DECLARATION
of 31 January 2007
on the details of the definition of water works registered in the Czech Real Estate Register
The Ministry of Agriculture, in an agreement with the Czech Office of Geographic and Catastral, provides for the Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll.:
§ 1
Subject matter
This decree provides for a more detailed definition of water works connected with the country with a solid basis, registered in the Czech Real Estate Register, which are dams, dams, hedges, structures for navigation purposes set up in watercourses or on their shores, structures for the use of water energy and the construction of drains.
Details of the definition of water works for registration in the Czech Real Estate Register
§ 2
The Czech Real Estate Register records
(a) a dam such as a watercourse or valley dam, consisting of a dam dam, including functional equipment which serves for the continuous sifting and accumulation of surface water in the water tank to control the drainage of surface water;
(b) a barrier as a building, including functional devices which:
1. crosses the water flow or the valley and serves for continuous or occasional sifting or accumulation of surface water;
2. to protect against floods, or to increase the capacity of the watercourse; or
3. They are used for reflecting water tanks,
(c) eat as a building which defends the water flow, or valleys, including functional equipment, which serves primarily to raise surface water in the holding;
(d) a construction for navigation purposes set up in or on the watercourse of the watercourse, such as a structure related to the navigation1), including functional equipment, such as a lock, a hoist, a saving chamber, a bridge, a lock tunnel, a ship's release, a lock-off facility on the navigational channels, a navigational channel, including lines or a waterside port including a swimming pool, waterfront walls and a navigational control command;
(e) a building for the use of hydroenergy as a building of a flow-through, accumulation or pumping hydropower plant, including functional equipment and related objects such as a flow-through facility, a feeder, a waste channel and a balancing chamber, in the case of an overflow hydropower plant in addition to the dam of the upper tank and an artificial tank;
(f) the construction of a draining site, such as the construction of a dam system, including a basic, increasing and dividing dam, and including functional equipment, a draining area and a sampling or discharge device which allows permanent or temporary storage of the waterproof material.
§ 3
(1) The circumference of the water work corresponds to the penetration of the outer circumference of the water work with the terrain or the vertical projection of the outer circumference of the water work on the terrain, if the vertical projection exceeds the area of the outer circumference of the water work with the terrain.
(2) If a part of the circumference of the water works cannot be determined by means of air water heating or, where appropriate, by reason of continuous spillage, the geometric and position determination of this part of the circumference of the water works shall be determined by taking over from the documentation of the actual implementation of the construction 2).
(3) If, in the cases referred to in paragraph 2, the documentation on the actual execution of the construction is not available, the simplified documentation (the construction passport), in particular the geodetic part, shall be used to determine the part of the waterworks which cannot be determined by reason of the heating of the air water or, where appropriate, by reason of continuous water spillage.
§ 4
Field marking of the waterworks
If part of the circumference of the water works in the field cannot be determined due to
(a) the impossibility of identifying part of the circumference of the waterworks with the penetration of the outer circumference of the waterworks with the terrain without the use of special technical equipment, in particular due to the lack of terrain;
(b) the inclarity of the passage of the waterworks with the terrain, in particular where the waterworks do not constitute a sharp terrain break or pass unknowingly into or through the shore of the infrastructure; or
(c) the large nature of the penetration of the waterworks with the terrain, which exceeds the criterion for distinguishing the detailed shapes of the objects displayed in the cadastral map half-book according to the legislation issued for the implementation of the cadastral law;
The provisions concerning the permanent designation of the boundaries of the land shall apply mutatis mutandis to the designation of this part of the waterworks perimeter of the land by the legislation issued for the implementation of the cadastral law.
§ 5
Efficacy
This Decree shall take effect on 1 March 2007.
