DECLARATION
Federal Ministry of Transport
of 21 February 1984
amending and supplementing Decree No 134 / 1964 Coll., on the Transport Regulations of Water Transport as amended by Decree No 31 / 1982 Coll.
The Federal Ministry of Transport shall provide for inland navigation, as amended by Act No. 126 / 1974 Coll., pursuant to § 392 (5) of the Economic Code No. 100 / 1964 Coll., in the full version of Act No. 45 / 1983 Coll. and under § 508 (1) of Civil Code No. 40 / 1964 Coll., in the complete version of the Act No. 70 / 1983 Coll.:
The Decree of the Ministry of Transport No. 134 / 1964 Coll., on the Transport Regulations of Water Transport, as amended by Decree of the Federal Ministry of Transport No. 31 / 1982 Coll., is amended as follows:
1. In Article 3, the words "to promote the most progressive mode of transport and packaging, such as the rapid repair of collection and assembly goods, containers, handling of containers, pallets and bundling, shall be inserted after the words" as economically as possible. "
Article 23 (10) reads as follows:
"(10) Unless otherwise provided for in these Regulations, or unless otherwise agreed between the shipping undertaking and the carrier, the loading or unloading of ships shall take place at any time of day or night on working days, working days and Saturdays (continuous loading and unloading). '
Article 23 (19) reads as follows:
"(19) Where the consignor has carried out the loading on the ship or the consignee of the discharge of the consignments from the ship for a period shorter than the loading or unloading period, the navigating undertaking shall:
(a) a premium of 50% of the delay in the case of foreign trade goods;
(b) a premium of 210 CZK for the transport of energy coal, if the beneficiary unloads more ships in one eight-hour shift than provided for in the operator plan for each landed ship exceeding the operator plan;
(c) a quantity of 0,50 CZK in national transport for the loading or unloading of goods by Saturday (1) and, on working days, by the consignor, where applicable, to the consignee for each loaded or unloaded tonne of goods; Bonification belongs to the assumption that
1. the vessel has been loaded in full and the consignor has submitted to the shipping undertaking all the documents to accompany the consignment and has signed the loading record within 6 hours of the following day (§ 23 (20)), or the vessel has been completely unloaded and the consignee has confirmed receipt of the consignments and signed the landing record within 6 hours of the following day (§ 23 (21));
2. the agreed (declared) daily loading or unloading standard has been met;
3. the agreed (declared) daily loading or unloading standard was met on the day preceding the Saturday or the day of work.
Condition 1 and 2 need not be met if the failure to comply with the daily loading or unloading standard has been caused by a navigational undertaking (non-arrival of the vessel, etc.).
Premiums and bonification shall not be granted if the loading of consignments on a ship or the unloading of consignments from a ship has been carried out through a cruise undertaking or its agent on behalf of the consignor or consignee. ';
This Decree shall take effect on 1 April 1984.
