case referred to in Paragraph 2 (6) occurred at the date of the incapacity. Where an incapacity for work was first established in the next settlement period, the likely deductible revenue shall be collected for the period up to the end of the accounting period preceding the date of the incapacity for work. ';
6. the following paragraph 12 is added to Article 2:
"(12) Once the likely deductible income is determined in the manner set out in the preceding paragraphs, it shall be used until a member of the cooperative has completed the number of days referred to in Paragraph 2 (3) within the relevant period, unless there is a permanent change in basic remuneration, cases considered as joining the cooperative or a change in working time. In cases where, due to the length of the period for which certain other components of income are provided in the cooperative, the deductible income determined after the processing of the number of days referred to in Paragraph 2 (3) is less than the likely deductible income previously determined under the preceding paragraphs, the likely deductible income shall be used until the end of the calendar year; This is without prejudice to the provisions of paragraphs 6 and 7 of Section 2. ';
7. In Article 12 (3), "Article 2 (8) 'is replaced by" Article 2 (9)'.
8. In Article 16 (1) (b), the word "three 'is replaced by the word" six'.
This Decree shall take effect on 1 January 1989.
