of 17 August 2007
amending Decree No 384 / 2006 Coll., laying down details on the placing into circulation of seeds and propagating plants
The Ministry of Agriculture provides pursuant to Sections 3 (8) and 7 (6) of Act No. 219 / 2003 Coll., on the putting into circulation of seeds and propagating plants and amending certain laws (Act on the circulation of seeds and seed), as amended by Act No. 178 / 2006 Coll.:
Decree No 384 / 2006 Coll., laying down the details of the putting into circulation of seed and planting plants, shall be amended as follows:
1. The words "Commission Directive 2006 / 124 / EC of 5 December 2006 amending Council Directive 92 / 33 / EEC on the marketing of vegetable propagating and planting material other than seed and Council Directive 2002 / 55 / EC on the marketing of vegetable seed shall be added to footnote 2. ';
2. Annex 8, including the title, reads:

Other requirements:
- each propagation crop of vegetables and root plants is separated from neighbouring crops by a gap of at least 1 m wide throughout the growing season,
- the plants from which isolation is determined may occur occasionally from half the distances listed in Table 3.2.1,
- there must be no weeds in vegetable and root plants from which Table 3.2.1 sets the isolation distance to avoid unwanted pollination,
- isolation distances may be replaced by technical insulation sufficiently preventing pollen transmission.

Purity of species and purity of variety
1) The crop must have sufficient varietal purity and authenticity.
2) The occurrence of harmful organisms subsequently reducing seed value must be as low as possible.
Requirements for the characteristics of seed crops for species included in the schemes of the Organisation for Economic Cooperation and Development for certification of seed in international trade:
- The planting ground shall be free of all wild plants which could cause foreign dusting or contaminate propagated seed:
diseases, communicable seeds; or
With its seeds, hard to remove from the seed.
- The transfer of soil pathogens to harvested seed must be avoided.
- The growing crop must be overlooked at least once at the appropriate stage or stages of development.
- Requirements for isolation distances - minimum distances from all sources of undesirable pollen and diseases communicable with seeds (including viral diseases communicable with seeds and wild plants which may be a source of diseases):

1) These distances need not be respected if there is sufficient protection against unwanted extraneous spraying and the transmission of diseases communicable with seeds.
(2) The distances referred to shall apply to other propagation crops and to normal growing crops flowering at the same time as the observed crop.
- Certification is subject to checking of species and variety identity and purity by the entry and exit vegetation test.
- The crop must have the required varietal identity and varietal purity.
- The seed used for propagation must be free from pests and diseases as far as possible. The seed health is checked before sowing and, if necessary, the seed is soaked.
- The occurrence of diseases communicable with seeds must be as low as possible.

*) Species not listed in the species list, recognition procedures can only be carried out for registered varieties.
(1) In the case of species with hybrid varieties, the flexibility (min. 95%) shall be determined by post-harvest checks carried out prior to seed certification using internationally agreed seed hybrid tests.
2) Moisture of vegetables is determined only on request.
3) Average number of sprouts per 100 fruits.
4) In brackets are given the masses according to ISTA Rules if they are different from the EC weights.
5) The seed must correspond with its appearance to purified seed.
Other requirements:
- varietal purity and authenticity for categories of certified propagating material and standard seed is subsequently checked in vegetative tests,
- the limit values for harmful organisms are given in Table 5.3.

- designation of the Constitution and the Czech Republic or abbreviation thereof
- the designation "EC rules and standards"
- name of species
- variety denomination
- the designation of the category "pre-stage propagating material" or "breeding material"
- generations after breeding material
- lot number
- the weight or number of seeds in a single package, where granulated plant protection products, packaging substances or other solid ingredients have been used, the type and indicative ratio between the weight of pure seed and the total weight of the seed,
- month and year of the last official sampling for the purposes of certification, expressed as: "sampled... (month and year)"
- indication of the country of production
- label number
- in the case of a natural person, the name, surname or business name, place of permanent residence and place of business of the supplier, if different from the place of permanent residence; in the case of a legal person, a business firm and a registered office
- where applicable, the type of chemical treatment and the preparation used, if the chemical treatment has been carried out
- where appropriate, the designation "genetically modified organism" in the case of a genetically modified variety,
The official label of vegetable seed category basic propagating material or certified propagating material shall include the following:
- designation of the Constitution and the Czech Republic or abbreviation thereof
- the designation "EC rules and standards"
- name of species
- variety denomination
- for hybrid varieties or inbred lines:
- for basic seed in which the hybrid or inbred line to which the basic seed belongs are entered in the common catalogue:
the name of the component under which it was officially authorised, with or without reference to the resulting variety, supplemented by the word "component 'in the case of a hybrid or a propagation line intended solely for use as components for the resulting varieties,
- for basic seed in other cases:
the name of the component to which the basic seed belongs and which may be indicated by a code, with reference to the resulting variety, indicating its function (paternity or maternity component) or without it, followed by the word "component ',
- for certified seed:
the name of the variety to which the seed belongs, supplemented by the word "hybrid"
- category
- lot number
- the weight or number of seeds in a single package, where granulated plant protection products, packaging substances or other solid ingredients have been used, the type and indicative ratio between the weight of pure seed and the total weight of the seed,

- marketing year of closure or last germination test, the end of the marketing year may be indicated

- lot number
- the weight or number of seeds in a single package, where granulated plant protection products, packaging substances or other solid ingredients have been used, the type and indicative ratio between the weight of pure seed and the total weight, except for small packages of up to 500 grams

Efficacy
This decree shall take effect on the day of its publication.
