DECLARATION
of 21 August 2007
amending Decree No 364 / 2005 Coll., on the management of school and school documentation and school matrices and on the transmission of data from school and school documentation and school matrices (Decree on school and school documentation), as amended by Decree No 389 / 2006 Coll.
The Ministry of Education, Youth and Sports provides, pursuant to § 28 (6) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 383 / 2005 Coll.:
Decree No. 364 / 2005 Coll., on the management of school and school equipment documentation and school matrices and on the transmission of data from school and school equipment documentation and school matrices (School and school documentation), as amended by Decree No. 389 / 2006 Coll., is amended as follows:
1. in Article 3 (1) (a), "pupils or students" shall be replaced by "pupils, students and applicants for admission to education."
2. In Article 3, the sentence "The data transmitted shall also include changes in the content of the school matrices and documentation of the school or school establishment, which have occurred since the corresponding relevant date in the preceding calendar year, shall be added at the end of paragraph 2. '.
3. The following Section 3a is inserted after Section 3:
The Ministry or, where appropriate, the legal person established by it, shall anonymise the personal data processed under this Order no later than 30 years after their first processing. ';
4. In Annex No 1, point (a) of Article 1 (1), the words "except for entry for training 'shall be inserted after the word" year'; the data transmitted shall also include changes in the content of the school matrices and the documentation of the school or school establishment that has taken place since 1 September of the preceding calendar year; ';
5. In Article 2 (1) (b), Article 3 (1) (b) and Article 4 (1) (b) (2) and (3) of Annex 1 shall read as follows:
"2. citizenship,
3. the municipality in which it is resident on the territory of the Czech Republic or the State in which it is resident, if not the Czech Republic, '.
6. In Annex 1, the following paragraph 3 is added to Article 2:
"(3) The applicant for admission to higher education shall be provided with a set of data containing:
(a) the school department identifier and the relevant date;
(b) identification details of the tenderer:
1. birth number, year and month of birth, sex,
2. citizenship,
3. the municipality in which it is resident on the territory of the Czech Republic or the State in which it is resident, if not the Czech Republic,
(c) details of previous training of the tenderer:
1. the previous position of the tenderer;
2. the department identifier of the school in which the candidate obtained secondary education with a graduate examination, the field of education, the year of completion of the graduate examination,
(d) details of the training to which the applicant applies, including the field of education, duration and form of education;
(e) details of the outcome of the admission procedure and, where applicable, information on the training for which the applicant has been accepted, including the field of education, duration and form of training, and registration of the applicant for training in the relevant higher vocational school. "
7. In Annex 1, the following Article 5 is added:
Transmission of individual data from school matrices and primary school documentation
(1) The basic data set shall be transmitted on each primary school pupil and shall include:
(a) the school department identifier and the relevant date;
(b) the student's identification details:
1. birth number, year and month of birth, sex,
2. citizenship,
3. the municipality in which it is resident on the territory of the Czech Republic or the State in which it is resident, unless the Czech Republic is concerned,
(c) details of previous education of the pupil:
1. the previous place of employment of the newly admitted pupil,
2. the department identifier of the school in which the pupil was educated before taking up primary school education;
(d) details of the start of education at the relevant primary school, including the date and code of the start of education;
(e) details of completion of education at the relevant primary school:
1. date and code of completion of education at the relevant primary school;
2. an indication of how the training ends,
(f) data on the course of primary school education:
1. code of the field of education, duration of education,
2nd year in which pupils are educated, the number of compulsory school years completed,
3. identification of class, group,
4. language of instruction, codes of foreign languages to which the pupil learns,
5. teaching in foreign language, number of subjects, number of hours,
6. code of the course of education, repetition of the year, mode of compulsory education,
7. financing of education by the pupil from public budgets,
(g) control items:
1. a control resolution as to whether the pupil successfully completed the last year of primary education, completed the training by other means, or continues to be a pupil of the school;
2. date and type of data change code;
3. beginning of sentence, end of sentence.
(2) When transmitting data on pupils with special educational needs, pupils in the class for pupils with disabilities, pupils who are trained in accordance with the individual training plan and those who are particularly gifted shall be treated mutatis mutandis in accordance with Article 2 (2). ';
8. In Annex 2, Article 1 (3) and Article 1 (4) (a) are replaced by "14 October 'by" 10 October'.
9. In Annex No 2, in Article 1 (3), the sentence "The data referred to in Article 8a shall be transmitted on paper by 20 May or by electronic means at the latest by 31 May of the current school year at the relevant date of 15 May of the current school year. '
10. In Article 1 (5) of Annex 2:
"(5) Aggregated data referred to in Articles 25 and 26 shall be transmitted on paper for the previous school year by 9 September or electronically by 19 September of the current school year at the relevant date of 31 August of the previous school year."
11. In Article 2 (1) of Annex 2, the words "school, conservatory" shall be inserted after the words "medium."
12. Article 2 (2) of Annex 2 reads as follows:
"(2) Data for the current school year: number of teachers by school type, number of secondary school teachers, conservatory and higher vocational schools by class, number of teachers in classes or study groups for children, pupils or students with special educational needs, number of teachers by school type, other teaching staff, classrooms, use of information technology in teaching, number of foreign language teachers by school type. '
13. Article 3 (3) of Annex 2 reads as follows:
"(3) Where a parent or primary school has one or more separate workplaces, aggregated data shall be transmitted for the school broken down by individual separate workplaces. ';
14. in Article 5 (2) (g) of Annex 2, the words "disabled" are replaced by the words "with special educational needs."
15. In Annex 2, in Article 7 (2), the words "classes in daily form of education also according to fields of education" shall be added at the end of the text in point (a).
16. in Annex No 2, Article 7 (2) (f) and Article 8 (2) (f), the words "disabled" are replaced by the words "pupils with special educational needs."
17. In Annex 2, the following Article 8a is inserted after Article 8:
Transmission of aggregated data from school matrices and documentation from secondary school and conservatory regarding admission to education
(1) Data for the current school year: the number of applicants enrolled and admitted to the first year in the daily form of education in the first round of the admission procedure by field of education, type and length of education and previous place of work, the number of applicants enrolled and admitted to the first year of the higher grade of six and eight-year high school in the first round of the admission procedure according to the previous place of employment. No data shall be transmitted relating to secondary education, short studies for secondary education with a certificate and short studies for secondary education with a graduate examination.
(2) Aggregated data referred to in paragraph 1 shall not be passed on to schools for facilities for the exercise of constitutional or protective education. "
18. In Annex No 2, in Article 9 (2), the words ", study groups in the daily form of training according to training programmes' shall be added at the end of the text in point (a).
19. in Annex 2, in Article 9 (2) (f), the words "disabled" shall be replaced by "students with special educational needs."
20. In Article 15 (2) of Annex 2:
"(2) Data for the current school year:
(a) the separation of satellites with the allocation of the Disabled Student Unit, the participants registered for regular attendance, the interest services and participants therein;
(b) the number of disabled participants by type of disability;
(c) participants registered regularly by citizenship, foreigners by access to school services;
(d) the accounting number of teaching staff by category. "
21. In Annex 2, Article 16 (2) (d), the words "foreigners under the conditions of access to school services," shall be deleted;
22. in Annex 2, point (f) of Article 17 (2), the words "home or institution" are replaced by the words "establishment."
23. In Annex 2, in Article 18, the words ", further activities of interest education according to areas of interest education, competition in private education declared or co-declared by the Ministry of Education, Youth and Sports' shall be added at the end of the text in paragraph 1.
24. In Annex 2, in Article 18 (2), "age 'is replaced by", broken down into children, pupils, students and others'.
25. in Annex 2, in Article 19 (2) (d), the words "supplementary meals" shall be replaced by "complementary meals."
26. In Annex 2, in Article 24 (1), the word "client 'shall be inserted after the word" arrival' and the word "provided 'shall be inserted after the word" species'.
This Decree shall take effect on the day of its publication, except for Article I (6), which shall take effect on 1 January 2008.
