DECLARATION
of 24 August 2015
on the details of the safety documentation and the extent of the information provided to processors by the assessment
According to Section 54 (1) of the Act No. 224 / 2015 Coll., on the prevention of major accidents caused by selected hazardous chemicals or chemical mixtures and amending Act No. 634 / 2004 Coll., on administrative charges, as amended, (Act on the Prevention of Major Accidents) ("the Act ') for the implementation of Sections 9 (3), 10 (6), 11 (3), 12 (6), 13 (3), 18 (5), 19 (6), 23 (8) and 27 (4) of the Act:
Subject matter
This decree implements the relevant European UnionRegulation (1) and provides for
(a) the details of the content of the risk assessment of a major accident, the extent of the risk assessment of a major accident processed for objects listed in Group A or Group B and the manner in which it is carried out;
(b) details of the content of the security programme, the security report, the assessment report and the internal emergency plan and their structure;
(c) details of the content of the alert on the security programme review carried out;
(d) the details of the content of the supporting documents for the establishment of the emergency planning zone and the processing of the external emergency plan, their structure and their manner of processing;
(e) the criteria for evaluating the draft safety documentation and the details of the content of the assessment; and
(f) the nature and range of information and documents which the processor is entitled to request for the assessment of the draft safety documentation.
Details of the content of the major accident risk assessment, scope of the risk assessment of the major accident processed for objects included in the group A or Group B and how it is implemented
(K § 9 (3) of the Act)
(1) A major accident risk assessment is carried out for:
(a) all phases of the life cycle of the building from project documentation processing to disposal;
(b) normal and exceptional operating conditions including possible failure of the human factor or potential external threat.
(2) A major accident risk assessment shall be carried out:
(a) identifying the sources of risk and selecting the sources of risk for a detailed risk analysis to determine the extent to which individual sources of risk contribute to the overall risk of the analysed object;
(b) a risk analysis covering:
1. identifying possible scenarios of events and their causes that may result in a major accident;
2. an estimate of the consequences of major accident scenarios on life and animal health, environment and property;
3. an estimate of the annual frequency of major accident scenarios,
4. the determination of the risk level of major-accident scenarios based on the results of the results of the assessment of the consequences and frequency of the scenarios; and
5. evaluation of the range of emergency manifestations; and
(c) a risk assessment which includes an assessment of the acceptability of major-accident risks on the basis of a group risk criterion.
(3) The procedure for carrying out the risk assessment of a major accident and its scope is set out in Annex 1 to this Regulation.
The content and structure of the security programme
(Paragraph 10 (6) of the Act)
(1) Basic information on the premises includes identification data on the operator and the premises, identification data on the legal or natural person involved in the development of the security programme, activity and employee data, review of publicly available verified information on earlier accidents and accidents with the same substances and procedures as used in the premises, taking into account relevant experience gained and a direct reference to a description of the specific measures taken to prevent such accidents and a description of the object. The structure of the security programme, including its contents, is set out in Annex 3 to this Decree.
(2) In the description of major accident prevention principles, the operator shall base its assessment of the risks of a major accident. The principles of major accident prevention shall be consistent with the nature of the risk sources and shall aim clearly and clearly to ensure the adequate structure and functioning of the major accident prevention system.
(3) In the description of major accident prevention objectives, the operator shall determine the tasks to ensure compliance with the major accident prevention principles. The determination of tasks shall cover all thematic areas of the safety management system and such indicators, parameters and criteria as allow monitoring of the level of performance and evaluation of the effectiveness of the major accident prevention measures implemented.
(4) In the description of major accident prevention policy, the operator declares that it undertakes to implement the principles and objectives of major accident prevention. The obligation to implement this policy may also be met by appropriate means, structures and management systems, which are proportionate to the risk of a major accident and, at the same time, meet the requirements of the safety management system set out in Annex 2 to this Decree in both thematic and content.
(Paragraph 10 (6) of the Act)
(1) Safety management system means a summary of planning, decision-making, organisational, management, coordination, motivation, information, control and evaluation activities. The safety management system shall be proportionate to the major accident hazard, the activities and complexity of the management organisation in the building and shall be based on a risk assessment of the major accident. The safety management system shall include part of a general management system which shall include the setting of an appropriate organisational structure, the setting of responsibilities and responsibilities and shall define the rules, procedures and procedures for managing and providing resources for the identification, implementation and verification of the correctness of major accident prevention policy.
(2) The description of the safety management system shall indicate:
(a) the characteristics of the safety management system;
(b) data on individual thematic areas of the safety management system, which are:
1. human resources in the object and their management;
2. control of the operation of the building,
3. control of changes in the object,
4. emergency planning,
5. monitoring and assessing the achievement of the objectives established by the major accident prevention policy and the safety management system; and
6. audit of the safety management system and major accident prevention policy.
(3) The elements of the characteristics of the safety management system and the structure of the description of the different thematic areas of the safety management system are set out in Annex 2 to this Regulation.
Details of the content of the alert on the security programme review carried out
(Paragraph 11 (3) of the Law)
The details of the content of the alert on the security programme review carried out and its structure, including its contents, are set out in Annex 4 to this Decree.
The content of the safety report and its structure
(Paragraph 12 (6) of the Law)
The details of the content of the safety report and its structure, including the contents of the individual parts thereof, are set out in Annex 5 thereto.

The details of the content of the safety report and its structure, including its contents, are set out in Annex 6 to this Decree.
Assessment criteria for draft safety documentation and details of the content of the assessment
(Paragraph 18 (5) of the Law)
The elements of the content of the opinion, including the criteria for evaluation of the draft safety documentation, are set out in Annex 7 to this Decree.
Nature and range of information and documents which the processor is entitled to request
(Paragraph 19 (6) of the Act)
(1) In order to verify the data contained in the draft safety documentation, the opinion processor is entitled to require:
(a) the documents used for the processing of the draft safety file and, where appropriate, the data sources used for the processing of the draft safety file;
(b) an indication of the sources of meteorological data;
(c) an indication of the data sources of the population around the premises,
(d) records of evaluation of the internal emergency plan;
(e) evidence of the provision of knowledge of workers and suppliers of existing risks and the determination of their risk reduction tasks;
(f) supporting documents documenting the handling of malfunctions and accidents, including the results of the investigation of the causes and the corrective actions proposed;
(g) the documents and supporting documents of the operator, supporting sources of information for analysis, compliance with the requirements of major accident prevention and emergency planning policy.
(2) Where the scope of the documents referred to in paragraph 1 or the nature of the data contained therein is justified, it shall be sufficient for the processor to be able to examine the information contained in the draft safety file on the spot.
The content and structure of the internal emergency plan
(Paragraph 23 (8) of the Law)
(1) The internal emergency plan is a written document setting out:
(a) arrangements for emergency preparedness, including information, material, economic and human resources in the event of a major accident;
(b) how major accidents can be managed;
(c) measures ensuring appropriate monitoring of the consequences of a major accident and the remediation of the site of a major accident; and
(d) the method of documentation of protocols, amendments and updates.
(2) The structure of the internal emergency plan, including its contents, is set out in Annex 8 to this Decree.
Details of the content of the supporting documents for the determination of the emergency planning and processing area of the external emergency plan, their structure and their manner of processing
(Paragraph 27 (4) of the Law)
(1) The documentation for the establishment of the emergency planning and processing zone of the external emergency plan shall be prepared by the operator of an object listed in Group B on the basis of the results of the assessment of major accident scenarios in accordance with Sections 2 and 3, in particular with regard to the hazardous substances placed and the consequences of the major accident on lives and human and animal health, the environment and property.
(2) The elements of the content of the supporting documents for the establishment of the emergency planning zone and the processing of the external emergency plan and their structure, including the content of their individual parts, are set out in Annex 9 to this Decree.
Efficacy
This Decree shall take effect on 1 October 2015.

Method for carrying out the risk assessment of a major accident and its scope
The risk assessment of a major accident shall include the following chapters:
1. Identification of risk sources
1.1. Overview of dangerous substances in the building.
a) Updated list of hazardous substances in the building.
(b) Safety data sheets of dangerous substances (digitally on the data medium in the Annex).
1.2. Identification and selection of risk sources for a detailed risk analysis.
(a) Description of methods used, reference to literary sources.
b) Overview of individual devices with the data needed for the application of the selection method.
(c) Selection of risk sources for a detailed risk analysis, list of selected risk sources.
1.3. Description of selected sources of risk and map display of their location in the object.
(a) A description of the selected sources of risk (technology, production process) and their security.
(b) Indication of the distances of the selected sources of risk from interest sites depending on the manner of risk and the recipients (persons, environment, property).
c) Drawing the location of the risk source on the map of the object.
2. Risk analysis
2.1. Identification of possible situations and causes (conditions) that may lead to major accident initiation events, identification of initiation events and possible scenarios for major accident development.
a) An overview of possible situations and causes (conditions) within an object that may cause damage to human health, the environment and property, including the consideration of hazardous chemical reactions.
b) An overview of possible situations and causes (conditions) outside the premises that may cause damage to human health, the environment and property.
(c) Systematic comprehensive identification of the causes and description of the initiation events of possible major accident scenarios.
(d) Description of identified major accident scenarios.
2.2. Estimates of the consequences of identified major accident scenarios on the lives and health of humans and animals, the environment and property.
(a) Determination of criteria and limit values for estimating the consequences of identified major accident scenarios.
(b) Estimates of the consequences of identified major-accident scenarios on people's lives and health.
(c) Estimates of the consequences of identified major accident scenarios on the environment, animals and property.
(d) Evaluation of the impact of emergency manifestations, including graphical representation of the range of selected limit values for the effects of identified major accident scenarios.
2.3. Estimate of the resulting annual frequency of major accidents.
a) Display the major accident scenarios described by the event tree.
(b) Determination of the resulting major accident scenarios and their frequencies.
2.4. Determination of the group risk ratio of identified scenarios.

2.5. The results and procedure for assessing the influence (reliability and error) of the human factor.
(a) Identification of critical job positions.
(b) Analysis of tasks and activities carried out by staff at critical posts.
(c) Causes of failure of a human factor in critical labour positions and possible consequences of such failure.
(d) Implementing and planned preventive measures to eliminate human error.
3. Risk assessment
3.1. Evaluation of the acceptability of major accident risk.
The group risk of a major accident scenario for the surrounding area of the assessed object shall be considered acceptable if applicable.

Where the resulting frequency of the major accident scenario appears to be unacceptable, organisational and technical measures to reduce that risk and their implementation dates shall be laid down and a new risk analysis and assessment shall be carried out.
3.2. Overall risk assessment of the object.
The overall acceptability of the object's risk to its surroundings is subject to an acceptable annual frequency of major accident scenarios identified in point 3.1 for all scenarios evaluated, a summary of the environmental impact assessment of the major accident and an evaluation of the effectiveness and adequacy of preventive and repressive emergency measures.
