DECLARATION
of 4 July 2023
amending Decree No. 23 / 2008 Coll., on technical conditions for fire protection of buildings, as amended by Decree No. 268 / 2011 Coll.
The Ministry of the Interior provides pursuant to § 24 (3) of Act No. 133 / 1985 Coll., on Fire Protection, as amended by Act No. 186 / 2006 Coll.:
Decree No. 23 / 2008 Coll., on technical conditions for fire protection of buildings, as amended by Decree No. 268 / 2011 Coll., is amended as follows:
1. Paragraph 1 (2) reads as follows:
"(2) This Decree has been notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services. '.
2. Paragraph 18 (2) is deleted.
Paragraphs 3 to 6 shall become paragraphs 2 to 5.
3. Article 23, including the title and footnotes Nos 9 and 10, reads:
Construction or part thereof intended for the activities of a school, school establishment or pre-school care
(1) When designing a building or part of it intended to operate a school, a school establishment or to provide regular, long-term and recurrent childcare before commencing their compulsory schools9), the Czech technical standard referred to in Part 1 (1) of Annex 1 to this Regulation shall be followed, unless otherwise specified.
(2) Each nursery class must form a separate fire station.
(3) The grade of the parent school shall not be located on a higher level than the second above or on the ground floor, provided that there is no escape exit directly to the open area.
(4) In the construction of a kindergarten, primary school, primary or secondary school intended for pupils or children with disabilities and in the construction where the premises are intended for the provision of a childcare service in a children's group, the door shall not be used on the escape route by rocking or tourniquet doors.
(5) The construction of a school establishment intended for accommodation (10) or the space intended for accommodation in a school establishment must comply with the conditions set out in Sections 17 and 17a.
9) For example, Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended, Act No. 247 / 2014 Coll., on the provision of childcare services in the children's group and on the amendment of related laws, as amended, Act No. 455 / 1991 Coll., on business, as amended.

4. The following Section 23a is inserted after Section 23:
Fire protection requirements for the use of the area where the childcare service is provided in the child group
(1) The area in which the child care service is provided in the child group, with the exception of sanitary facilities, and the subsequent unprotected escape route shall be equipped with an autonomous detection and signalling device or an equally effective device.
(2) The space in which a child care service is provided in a child group must be equipped with at least 1 portable fire extinguisher with a fire extinguisher capability of at least 21A.
(3) The space in which the childcare service in the child group is provided must consist of a separate fire compartment or be separated from another building space by a fire separation structure with a fire resistance of at least 30 minutes. Only one childcare service in the children's group may be provided in the first sentence.
(4) One or more childcare services in the children's group may be provided in the area of the fire compartment of the apartment if their total capacity does not exceed 12 children.
(5) The area in which the childcare service is provided in the child group must not be on a higher level than the second deck or on the ground floor, unless it leads the exit directly to the open area.
(6) From the area in which the childcare service is provided in a child group with a capacity exceeding 12 children, at least 2 escape routes shall be provided from the fire compartment.
(7) The unprotected escape route from the area where the childcare service in the child group is provided shall meet the limit length which shall be:
(a) 25 m, in the case of a single escape route,
(b) 40 m, in the case of an area from which there are several escape routes.
(8) For the area in which the childcare service is provided in a child group,
(a) the construction products of the reaction-to-fire class B-s1-d0 shall be used for surface treatment of the ceiling and ceiling,
(b) the construction products of the reaction-to-fire class at least D-s1-d0 shall be used for surface wall finishing; and
(c) floor coverings comply with a reaction to fire class of at least CFL-s1.
(9) Paragraphs 3 to 8 shall not apply where 1 or more childcare services in a child group with a total capacity of not more than 6 children are provided in the construction. ';
Transitional provision
In the case of a building or part thereof intended for the activity of a school, a school establishment or for the provision of pre-school care started before the date of application of this decree, compliance with the technical conditions of fire protection shall be assessed in accordance with Decree No. 23 / 2008 Coll., as effective before the date of entry into force of this decree. The requirements for the use of the construction pursuant to Section 23a of Decree No. 23 / 2008 Coll., as effective from the date of its effectiveness, are not affected.
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Decree shall take effect on 1 August 2023, with the exception of Article I (4), which shall take effect on 1 January 2026.
